Mr. CADDELL. This one [indicating] has the candidates for President and Vice President and for Members of Congress from the Eighth Congressional District of Virginia and has a check mark by Roosevelt, Truman, for President and Vice President, and by Howard W. Smith for Member of Congress.

Mr. SMITH. Yes.

Mr. CADDELL. That is correct?

Mr. SMITH. Yes.

Mr. CADDELL. And the yellow one has a list of candidates for President and Vice President, for Member of Congress from the Eighth Congressional District of Virginia and for members of the county board, and a check for Roosevelt and Truman for President and Vice President.

Mr. SMITH. Yes.

Mr. CADDELL. And Howard W. Smith for Member of Congress and Leo Llyod for member of the county board.

Mr. SMITH. Yes. That was gotten out by Democratic Headquarters Organization of Arlington County.

Mr. CADDELL. Have you published any campaign literature?
Mr. SMITH. No.

Mr. CADDELL. This pamphlet is the only thing you have actually published?

Mr. SMITH. Yes.

Mr. CADDELL. Have you engaged any billboards?

Mr. SMITH. No.

Mr. CADDELL. Have you written any items in newspapers?
Mr. SMITH. No.

Mr. CADDELL. Had any radio broadcasts?

Mr. SMITH. No.

Mr. CADDELL. So this one pamphlet contains the extent of your expenditures for political purposes?

Mr. SMITH. That is true. I have not been particularly worried. Mr. CADDELL. What information do you have as to activities in your race by the C. I. O. Political Action Commitee?

Mr. SMITH. Well, there came into my hands a few days ago a letter containing some information about the C. I. O. Political Action Committee. I knew none of the parties connected with it, but as it relates to the C. I. O. Political Action Committee and the political activities in my congressional district, I notified this committee that I had possession of the documents. During the course of the same day I was served with the subpena duces tecum requiring me to turn over the documents to the committee and I complied with the subpena. Mr. CADDELL. Those are the documents [indicating]?

Mr. SMITH. After opening the envelope I can tell you. They appear to be the same documents that I turned over to the committee under the subpena duces tecum.

Mr. CADDELL. Did you give Mr. Gathings, the chairman of the subcommittee, a letter when you turned these documents over to him; did you write him?

Mr. SMITH. Oh, yes.

Mr. CADDELL. Is this the letter [indicating]?

Mr. SMITH. Yes.

Mr. CADDELL (reading):

Pursuant to your subpena, I am turning over to you the following documents: One receipt for Pullman fare.

Newspaper clipping from the Richmond Times-Dispatch of October 15.

One letter from George S. Mitchell to Hon. Walter F. George, dated October 24, 1944.

One receipt of Albemarle Hotel, to Mrs. M. Speir.

One check from the C. I. O. Political Action Committee to Mercedes Spier, for $19.78, numbered C 1550.

One expense account statement for $73.05; entitled “Mrs. Mercedes Powell Speir in account with C.I.O. Political Action Committee” dated October 15, 1944. One letter dated October 15, 1944, to a Dr. Mitchell, initialed "M. S.”. Also, the envelope in which the documents were contained.

I do not know any of the parties involved and assume that in the course of your investigation you will learn who they are, and can deliver the documents to the persons to whom your committee finds they should go.

Mr. CADDELL. That was your letter?

Mr. SMITH. That is correct.

Mr. CADDELL. I should like this letter to be incorporated in the record.

Mr. CADDELL. Mr. Smith, I show you a photostat copy of the documents which you turned over to Mr. Gathings, or the committee, under that subpena and ask you if this is a true and correct photostat copy of those documents.

Mr. CADDELL. Mr. Chairman, I would like to incorporate in the record at this point, as an exhibit of Judge Smith's testimony, the photostat of each of these documents.
