Annual Report of the Board of State Auditors.

To the Honorable the Legislature of the State of Michigan:

In obedience to the law creating the Board of State Auditors, we have the honor to report the following account of the proceedings of said Board during the past year.

In addition to the duties imposed upon the Board by the act which created it, several other matters have been referred to the Board by acts and resolutions of 1843.

By the "act providing for the final adjustment of all unsettled claims for damages growing out of the internal improvements of this state," claims of that nature, upon the various works of internal improvement, which occurred prior to the first day of April, 1842, have been placed before the Board for adjustment during the past summer.

Upon an investigation of the different claims, it became impossible to adopt one general rule which would apply in all cases; but in a large majority of the cases, the Board have allowed the claimant forty cents per rod for all necessary fences which the construction of the different works made it necessary for the claimant to build, and a reasonable compensation for the land, if taken before improved. In cases where the land had been taken since improved, a fair valuation for the improvement has been given. In other cases, where it has been made to appear by affidavits, or other testimony, that the claimant had sustained damages which would not be included in the fencing and a reasonable valuation of the land taken by the state, a reasonable compensation, in addition, has been allowed.

The Board are sensible that, in a large majority of cases, the state would not have been put to this heavy expense for damages, if a proper prudence had been observed by the public officers who had charge of these works, and the right of way obtained before the state took possession of the claimant's lands.
