12 1 application may be approved only if it is recommended by 2 the advisory group described in section 912 (b), meets the 3 requirements of section 914, and contains or is supported by 4 reasonable assurance that— "(1) satisfactory efforts will be undertaken by the applicant to obtain financing from non-Federal sources, and from Federal sources providing reimbursement for medical care for eligible beneficiaries, to support the program after such period of initial support under this section as may be prescribed by regulations; and "(2) any laborer or mechanic employed by any contractor or subcontractor in the performance of work on any construction aided by payments pursuant to any grant under this section will be paid wages at rates not less than those prevailing on similar construction in the locality as determined by the Secretary of Labor in accordance with the Davis-Bacon Act, as amended (40 U.S.C. 276a-276a-5); and the Secretary of Labor shall have, with respect to the labor standards specified in this paragraph, the authority and functions set forth in Reorganization Plan Numbered 14 of 1950 (15 F.R. 3176; 5 U.S.C. 133z-15) and section 2 of the Act of June 13, 1934, as amended (40 U.S.C. 276c). "GENERAL CONDITIONS OF GRANTS "SEC. 914. Grants may not be made under this part 26 unless the applicant also gives reasonable assurance that 13 "(1) Federal funds paid pursuant to any such grant (A) will be used only for the purposes for which paid and in accordance with the applicable provisions of this title and the regulations thereunder, and (B) in the case of an application under section 913, will not supplant funds that are otherwise available for establishment or operation of the regional medical program with respect to which the grant is made; "(2) the applicant will provide for such fiscal control and fund accounting procedures as are required by the Secretary to assure proper disbursement of and accounting for such Federal funds; "(3) the applicant will make such reports, in such form and containing such information as the Secretary may from time to time reasonably require, and will keep such records and afford such access thereto as the Secre tary may find necessary to assure the correctness and verification of such reports; and "(4) reasonable opportunity has been provided, prior to submission of the application, for review and comment by the appropriate State health planning agency or agencies designated pursuant to section 921 of this title, and by the agency or agencies conducting the comprehensive regional, metropolitan, or other area planning referred to in section 922 of this title or, if there 1 2 3 4 5 6 7 8 14 is no such agency in the area where the project is to be located, such other public or nonprofit private agency or organization performing similar planning functions as may be determined in accordance with criteria prescribed by the Secretary. "INFORMATION ON SPECIAL TREATMENT AND TRAINING RESOURCES "SEC. 915. The Secretary shall provide, either directly or through grants or contracts, for the establishment, and maintenance on a current basis, or (1) a list or lists of facilities in the United States equipped and staffed to provide advanced methods and techniques in the prevention, diagnosis, and treatment, of such diseases and impairments of man as may be prescribed by the Secretary for the purposes of this section, and in the rehabilitation of persons suffering from such diseases and impairments, and (2) such related information as trends in equipment, staffing, and services and the distribution of various types of such facilities in the United States, and (3) the availability of advanced specialty training in such facilities. "PROJECT GRANTS FOR MULTIPROGRAM SERVICES AND CONTRACTS FOR CLINICAL AND FIELD STUDIES "SEC. 916. Funds appropriated to carry out this part shall also be available for (a) grants to any public or nonprofit private agency or institution for services needed by, or 15 1 2 3 4 which will be of substantial use to, any two or more regional medical programs, and (b) contracts with public or private agencies and institutions for the conduct of cooperative clini cal and field studies and demonstrations of systems for orga 5 nizing and delivering medical care and of other activities for which support is authorized pursuant to this part. B-COMPREHENSIVE STATE AND AREAWIDE HEALTH PLANNING AND PUBLIC HEALTH SERVICES "GRANTS FOR COMPREHENSIVE STATE HEALTH 6 8 9 10 11 12 PLANNING "State Plans "SEC. 921. (a) In order to be approved for purposes of 13 assistance under this section, a State plan for comprehensive 14 State health planning must 15 16 17 "(1) designate, or provide for the establishment of, a State agency, which may be an interdepartmental agency as the sole agency for administering or super vising the administration of the State's health planning functions under the plan; "(2) provide for a State health planning advisory council which shall include representatives of State and local agencies, and public and private agencies and organizations concerned with health and with the fi 24 nancing of health services (including representation of the regional medical program or programs within the 25 16 1 2 3 4 5 6 7 8 9 10 11 12 13 34 14 15 16 17 State established pursuant to part A of this title), and of consumers of health services, and with one member being a representative of the regional medical programs and with a majority of the membership of such council consisting of representatives of consumers of health services (including an appropriate number of representatives of poor and minority groups as determined in accordance with regulations promulgated by the Secretary); "(3) set forth policies and procedures for the expenditure of funds under the plan, which, in the judgment of the Secretary are designed to provide for comprehensive State planning for health services (both public and private), including the facilities and persons required for the provision of such services, to meet the health needs of the people of the State; "(4) provide for encouraging cooperative efforts among governmental or nongovernmental agencies, orga nizations and groups concerned with health services. facilities, or manpower, and for cooperative efforts between such agencies, organizations, and groups and 21 similar agencies, organizations, and groups in the fields 20 "(5) contain or be supported by assurances satis factory to the Secretary that the funds paid under this subsection will be used to supplement and, to the extent |
