16 1 The remainder of such allotment shall be available to such 2 State only for paying 21 22203 222 "(3) such percentage as the Secretary determines, but not more than 90 per centum, of the cost of social or nutritional services provided under a program or project approved by the area agency on aging in a planning and service area for which there is an area plan approved by the State agency; and "(4) in the case of social or nutritional services provided under a program or project approved by the State agency under the State plan in a planning and service area for which there is no area plan approved by the State agency, such percentage as such agency determines, but not more than 75 per centum of the cost of such services for the first year they are so provided, not more than 60 per centum of such cost for the second year they are so provided, and not more than 50 per centum of the cost of such services for the third year they are so provided; except that not more than 10 per centum of an allotment to a State under section 303 for a fiscal year shall be avail able for payments for social or nutritional services provided 23 in a planning and service area for which there is no area 24 plan approved by the State agency, and except that not more than 65 per centum nor less than 35 per centum of 17 1 such an allotment shall be available for payments for nutri 2 tional services provided under the State plan. 3 4 "(b) Payments of grants or contracts under this title may be made (after necessary adjustments on account of 5 previously made overpayments or underpayments) in ad 6 7 vance or by way of reimbursement, and in such installments, as the Secretary may determine. From the portion of a 8 State's allotment for a fiscal year which is available pursuant 9 to subsection (a) (1) the Secretary may advance to a State 10 which does not have a State plan approved under section 11 305 such amounts as he deems appropriate for the purpose 12 of assisting such State in developing a State plan. 13 "(c) No allotment to a State under this title shall be 14 available for making payments with respect to any program 15 or project for providing nutritional or social services under 16 a State plan approved under section 305 after payments 17 have been made from such allotments with respect to such 18 19 program or project for a period of time equal to three calendar years. No allotment to a State under this title shall be avail20 able for making payments with respect to the administration 21 of an area plan approved under section 305 (a) (8) after 22 payments have been made from such allotments with respect 23 to the administration of such plan for a period of time equal 24 25 to three calendar years. "(d) Not less than 25 per centum of the non-Federal 18 1 share (pursuant to subsection (a) of this section) of the 2 total expenditures under the State plan shall be met from 3 funds from State or local public sources. 4 5 "(e) A State's allotment under section 303 for a fiscal year shall be reduced by the percentage (if any) by which 6 its expenditures for such year from State sources under its 7 State plan approved under section 305 are less than its ex8 penditures from such sources for the preceding fiscal year. 9 10 "MODEL PROJECTS "SEC. 307. The Secretary may, after consultation with 11 the State agency, or the Governor of the State where there 12 is no State agency, make grants to or contracts with any 13 public or nonprofit private agency or organization within 14 such State for paying part or all of the cost of developing 15 or operating statewide, regional, metropolitan area, county, 16 city, or community model projects which will expand or 17 improve social or nutritional services or otherwise promote 18 the well-being of older persons. 19 20 21 222 "AVAILABILITY OF SURPLUS COMMODITIES "SEC. 308. (a) Agricultural commodities and products purchased by the Secretary of Agriculture under section 32 22 of the Act of August 24, 1935 (7 U.S.C. 612c), may be 23 donated to public or nonprofit private agencies or organiza24 tions to be used for providing nutritional services in accordance with the provisions of this title. 25 1 19 "(b) The Commodity Credit Corporation may dispose 2 of food commodities under section 416 of the Agricultural 3 Act of 1949 (7 U.S.C. 1431) by donating them to public or 4 nonprofit private agencies or organizations to be used for 5 providing nutritional services in accordance with the pro6 visions of this title. 7 8 "(c) Dairy products purchased by the Secretary of Agriculture under section 709 of the Food and Agriculture 9 Act of 1965 (7 U.S.C. 1446a-1) may be used to meet the requirements of programs providing nutritional services in 10 11 accordance with the provisions of this title." 12 13 14 REPEAL OF LIMITATION ON APPROPRIATIONS AUTHORIZATION SEC. 3. Title VII of the Older Americans Act of 1965 15 is amended by striking out section 703 thereof and re 16 designating sections 704 and 705 as sections 703 and 704, 17 respectively. 18 19 EVALUATION SEC. 4. The section redesignated as section 703 of the 20 Older Americans Act of 1965 by section 3 of this Act is 21 amended by striking out "or VI or section 703" and in22 serting in lieu thereof ", IV or V". 23 REPEAL OF STUDY AUTHORIZATION 24 SEC. 5. Title V of the Older Americans Act of 1965 255 25 is amended by striking out section 503 thereof. 20 1 2 CONFORMING AMENDMENTS SEC. 6.
