1 construction of a facility or for acquisition of equipment may 2 not provide for payment of more than 50 per centum of so 3 much of the cost of a facility or equipment as the Secretary 4 determines is reasonably attributable to research, experi5 mental, or demonstration purposes. The provisions of clause 6 (5) of the third sentence of section 605 (a) and such other 7 conditions as the Secretary may determine shall apply with respect to grants or contracts under this section for projects 9 for construction of a facility or for acquisition of equipment.

"PAYMENTS

"SEC. 933. Payments of any grants or under any con12 tracts under this part may be made in advance or by way 13 of reimbursement, and in such installments and on such con14 ditions, as the Secretary deems necessary to carry out the

"SEC. 941. For purposes of this title

"(1) The term 'State' includes the Commonwealth of 20 Puerto Rico, Guam, American Samoa, the Trust Territory 21 of the Pacific Islands, the Virgin Islands, and the District of 22 Columbia and the term 'United States' means the fifty States 23 and the District of Columbia.

"(2) The term 'Council' means the National Advisory 25 Council on the Planning, Organization, and Delivery of

1 Health Services established pursuant to section 901, unless

2 the context otherwise requires.

(3) The term 'nonprofit' as applied to any private

4 agency, institution, or organization means one which is a cor

5 poration or association, or is owned and operated by one or

6

more corporations or associations, no part of the net earnings 7 of which inures, or may lawfully inure, to the benefit of any 8 private shareholder or individual.

"GRANTS OF EQUIPMENT, SUPPLIES, AND SERVICES "SEC. 942. The Secretary, at the request of any recipient 11 of a grant or contract under this title, may reduce the pay

12

ments of such recipient by the fair market value of any 13 equipment or supplies furnished to such recipient and by 14 the amount of the pay, allowances, traveling expenses, and 15 any other costs in connection with the detail of an officer 16 or employee to the recipient when such furnishing or such 17 detail, as the case may be, is for the convenience of and 18 at the request of such recipient and for the purpose of 19 carrying out the State plan or the project with respect to 20 which the grant or contract under this title is made. The 21 amount by which such payments are so reduced shall be 22 available for payment of such costs (including the costs of 23 such equipment and supplies) by the Secretary, but shall, 24 for purposes of determining the Federal share under section 25 921 or 924 be deemed to have been paid to the State.

"JOINT FUNDING

"SEC. 943. (a) Pursuant to regulations prescribed by

3 the Secretary, where funds are advanced for a single project 4 pursuant to the authority of more than one statute adminis5 tered by the Department of Health, Education, and Welfare, 6 any one administrative unit within the Department may be designated to act for all in administering the funds advanced. 8 In such cases, a single non-Federal share or participation

requirement may be established according to the proportion 10 of funds advanced under each authorization and any such 11 administrative unit may waive any technical grant or con12 tract requirement (as defined by such regulations) which is 13 inconsistent with the similar requirements of the administer14 ing unit or which such unit does not impose.

"(b) Pursuant to regulations prescribed by the Presi16 dent, where funds are advanced for a single project by 17 more than one Federal agency to an agency or organization 18 assisted under this title, any one Federal agency may be 19 designated to act for all in administering the funds advanced. 20 In such cases, å single non-Federal share requirement may be 21 established according to the proportion of funds advanced by 22 each Federal agency, and any such agency may waive any 23 technical grant or contract requirement (as defined by such 24 regulations) which is inconsistent with the similar require

ments of the administering agency or which the administering

agency does not impose.

"TRANSFER OF FUNDS

"SEC. 944. Notwithstanding any limitation on appro

5 priations for any program or activity under this title, not to 6 exceed 10 per centum of the amount appropriated to carry 7 out any such program or activity, other than amounts appro8 priated to carry out section 921 or 924, may be transferred 9 and used by the Secretary for the purpose of carrying out any 10 other such program or activity under this title other than 11 activities under such section 921 or 924, but no such trans12 fer may result in increasing the amounts otherwise available 13 for carrying out programs or activities under any section of 14 this title by more than 10 per centum.

"ANNUAL REPORT

"SEC. 945. On or before January 1 of each year, the 17 Secretary, after consultation with the Council, shall transmit 18 to the Congress a report of the activities under this title to19 gether with (1) an evaluation of the effectiveness of these 20 activities in improving the efficiency and effectiveness of the 21 delivery of health services and in carrying out the other pur22 poses of this title, (2) a statement of the relationship be23 tween Federal financing and financing from other sources of 24 the activities undertaken pursuant to this title, including

1 efforts by the grantees to develop alternate sources of financ2 ing after an initial period of support, and (3) such recom

3 mendations with respect to modifications of this title as he 4 deems appropriate.

"REGULATIONS

"SEC. 946. The Secretary may, after consultation with 7 the Council, prescribe regulations relating to the general ad8 ministration of this title and the terms and conditions for ap9 proving applications for assistance thereunder, and relating to methods for the coordination of programs assisted under 11 this title with other Federal or federally assisted health

"RECORDS AND AUDIT

"SEC. 947. (a) Each recipient of a grant under this 15 title (other than section 921 or 924) shall keep such rec16 ords as the Secretary may prescribe, including records which 17 fully disclose the amount and disposition by such recipient of 18 the proceeds of such grant, the total cost of the project or 19 undertaking in connection with which such grant is made 20 or used, and the amount of that portion of the cost of the 21 project or undertaking supplied by other sources, and such 22 records as will facilitate an effective audit.

"(b) The Secretary and the Comptroller General of the

24 United States, or any of their duly authorized representatives, 25 shall have access for the purpose of audit and examination to
