CONTRACTOR'S PROPOSAL FOR BUILDING WORK

Problem: The Board of Education of Parkville, N. K., has undertaken the standardization of the form of "proposal for building work" which shall be accepted from contractors bidding on school building construction.

The special committee of the Board of Education to which this task has been assigned finds a wide range in practice with respect to the form of proposal. Form A represents the minimum type of form used by a neighboring school system; Form B represents another rather common practice.

FORM A

PROPOSAL FOR BUILDING WORK

(a) The undersigned, having carefully examined the Instructions to Bidders, the General Conditions of the Contract and Specifications entitled, "Wilson Junior High School" and the Drawings, similarly entitled, numbered 1 to 70 inclusive, as well as the premises and the conditions affecting the work, the undersigned proposes to furnish all materials and labor called for by them under Building Work, Sections I to X inclusive, in accordance with the said documents for the sum of...

(b) The undersigned agrees that if, within fourteen (14) days from the day named for delivering the proposal, notice that this proposal will be accepted by the Owner shall be mailed him at the business address given below or shall be delivered to him, he will execute and deliver to the Architect within six (6) week days thereafter a contract and bond properly executed in the forms annexed. The bond is to be in an amount equal to 50 per cent of the contract price and of a surety company satisfactory to the Owner. (c) The undersigned further agrees that the certified check pay

able to the City of Riverside, N. K., Owner, accompanying this proposal, is left in escrow with the City Auditor, that its amount is the measure of liquidated damages which the Owner will sustain by the failure of the undersigned to execute and deliver the above named Agreement and Bond, and that if the undersigned defaults in executing that Agreement within six (6) days of written notification of the award of the contract to him or in furnishing the Bond within six (6) days thereafter, then the check shall become the property of the Owner, but if this proposal is not accepted within fourteen (14) days of the time set for the submission of bids, or if the undersigned executes and delivers said Contract and Bond, the check shall be returned to him on receipt therefor.

(d) The undersigned further agrees, that in case he obtains the award, he will employ, subject to the Architect's approval, subcontractors in each of the several trades named below:

The above price includes all charges and expenses for the furnishing of all materials and labor for the erection, construction, and in all respects completing the aforesaid work in manner and under conditions specified.

The undersigned states that he has carefully examined the drawings and specifications, advertisements, instructions to bidders, and forms of contract and bond, and that he has fully informed himself regarding all conditions at the site and pertaining to the work to be done; and that he will to the satisfaction of the Architects, do all the work, furnish all the materials and assume all responsibilities, even though not specially mentioned, but which are necessarily required or reasonably implied to obtain the completed conditions contemplated, in accordance with the drawings and specifications as interpreted by the said Architects.

The undersigned agrees that should a contract be awarded him, he will furnish a satisfactory bond, in amount one-third that of his contract, executed upon the blank form in use by the Architects, by a Surety Company acceptable to the said Owner, and qualified to do business under the laws of the State of....

ment, instructions to bidders, drawings and specifications, and the satisfactory completion of the work therein required and shown within the time stated, and covering all guarantees required for maintenance or repair or replacing of defective work, the prompt payment of any person furnishing material or labor for the execution of the work under his contract, and the settlement of all claims, liens or other liabilities caused by or incident to the execution of the work or to the use of patented articles.

The undersigned submits the name of.

The undersigned does further agree that should a contract be awarded him, he will bind himself to complete the same within the time stated in the specifications and contract, and in case of failure to complete the work within the time so fixed, or at other than the time to which completion may have been extended as provided for under certain conditions, the Owner may deduct and retain out of any moneys due or thereafter to become due for fixed, settled, and liquidated damages, the sum of
