A BILL To amend the Food Stamp Act of 1964, as amended, and for

other purposes. i Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That this Act may be cited as the food program technical 4 amendments. 5 SECTION 1. Notwithstanding any other provision of law, 6 the Secretary of Agriculture shall (1) use funds available 7 under provisions of section 32 of Public Law 74-320, as 8 amended (7 U.S.C. 612c), to purchase, without regard to 9 the provisions of existing law governing the expenditure

1 of public funds, agricultural commodities, and their products

2 to maintain the traditional level of assistance for food assist

3 ance programs as are authorized by law, including but not

4 limited to school lunch, institutions, supplemental feeding,

5 and disaster relief, and (2) if the stocks of the Commodity

6 Credit Corporation are not available, use the funds of the

7 Corporation to purchase agricultural commodities and the g products thereof under section 416 of the Agricultural Act of g 1949 to meet such requirements.

10 Sec. 2. Section 3 of the Food Stamp Act of 1964, as

11 amended, is amended, by adding at the end thereof new

12 subsections as follows:

13 "(o) The term 'tribal government' shall refer to any

14 group of native Americans so recognized by the Department

15 of the Interior.

16 "(p) The term 'Indian reservation' shall refer to any

17 area so recognized by the Department of the Interior."

18 Sec. 3. Section 4 of the Food Stamp Act of 1964, as

19 amended, is amended by: (1) redesignating subsections (b)

20 and (c) as subsections (c) and (d) and (2) inserting a new

21 subsection (b) as follows:

22 "(b) Notwithstanding any other provision of law, the

23 Secretary is authorized to formulate and administer a food

24 stamp program at the request of any tribal government

25 under which eligible households shall be provided with an 1 opportunity to participate in the food stamp program under

2 the provisions of this Act, in which case the tribal govern

3 ment shall he considered a State for purposes of this Act.

4 Any tribal government requesting a food stamp program

5 may enter into an agreement with a State to have the State

6 administer such a program, or may delegate the administra

7 tion to the Secretary of the Interior, in which case such State

8 or Secretary shall be considered a State agency for purposes

9 of this Act. The Secretary may issue regulations as he deems

10 necessary or appropriate for the effective and efficient ad

11 ministration of the food stamp program on any Indian reser

12 vation requesting such a program."

13 Sec. 4. Section 15 of the Food Stamp Act of 1964, as

14 amended, is amended to read as follows:

15 "(a) Each State shall be responsible for financing, from

16 funds available to the State, or political subdivision thereof

17 the costs of carrying out the administrative responsibilities

18 assigned to it under the provisions of this Act.

19 "(b) The Secretary is authorized to pay to each State

20 agency an amount equal to 62.5' per centum of all such ad

21 ministrative costs including, but not limited to, certification

22 of households; the acceptance, storage, and protection of

23 coupons after their delivery to receiving points within the

24 States; the issuance of such coupons to eligible households;

25 outreach and fair hearing requirements of section 10 of this

1 Act; and the control and accounting of coupons: Provided,

2 That, the Secretary is authorized to pay to a tribal govern

3 ment or its agent, under section 4(b), an amount equal to

4 100 per centum of such administrative costs for that portion

5 attributable to the administration of the food stamp program

6 on any Indian reservation."

7 Sec. 5. Section 17 of the Food Stamp Act, as amended,

8 is amended by inserting after the words "State of Alaska",

9 the following: "or any Indian reservation".

10 Sec. 6. The following new section is added at the end of

11 the Food Stamp Act:

12 "sec. 18. (a) In the case of any experimental, pilot, or

13 demonstration project which the Secretary specifically deter

14 mines is likely to promote raising the levels of nutritional

15 adequacy among low-income households and alleviate hunger

16 and malnutrition, the Secretary may waive compliance with

17 any of the requirements of this Act, or regulations promul

18 gated thereunder, to the extent and for the period he finds

19 necessary to carry out such a project.

20 "(b) The Secretary is authorized to use funds appro

21 priated for this Act to implement any project he establishes

22 pursuant to subsection (a),"
