equipment for the station at Brawley, California, including architectural and other costs previously incurred in connection therewith. § 1301. Farmers' Home Administration.-Loan authorization.-For an additional amount for "Loan Authorization" for loans under title II of the Bankhead-Jones Farm Tenant Act, as amended, $18,000,000, to be borrowed from the Secretary of the Treasury in the manner authorized under this head in the General Appropriation Act, 1951: Provided, That none of the funds hereby authorized shall be used for loans other than to farmers and stockmen who suffered production disasters in areas designated pursuant to Public Law 38 (81st Congress). § 1302. General provisions.-No part of any appropriation contained in this Act, or of the funds available for expenditure by any corporation included in this Act, shall be used to pay the salary or wages of any person who engages in a strike against the Government of the United States or who is a member of an organization of Government employees that asserts the right to strike against the Government of the United States, or who advocates, or is a member of an organization that advocates, the overthrow of the Government of the United States by force or violence: Provided, That for the purposes hereof an affidavit shall be considered prima facie evidence that the person making the affidavit has not contrary to the provisions of this section engaged in a strike against the Government of the United States, is not a member of an organization of Government employees that asserts the right to strike against the Government of the United States, or that such person does not advocate, and is not a member of an organization that advocates, the overthrow of the Government of the United States by force or violence: Provided further, That any person who engages in a strike against the Government of the United States or who is a member of an organization of Government employees that asserts the right to strike against the Government of the United States, or who advocates, or who is a member of an organization that advocates, the overthrow of the Government of the United States by force or violence and accepts employment the salary or wages for which are paid from any appropriation or fund contained in this Act shall be guilty of a felony and, upon conviction, shall be fined not more than $1,000 or imprisoned for not more than one year, or both: Provided further, That the above penalty clause shall be in addition to, and not in substitution for, any other provisions of existing law: Provided further, That, as applicable to the Departments of Agriculture and Interior, nothing in this section shall be construed to require an affidavit from any person employed for less than sixty days for sudden emergency work involving the loss of human life or destruction of property, and the payment of salary or wages may be made to such persons from applicable appropriations for services rendered in such emergency without execution of the affidavit contemplated by this section. § 1303. After September 1, 1950, and during the fiscal year 1951: (a) In making appointments in the Government service the Civil Service Commission shall make full use of its authority to make temporary appointments in order to prevent increases in the number of permanent personnel and no employee in the Federal civil service promoted, transferred or appointed to a position of higher grade shall be eligible, in the event of separation from the service through reduction in force, to reinstatement at a grade above the grade held by such employee on September 1, 1950; and all reinstatements, transfers or promotions to positions in the Federal civil service shall be temporary and for positions subject to the Classification Act of 1949 shall be made with the condition and notice to the individual reinstated, transferred or promoted that the classification grade of the position is subject to post-audit and correction by the appropriate departmental or agency personnel office or the Civil Service Commission; (b) The names of all persons to be terminated under reductions in force in the departments and agencies of the Government shall be certified as eligible for appointment to positions in agency programs determined by the President to be related directly to national defense, if qualified, at not to exceed the grade and salary last held in the terminating agency or department; and (c) The Department of Defense is authorized to call on other departments or agencies for such additional personnel as it may require within the limits of its funds. § 1304. When determined by the President to be necessary, the provisions of subsection (c) of section 3679 of the Revised Statutes, as amended by section 1211 of the General Appropriation Act, 1951, shall not apply, during the current fiscal year, to any appropriations, funds, or contract authorizations, available to the executive departments for carrying out the provisions of the Act of August 9, 1950 (Public Law 679); and for the purposes of said Act of August 9, 1950, the Secretary of the Treasury may, during the current fiscal year, transfer such amounts as may be necessary (not to exceed $10,000,000) from appropriations to the Coast Guard for "Operating expenses, fiscal year 1951, to appropriations to the Coast Guard for "Acquisition, construction, and improvements," and the limitation on number of aircraft on hand at one time, provided in the General Appropriation Act, 1951, shall not apply with respect to said Act of August 9, 1950. § 1305. During any period in which the Armed Forces of the United States are actively engaged in hostilities while carrying out any decision of the Security Council of the United Nations, no economic or financial assistance shall be provided, out of any funds appropriated to carry out the purposes of the Economic Cooperation Act of 1948, as amended, or any other act to provide economic or financial assistance (other than military assistance) to foreign countries, to any country whose trade with the Union of Soviet Socialist Republics or any of its satellite countries (including Communist China and Communist North Korea) is found by the National Security Council to be contrary to the security interests of the United States. § 1306.
