"(e) All assessments under this section, when collected,

2 shall be deposited in the Treasury of the United States in a

3 separate fund. There is hereby authorized to be made avail4 able for expenditure from the fund such amounts as the Con5 gress may deem appropriate for the necessary expenses of 6 the Secretary of Labor for the performance of his functions 7 under the Act, except those specified in subsection (j) of 8 this section.

9 "(f) The Secretary shall have authority to make such 10 regulations as he deems necessary or appropriate to carry out 11 the purposes of this section, including, but not limited to, pro12 visions for the making and preservation of appropriate rec13 ords, the inspection of such records, and the submission by 14 carriers and self-insurers of reports prescribed by the Secre

tary.

16 "(g) In the event of failure by any carrier or self17 insurer to pay the assessments referred to in subsection (c) 18 of this section, to make and preserve records in the form and manner required by the Secretary, or to file a report in the 20 form and manner required by him, or a denial of the right of 21 the Secretary to inspect records required by regulations issued 22 under this section, the Secretary may suspend or revoke the 23 authorization of a carrier to insure compensation or a self24 insurer to act as a self-insurer under this Act.

“(1) The Act of May 17, 1928, as amended, entitled 'An Act to provide compensation for disability or death resulting from injury to employees in certain employment in the District of Columbia, and for other purposes' (45 Stat. 600);

"(2) The Defense Base Act, as amended, approved August 16, 1941 (55 Stat. 622);

"(3) Section 4 (c) of the Outer Continental Shelf

Lands Act, approved August 7, 1953 (67 Stat. 462);

"(4) Section 2 of the Act of June 19, 1952, as amended, entitled 'An Act to confirm the status of

certain civilian employees of nonappropriated fund instrumentalities under the Armed Forces with respect to

laws administered by the Civil Service Commission, and for other purposes' (66 Stat. 139);

18 and such extensions as may be made from time to time to 19 provide compensation for disability or death resulting from 20 injury occurring to persons engaged in private employment. 21 other than extensions in which it is provided that liability 22 for such compensation will be assumed by the United States 23 Government or its instrumentalities. The Secretary shall 24 treat the administration of extensions to which this section

1 applies as a part of the administration of this Act in com2 puting assessments due.

3 "(i) The provision of subsection (d) of section 44 of

4 this Act shall be applicable to the fund established under this 5 section.

"(j) This section shall not apply to costs incurred in 7 administering section 41 of the Act, as added by section 1 8 of the Act of August 23, 1958 (72 Stat. 835)."

APPROPRIATION

SEC. 16. Section 46 (b) of such Act is amended to read 11 as follows:

"(a) There is authorized to be appropriated out of any moneys in the Treasury not otherwise appropriated for the 14 fiscal year beginning July 1, 1968, the sum of $1,420,000 to be deposited in the separate fund established under section 16 45 of this Act.

"(b) There is authorized to be appropriated in succeed18 ing years sums which may be necessary to administer this 19 Act including sums with respect to claims for which the 20 Federal Government is liable and sums required whenever 21 sufficient assessments are not collected and made available

22 to the Secretary of Labor as provided by this Act.

REPEAL AND RENUMBERING

SEC. 17. Section 47 of such Act is repealed and sections

25 48, 49, and 50 are renumbered, 47, 48, and 49 respectively.

TECHNICAL AMENDMENT

SEC. 18. Section 3 (a) (1) of such Act is amended by

3 striking out the word "nor" and substituting the word "or".

5 SEC. 19. The amendments made by sections 14, 15, and

6 16 of this Act shall become effective July 1, 1968. All other 7 amendments shall become effective six months after the date 8 of enactment.

A BILL

To increase the monthly disability and death compensation payable to certain persons under the War Hazards Compensation Act, and for other purposes.

1 Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That (a) notwithstanding any other provision of law, the 4 monthly disability and death compensation payable pursu5 ant to section 101 (a) of the War Hazards Compensation 6 Act (42 U.S.C. 1701 (a)) shall, with respect to disabilities 7 or deaths resulting from injury sustained prior to July 1, 8 1946, be increased by 25 per centum.
