The Owner will not receive the bids of persons who are in arrears to the Owner as an individual, corporation, municipality, district, or to whatever body he may be acting as lawful agent, or who are in default, either as Contractors or sureties, or with whom a suit as to arrears or default is pending, and the decision of the Owner on these matters shall be final.

The bidder shall provide the Architect of the Owner all possible facilities for examining the quality of the materials proposed to be furnished, and for obtaining such samples as he may require. The materials furnished under the Contract must equal in quality said samples and be satisfactory to the Architect.

Bidders must satisfy themselves, by personal examination of the location of the proposed work, and by such other means as they may prefer, as to the actual conditions and requirements of the work and the accuracy of the plot plans of the Architects, and shall not, at any time after the submission of a bid, dispute or complain of such conditions, nor assert that there was any misunderstanding in regard to the nature or amount of work to be done.

The bidder is expected to make himself familiar with the laws of the State and the ordinances of the municipality which refer to the employment of labor, or the letting or carrying out of Contract work, and to observe and comply therewith, whether or not special attention is called to them herein or in the Proposal Contract, or Specifications which accompany this Information for Bidders.

Each bidder is required to state in his bid the names of all persons interested with him, and if no other person be so interested, he shall distinctly state the fact; also that it is made without any connection with any other person making any bid for the above work; also that the bid is in all respects fair, and made without collusion or fraud; and that no person acting for, or employed by the Owner is directly or indirectly interested therein, or in the supplies or work to which it relates, or in any portion of the profits thereof. The Proposal must be sworn before some official authorized to administer oaths. Bidders are invited to be present at the opening of bids.

CASE 2

NOTICE TO CONTRACTORS

Office of the Secretary of the Board of Education of the
City of Mercersville

Notice is hereby given that the Board of Education of the City of Mercersville hereby calls for sealed proposals to be delivered to the Secretary of said Board, Room 122, City Hall, Mercersville, N. K., until Thursday, the 21st day of October, 1926, at 11:00 A.M., at which time said bids will be opened, for the erection and completion of the Senior High School Building, located on property bounded by Hilldale Avenue and 24th Street.

These bids shall be presented in accordance with plans and specifications for said building on file in the office of the Secretary of the Board of Education, City Hall, and in the office of the Superintendent of Buildings, Room 304, 421 G Street, Mercersville, N. K. Separate bids will be received for:

(1) General Work.

(2) Plumbing, Heating and Ventilating.

On a deposit of Twenty-five Dollars ($25), complete sets of plans and specifications may be had by any bidder on application to the Superintendent of Buildings at his office hereinbefore mentioned, and in each case shall be returned within ten (10) days after securing same, to the Superintendent of Buildings. If the plans and specifications are not returned within said time, or if mutilated, the said deposit shall be retained by the said Board of Education as agreed and liquidated damages for said mutilation or detention.

Bids must be made on proposals obtained at the office of the Superintendent of Buildings, and be signed by the bidder and accompanied by a certified check, certified to by some responsible bank or banker, and made payable to the Board of Education of the City of Mercersville, N. K., to be retained by said Board of Education as agreed and liquidated damages should the party or parties to whom the contract should be awarded fail to enter into the contract after the award, or to give bonds required for the faithful performance of the contract, or any bond required by law. The amount of said check shall not exceed Five Thousand Dollars ($5,000), but for all bids of less than Fifty Thousand Dollars ($50,000), said check shall be for at least ten per cent (10%) of the

amount of the bid. Each bidder shall execute the affidavit accompanying the proposal obtained from the Superintendent of Buildings.

Bids will be opened by the Board of Education on Thursday, the twenty-first day of October, 1926, at 11:00 A.M., in the Board Room, 122 first floor, of said City Hall, in said City of Mercersville, N. K. The Board reserves the right to reject any and all bids or any or all items of such bids.

PUBLIC NOTICE TO BIDDERS ON SCHOOL
BUILDING CONTRACTS

Problem: The clerk of the Board of Education of Grant Centre, N. K., has submitted to the superintendent of schools for approval the formal "notice to bidders" for the construction contracts of the new high school building.

The notice follows:

NOTICE TO BIDDERS

GRANT CENTRE HIGH SCHOOL BUILDING

Public notice is hereby given that the Board of Education of the Village of Grant Centre, N. K., in the county of Chenango, will meet at its office in the Village Hall on Thursday, February 25, 1926, at the hour of 8:30 o'clock in the evening, and then and there will receive and open sealed proposals for furnishing labor and material to erect and complete a new high school building, located at the corner of Cherry Street and Walnut Road. The bids are to be as follows:

1. For the general construction, which includes all masonry, carpentry, steel and iron, painting, etc., and all work kindred thereto.

2. For plumbing and gas fitting, and all work kindred thereto. 3. For heating and ventilating, and all work kindred thereto. 4. For electrical work.

The Board of Education reserves the right to accept or reject any or all proposals, and waive informalities at its discretion.

All bids must be in sealed envelopes and marked "Proposals for New High School," and stating the branch of work covered, addressed to the Board of Education.

Terms and proposals and surety required are fixed by the specifications.

A copy of the drawings and specifications, proposal, contract, and bond forms, will be on file at the Board Room of the Board of Education, Village Hall, Grant Centre, N. K., on and after Wednesday, February 10th, 1926, during school hours and on Monday, Tuesday, and Wednesday evenings, February 15th, 16th, and 17th, between 7:30 and 9:30 o'clock for the purpose of estimating. Blank proposals may be obtained at the office of the Architects, Marysville, N. K.

The Architects will provide a limited number of copies of drawings and specifications which will be loaned by them to prospective bidders upon deposit with them of a certified check to their order of Fifty Dollars ($50.00). If drawings and specifications are returned and bid submitted, the check will be returned after opening of bids; but if drawings and specifications are returned and bid not submitted, Ten Dollars ($10.00) will be deducted from the deposit, as cost of prints used. Should the drawings and specifications not be returned as above, the deposit may become forfeited.
