Senator CRANSTON. This morning we will be delighted to hear the views of the administration on these two pending measures, and we are very pleased to have Under Secretary Carlucci with us.

Before turning to Senator Stafford's opening remarks, I do wish to note that the period since September 26, 1973, when the Rehabilitation Act of 1973 was enacted, has been characterized by what I consider to have been an unusual, and highly valuable period of consultation between the legislative and executive branches with respect to the implementation of that new public law.

There were more than 15 hours of staff consultations carried out o a bipartisan basis by the staffs of both houses of Congress with various officials in RSA, SRS, and HEW.

Although the administration did not adopt all the congressional suggestions with regard to the regulations and implementation of the new law, we certainly feel that we had a very fair and full opportunity for comment and participation, and note that many of our suggestions have indeed been included in the final regulations as published on May 28, 1974.

During the same period we were also in close communication with the Civil Service Commission with respect to its implementation of section 501 regarding the new affirmative action plan requirements for Federal agencies with respect to the employment and advancement in employment of handicapped individuals. I believe that we enjoyed a similar cooperative relationship with the Commission.

Also, during this period, there was a lesser degree of communication and consultation between the committees in both Houses and the Department of Labor with respect to the Department's implementation and preparation of regulations regarding section 503 of the new act, requiring affirmative action plans with respect to hiring handicapped individuals on the part of Federal contractors and subcontractors.

We note that the Labor Department has now published its regulations under section 503, and we expect to be communicating further with the Department in connection with those regulations and the implementation of section 503.

It is further our understanding that there are now ongoing consultations between the Department of Health, Education, and Welfare and the Department of Labor with respect to coordinating the Labor Department's section 503 regulations and the section 504 Governmentwide regulations which the Office for Civil Rights in HEW is now developing with respect to the prohibition against discrimination against otherwise qualified handicapped individuals under any federally assisted program or activity.

Thus, I would like to extend to Secretary Weinberger, Under Secretary Carlucci, and Assistant Secretary Kurzman, as well as to the numerous officials of the Rehabilitation Services Administration and SRS who gave so much of themselves during this consultative process, our very genuine thanks for their many courtesies and their sincere interest in working with the Congress to achieve the best possible implementation of the new law.

It is further our very real hope that this process will be a continuing one and will not have to come to an end with the issuance of the new regulations.
