The Committee recommends an appropriation of $1,800,000, the same as the budget request and the House allowance.

The Fishermen's Guaranty Fund appropriation provides reimbursement to owners of U.S. commercial fishing vessels which are seized by foreign countries on the basis of claims either to territorial waters or to the high seas which are not recognized by the United States.

The Committee recommends an appropriation of $1,000,000, the same as the budget request and $1,000,000 above the House allowance. Under the Fishermen's Protective Act of 1967, as amended by Public Law 98-364, the Fishermen's Protective Fund provides timely reimbursement to owners of U.S. vessels seized by foreign governments for the cost of securing release of the vessel and crew. The fund provides reimbursement for any direct charges, such as fines, license fees, registration fees, et cetera, incurred by the owner in order to secure release of the crew and vessel.

GENERAL PROVISIONS-DEPARTMENT OF STATE

Section 301 of the bill permits funds appropriated in this act for the Department of State to be available for allowances and services as authorized by 5 U.S.C. 3109 and passenger or freight transportation. This provision was carried in the fiscal year 1987 continuing resolution. The Committee has restored section 302 which requires the Secretary of State to report to the appropriate committees of Congress on the obligation of funds provided for diplomatic security and related expenses every month beginning November 1, 1987. The Committee expects the Department of State to continue to provide monthly reports to the appropriate committees of the Congress concerning the obligation of funds provided for diplomatic security and related expenses.

TITLE IV-THE JUDICIARY

The funds provided under title IV of the bill are for the operation of the Federal courts, including salaries of judges, judicial officers and employees, and other expenses of the Federal judiciary. The budget requests for the judiciary are submitted to the Congress without revision by the Office of Management and Budget in accordance with the Budget and Accounting Act of 1921, as amended.

The budget request submitted for fiscal year 1988 for the activities of the Federal judiciary totals $1,460,678,000. The Committee recommends a total of $1,405,108,000 to carry out these activities. This amount is $55,570,000 less than the budget requests but $145,400,000 more than the total amount available to date for the judiciary for fiscal year 1987. SUPREME COURT OF THE UNITED STATES

The Committee recommends an appropriation of $15,900,000 for the Supreme Court. This is $387,000 more than fiscal year 1987 appropriations, the same as the House allowance, and $141,000 less than the budget request.

This appropriation provides for salaries of the Chief Justice and the Associate Justices, salaries of officers and employees of the Court, printing and binding of Supreme Court reports, books for the Supreme Court, and miscellaneous expenses. The Committee recommendation includes funding to meet increases in contract rates and charges for services, supplies, and equipment.

The Committee recommends an appropriation of $2,200,000, a decrease of $136,000 from fiscal year 1987 appropriations to date and the same as the House allowance. The amount recommended is $462,000 below the budget request.

This appropriation provides for the structural and mechanical care of the U.S. Supreme Court building and grounds, including maintenance and operation of mechanical equipment.

The Committee recommends an appropriation of $8,000,000 for the Court of Appeals for the Federal Circuit. This is $98,000 less than the budget request. $1,080,000 above fiscal year 1987 appropriations to date, and $500,000 more than the House allowance. The recommendation includes funds to cover an increase in rental charges to be assessed by the General Services Administration, increases in employee compensation, contract rates, and charges for services and supplies, as well as personnel and equipment associated with the filling of three vacant judgeships. The Committee recommends an appropriation of $8,100,000, which is an increase of $982,000 over fiscal year 1987 appropriations to date and the same as the House allowance. The recommendation is $111,000 less than the budget request. The Committee recommendation provides for the salaries of the nine judges, supporting personnel, and necessary operating expenses of the U.S. Court of International Trade.

COURTS OF APPEALS, DISTRICT COURTS, AND OTHER JUDICIAL SERVICES

The Committee recommends an appropriation of $1,143,583,000, an increase of $139,563,000 over 1987 appropriations to date. The recommendation is $38,323,000 more than the House allowance but $33,920,000 below the request.

This account provides for the salaries of judges, magistrates, and all other officers and employees not otherwise specifically provided for, and for all necessary expenses including charges for space and facilities. The Committee recommendation will substantially meet the courts' request for fiscal year 1988, including uncontrollable cost increases associated with GSA space rental charges, employee compensation, services

and supplies; as well as changes resulting from legislation enacted during the 99th Congress, workload increases, and new program initiatives.

The Committee has inserted language enabling the judiciary to utilize the fees collected pursuant to 28 U.S.C. 1931.

The Committee recommends an appropriation of $88,740,000, which is an increase of $882,000 over 1987 appropriations to date. The amount recommended is $9,700,000 less than the budget request and $1,660,000 less than the House allowance.

This appropriation provides funds for the operation of the Federal public defender and community defender organizations and the compensation, reimbursement, and expenses of attorneys appointed to represent persons under the Criminal Justice Act of 1964, as amended.

The amount recommended, along with fiscal year 1987 carryover balances, allows for annualization of costs associated with the January 1, 1987, Federal pay raise and the judicial pay raise and provides for increases in case activity.

The Committee recommends an appropriation of $46,135,000. The amount recommended is $6,000,000 less than the budget request and the fiscal year 1987 level, and $4,265,000 less than the House allowance. This appropriation provides for the compensation of jury commissioners and land commissioners and for the fees and allowances of grand and petit jurors, including expenses associated with sequestered jurors and transportation of juries of view. Budgetary requirements depend largely upon the volume and length of jury trials demanded by parties to both civil and criminal actions and the number of grand juries being convened by the courts at the request of U.S. attorneys. The Committee recommendation, along with unobligated carryover balances, will meet the needs of this appropriation during fiscal year 1988.

The Committee recommends an appropriation of $42,600,000 for court security. This amount is $3,700,000 less than the budget request, $6,600,000 above the fiscal year 1987 level, and the same as the House allowance.

This appropriation provides for the necessary expenses of security and protective services for the U.S. courts in courtrooms and adjacent areas. The Committee recommendation will allow for uncontrollable cost increases, annualization of 1987 contract security officer positions, and a portion of the workload increases and program initiatives.

The Committee recommends an appropriation of $33,000,000 for the salaries and expenses of the Administrative Office of the U.S. Courts. This amount is $666,000 less than the request, but $2,816,000 more than the fiscal year 1987 appropriation, and $500,000 above the House allow

ance.

Provision has been made for the new positions requested by the Administrative Office, but denied in the fiscal year 1987 supplemental. As in the past, the Committee expects the Director of the Administrative Office to establish priorities and allocate these positions based on workload and program objectives. The amount recommended allows for uncontrollable cost increases associated with GSA space rental charges, an additional six positions, employee compensation, services, and supplies.

HOUMA, LA, COURTHOUSE

The Committee directs the Administrative Office of the United States Courts, in cooperation with the Judicial Conference of the United States, to explore the prospects of establishing facilities or utilizing existing structures in Houma, LA, for holding U.S. district court in the Eastern District of Louisiana. The Committee further directs the Administrative Office to prepare a comprehensive review and analysis toward this end by February 1, 1988.

The Committee recommends an appropriation of $11,500,000, an increase of $676,000 over 1987 appropriations to date. The amount recommended is $522,000 below the budget request but $500,000 more than the House allowance. The amount recommended allows for uncontrollable cost increases associated with GSA space rental charges, employee compensation, services and supplies, as well as annualization of the fiscal year 1987 supplemental.
