A BILL

To provide for the continuation of programs authorized under the Older Americans Act of 1965, and for other purposes.

1 Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That this Act may be cited as the "Older Americans Amend4 ments of 1972”.

SEC. 2. Title III of the Older Americans Act of 1965 is

7 amended to read as follows:

"TITLE III-GRANTS FOR STATE AND AREA

PROGRAMS

"SEC. 301. It is the purpose of this title to encourage

4 and assist State or local agencies to develop greater capacity 5 and foster the development of coordinated service systems to

serve older persons by entering into new cooperative ar

rangements with each other and with providers of social

or nutritional services for planning for the provision of, and 9 providing, social or nutritional services and, where necessary, to reorganize or reassign functions, in order to

"(1) secure and maintain maximum independence and dignity in a home environment for older persons capable of self-care with appropriate supportive services and for whom economic independence is not feasible; and

"(2) remove individual and social barriers to economic and personal independence for older persons capable of self-support.

"DEFINITIONS

"SEC. 302. For purposes of this title

"(1) The term 'social services' means any of the

following services which meet such standards as the Sec

retary may prescribe:

"(A) health, continuing education, welfare, infor

1 mational, recreational, homemaker, counseling, or refer

ral services;

"(B) transportation services where necessary to facilitate access to social or nutritional services;

"(C) services designed to encourage and assist older

persons to use the facilities and services available to

them;

"(D) services designed to assist older persons to

obtain adequate housing; or

"(E) any other services;

11 if such services are necessary for the general welfare of

12 older persons.

13 "(2) The term 'nutritional services' means any of 14 the following services which meet such standards as the 15 Secretary may prescribe:

"(A) provision of nutritionally balanced meals for

older persons served in group settings;

"(B) provision of home delivered meals for older persons requiring such service because they are disabled or for other health reasons;

"(C) nutrition education services for older per

sons; or

"(D) any other services;

if such services are designed to meet the dietary needs of

2 older persons.

"(3) The term 'unit of general purpose local govern4 ment' means (A) a political subdivision of the State whose 5 authority is broad and general and is not limited to only one 6 function or a combination of related functions, or (B) an 7 Indian tribal organization.

"(4) The term 'coordinated system' means a system for 9 providing social services and nutritional services in a man

ner designed to

"(A) facilitate accessibility to and utilization of all social services and nutritional services provided within the geographic area served by such system by any public or private agency or organization;

"(B) make the most efficient use of social services and nutritional services in meeting the needs of older persons; and

"(C) use available resources efficiently and with a minimum of duplication.

"(5) The term 'Governor' means the Governor of the

State, in the case of any of the fifty States, and, in the

22 case of the other States, the chief executive officer thereof.

"ALLOTMENTS

"SEC. 303. (a) (1) From the sum appropriated for a fis

25 cal year for allotments to States, the Virgin Islands, Guam,

1 American Samoa, and the Trust Territory of the Pacific 2 Islands each shall be allotted an amount equal to one-half 3 of 1 per centum of such sum and each other State shall be 4 allotted an amount equal to 1 per centum of such sum. 5 "(2) From the remainder of the sum appropriated for 6 a fiscal year for allotments to States, each State shall be 7 allotted an additional amount which bears the same ratio

to such remainder as the number of individuals in such 9 State who have attained age sixty-five bears to the total 10 number of individuals in all the States who have attained 11 such age, as determined by the Secretary on the basis of 12 the most recent satisfactory data available to him.

"(b) Whenever the Secretary determines that any 14 amount allotted to a State for a fiscal year under this sec15 tion will not be used by such State for carrying out the 16 purpose for which the allotment was made, he may make 17 such amount available for carrying out such purpose to one

or more other States to the extent he determines such other 19 States will be able to use such additional amount for carry

20

ing out such purpose. Any amount made available to a

21 State from an appropriation for a fiscal year pursuant to the

preceding sentence shall, for purposes of this title, be re

23 garded as part of such State's allotment (as determined 24 under the preceding provisions of this section) for such
