Section 106 transfers loans made under the authority of the Trade Act of 1974 to the Economic Development Revolving Fund.

Section 107 authorizes the Secretary of Commerce to exchange land in order to expand the NOAA facility in Pascagoula, MS.

Section 108 establishes a buying power maintenance fund for the Department of Commerce. This fund will help the Department cope with fluctuations in foreign currencies and is similar to funds previously established for the Department of State and the Board for International Broadcasting.

TITLE II-DEPARTMENT OF JUSTICE

The total amount of new budget authority recommended by the Committee for the Department of Justice is $5,303,943,000, which is $354,000,000 more than the 1987 appropriation, $17,237,000 less than the budget estimates, and $55,193,000 over the House allowance for the Department.

ENFORCEMENT OF THE ARCHEOLOGICAL RESOURCES PROTECTION ACT

The Committee is supportive of administration efforts to protect the cultural artifacts that document the diverse heritage of the Nation. The Committee is especially pleased that the interagency archeological task force is making a coordinated effort to improve the protection of our archeological resources.

The Department of the Interior and the U.S. Forest Service have made progress in protecting archeological sites against destruction and looting, but much remains to be done. There are an estimated 2 million archeological sites in New Mexico, Arizona, Colorado, and Utah. Over 800,000 of these sites are in New Mexico alone. One-third of all recorded archeological sites in the Southwest have been looted, but the problem is of national proportion. In 1985, two-thirds of all documented archeological vandalism on Park Service land occurred in the mid-Atlantic region.

The Committee believes that Department of Justice resources must be specifically assigned to insure that the Archeological Resources Protection Act [ARPA] is properly enforced. Accordingly, the Committee directs that not less than $1,000,000 be allocated for the arrest and prosecution of persons trafficking in looted archeological artifacts. The Committee expects a report from the Department not later than February 1, 1988, of the Department's activities with regard to the enforcement of the ARPA.

The Committee recommends an appropriation of $93,580,000, an increase of $18,405,000 over the 1987 appropriations to date. The amount

recommended is $9,933,000 less than the budget request but $3,180,000 more than the House allowance.

This appropriation funds the development of policy objectives and the management of the Department and two organizations responsible for the administrative review and appeal of decisions relating to individuals: the Executive Office for Immigration Review and the Pardon Attorney.

The Committee recommendation provides for uncontrollabe cost increases, savings from management initiatives, and nonrecurring decreases. The Committee has approved requested program increases of $106,000 and 2 positions to meet the increased foreign intelligence and counterintelligence related workload in the Office of Intelligence Policy and Review and $999,000 and 13 positions for the Executive Office of Immigration Review. Additionally, the recommendation reflects a reduction to the fiscal year 1988 base resulting from decreases in the Fiscal Year 1987 Supplemental Appropriations Act, Public Law 100-71 and a general reduction of $150,000.

WORKING CAPITAL FUND

$4,000,000

The Committee recommendation denies the requested increase of $4,000,000 in the working capital fund to relocate the Washington, DC, data center. The Committee has included bill language allowing the Department to derive this additional capital from current operating in

The Committee recommends an appropriation of $12,164,000, $1,625,000 over the 1987 appropriations to date. The amount recommended is $89,000 less than the budget estimate and the House allowance. The Committee recommendation provides for uncontrollable cost increases, nonrecurring decreases, and requested program growth. The Committee has also made a general reduction of $86,000.

The U.S. Parole Commission is an independent body within the Department of Justice which makes decisions regarding the granting or denial of parole, conditions of parole, supervision of parolees and mandatory releases, recommitment in the event of violation of the conditions of supervision, and termination of supervision as outlined in the 1976 Parole Commission and Reorganization Act.

The Committee recommends an appropriation of $254,650,000, an increase of $33,757,000 over 1987 appropriations to date. The amount recommended is $48,836,000 less than the budget request but $16,651,000 more than the House allowance after excluding funds designated by the House for antitrust activities.

This appropriation supports the Attorney General through the establishment of litigative policy, conduct of litigation, and various other legal responsibilities, through the Office of the Solicitor General, the Tax Division, the Criminal Division, the Office of Legal Counsel, the Civil Rights Division, the Land and Natural Resources Division, the Civil Division, and Interpol.

The Committee recommendation will provide for the requested uncontrollable increases, nonrecurring decreases, and management savings. The Committee has also made a general reduction of $324,000. In addition, the recommendation provides a portion of the requested program increases for the Criminal Division ($1,420,000 and 12 positions), the Tax Division ($3,100,000 and 30 positions), the Civil Division ($5,738,000 and 50 positions, including $1,390,000 and 11 positions for the Immigration Litigation Program), and the Lands and Natural Resources Division ($2,451,000 and 13 positions). The Committee has provided the full funding requested for the Civil Rights Division, and Interpol. The recommendation does not include the requested increase for office automation projects.

The Committee has once again denied the merger of the U.S. Attorneys and the Antitrust Division into the "General legal activities" account and kindly suggests to the Department to cease and desist from resubmitting this proposal.

The Committee recommends an appropriation of $48,260,000, an increase of $4,315,000 over the 1987 appropriations to date. The amount recommended is $1,859,000 more than the budget request and the

House allowance for antitrust activities included in the "General legal activities" appropriation.

The Committee has denied the proposed decrease of $2,109,000, as well as the request to merge this appropriation with the "General legal activities" account. However, the Committee has made a general reduction of $250,000.

The Antitrust Division acts on antitrust cases before the Supreme Court as authorized by the Solicitor General; represents the interests of the United States in the courts of appeals in all civil and criminal cases brought by the United States under the Federal antitrust laws; reviews certain decisions of the Interstate Commerce Commission, the Federal Communications Commission, the Federal Maritime Commission and the Nuclear Regulatory Commission, and prepares an appeal position for the United States; and prepares and files amicus briefs in the district courts, the courts of appeals and the Supreme Court in selected private antitrust cases.

The Committee recommends an appropriation of $397,895,000 for the activities of U.S. attorneys. The recommendation is $40,567,000 more than the 1987 level, $15,660,000 less than the budget request but $6,195,000 more than the House allowance.

The Committee recommendation provides increases of $12,624,000 and 250 positions. Of this amount $10,061,000 and 201 positions are for the Criminal Program to enhance narcotics and dangerous drug and white collar crime litigation, $1,285,000 and 27 positions are for the Civil Program, and $1,278,000 and 22 positions are for organized crime drug enforcement activity. Finally, the recommendation includes $28,048,000 in uncontrollable cost adjustments, including the annualization of the additional positions funded in fiscal year 1987 and a general reduction of $105,000.

The Committee has denied the Department's request to merge this account with the "General Legal Activities" appropriation.

The Committee is well aware of the tremendous caseloads currently being processed by the U.S. attorneys offices throughout the country. The Committee is very concerned that this caseload will become unprecedented with the enactment of the Anti-Drug Abuse Act, the new sentencing guidelines, and the Superfund Amendments and Reauthorization Act. Therefore, the Committee urges the Department to use its 1988 resources to distribute additional positions for assistant attorneys to those regions of the country where it is projected that the new drug, crime, and environmental laws will have the most dramatic impact and
