4 1 "(b) In making grants and contracts under this section 2 the Secretary shall take into account the number of persons 3 to be served, the extent to which such screening and coun4 seling is needed on a local basis, the relative need of the ap5 plicant, and its capacity to make rapid and effective use of 6 such assistance. 7 8 "(c) For the purpose of making payments pursuant to grants and contracts under this section, there are authorized 9 to be appropriated $25,000,000 for the fiscal year ending 10 June 30, 1973; $25,000,000 for the fiscal year ending 11 June 30, 1974; and $25,000,000 for the fiscal year ending 12 June 30, 1975. 14 "SEC. 1102. (a) In order to promote research in the 15 diagnosis, treatment, and prevention of sickle cell anemia, 16 development of programs to educate the public regarding the nature and inheritance of the sickle cell trait and sickle cell 18 anemia, and the development of centers for research, test19 ing, counseling, prevention, or treatment of sickle cell 20 anemia, the Secretary is authorized to make grants to public or nonprofit private entities and to enter into contracts with 22 public or private entities and individuals for projects for re23 search and research training in such fields. 21 24 "(b) For the purpose of making payments pursuant 5 1 2 to grants and contracts under this section there are author ized to be appropriated $5,000,000 for the fiscal year ending 3 June 30, 1973; $5,000,000 for the fiscal year ending 4 June 30, 1974; and $5,000,000 for the fiscal year ending 5 June 30, 1975. 6 7 "VOLUNTARY PARTICIPATION "SEC. 1103. The participation by any individual in 8 any program or portion thereof under this title (whether 9 by grant or contract) shall be wholly voluntary and shall 10 not be a prerequisite to eligibility for or receipt of any other 11 service or assistance from or to participation in, any other 12 program. 13 14 "APPLICATIONS "SEC. 1104. A grant under this title may be made 15 upon application to the Secretary at such time, in such 16 manner, containing and accompanied by such information as 17 the Secretary deems necessary. Each application shall"(1) provide that the programs and activities for which assistance under this title is sought will be administered by or under the supervision of the applicant ; 18 19 20 22 21 "(2) describe with particularity the programs and activities for which assistance is sought; "(3) provide for strict confidentiality of all test results, medical records and other information regarding 42 3 41 5 6 7 8 9 10 11 12 13 14 15 16 17 6 screening, counseling, or treatment of any person treated, except for (A) such information as the patient (or his guardian) consents to be released; or (B) sta tistical data compiled without reference to the identity of any such patient; "(4) provide for appropriate consultation with community representatives in the development and operation of any program funded under this title; "(5) set forth such fiscal control and fund accounting procedures as may be necessary to assure proper disbursement of and accounting for Federal funds paid to the applicant under this title; and "(6) provide for making such reports in such form and containing such information as the Secretary may reasonably require. "PUBLIC HEALTH SERVICE FACILITIES "SEC. 1105. The Secretary shall establish a program 18 within the Public Health Service to provide for voluntary 19 sickle cell anemia screening, counseling, and treatment. Such 20 program shall be made available through facilities of the 21 Public Health Service to any eligible person requesting 22 screening, counseling, or treatment, and shall include notifi23 cation of all eligible persons of the availability and voluntary 24 nature of such programs. 1 2 7 "REPORTS "SEC. 1106. (a) The Secretary shall prepare and sub 3 mit to the President for transmittal to the Congress on or 4 before April 1 of each year a comprehensive report on the 5 administration of this title. 6 "(b) The report required by this section shall contain 7 such recommendations for additional legislation as the Sec8 retary deems necessary." 9 10 PROTECTION OF ARMED FORCES PERSONNEL SEC. 4. (a) The Secretary of Defense is authorized and 11 directed to promulgate rules and regulations to provide for 12 screening and counseling of members of the Armed Forces 13 (including their dependents), civilian employees of the De14 partment of Defense, and persons examined at Armed Forces 15 examining and entrance stations, for the sickle cell trait and 16 sickle cell anemia. (b) Such rules and regulations shall provide for (1) voluntary screening for the sickle cell trait for persons described in subsection (a) who request such a test, at no cost to such person; (2) communication to such person described in subsection (a) of the results of such test; (3) voluntary referral of individuals determined to 8 =23 possess a positive trait to an appropriate military or civilian counseling or treatment agency; (4) notification to persons described in subsection (a) of the cost-free and voluntary nature of the screen ing and referral programs implemented pursuant to this section; (5) education of persons described in subsection (a) regarding the nature and inheritance of the sickle cell trait and sickle cell anemia; and (6) assurance that all information obtained on specimens submitted voluntarily under this Act shall be 12 held confidential except for (A) such information as the 13 14 15 16 patient (or his guardian) consents to be released or (B) statistical data compiled without reference to the identity of any such patient. (c) The Secretary of Defense shall provide for volun17 tary counseling or treatment of such persons described in 18 subsection (a) found to have the sickle cell trait or sickle 19 cell anemia at an appropriate military or civilian facility as 20 the case may be. 21 (d) (1) The Secretary of Defense shall prepare and 22 submit to the President for transmittal to Congress on or 23 before April 1 of each year a comprehensive report on the 24 administration of this section. 25 (2) The report required by this subsection shall con |
