8 SEC. 103. SUBMISSION, APPROVAL, AND IMPLEMENTATION

(a) IN GENERAL.-Section 4007 is amended to read 11 as follows:

12 "SEC. 4007. SUBMISSION, APPROVAL, AND IMPLEMENTA

TION OF STATE PLAN.

"(a) PLAN SUBMISSION.-Each State shall develop

15 a solid waste management plan that complies with the re16 quirements of section 4003 and shall submit such plan to 17 the Administrator not later than 30 months after the date 18 of the enactment of the National Waste Reduction, Recy19 cling, and Management Act. In developing such plan, each 20 State shall consult with regional and local authorities and 21 provide notice and opportunity for public comment, includ22 ing public hearings in both urban and rural areas of the 23 State.

"(b) PLAN APPROVAL OR DISAPPROVAL.-(1) Sub

25 ject to paragraph (5), not later than 6 months after a

1 State plan has been submitted to the Administrator pursu

2 ant to subsection (a), the Administrator shall approve or

3 disapprove the plan.

"(2) The Administrator shall approve a State plan

"(A) the Governor submits a certification of completeness pursuant to subsection (c); and

"(B) the Administrator finds that each requirement of section 4003 (a) is addressed in the plan and that the plan was developed in accordance with the guidelines published under section 4002, including the methodologies contained in such guidelines. "(3) The Administrator shall disapprove a plan if"(A) the Governor does not submit the certification of completeness pursuant to subsection (c);

or

"(B) the Administrator finds that the plan does not address each requirement of section 4003 (a) or was not developed in accordance with the guidelines published under section 4002, including the methodologies contained in such guidelines.

"(4) If the Administrator disapproves a State plan,

23 the Administrator shall notify the State in writing of the 24 disapproval. Such notification shall include an explanation 25 of the reasons for the disapproval.

1 "(c) CERTIFICATION OF COMPLETENESS BY GOV. 2 ERNOR.-In order for a State plan to be approved under 3 subsection (b), the Governor of the State must submit to 4 the Administrator a certification of completeness. Such 5 certification shall consist of a statement by the Governor 6 that, to the best of the Governor's knowledge and belief"(1) each of the requirements contained in sec

tion 4003(a) are addressed in the State plan in a complete manner; and

"(2) the plan was developed in accordance with the guidelines published under section 4002, including the methodologies contained in such guidelines. "(d) STATE REVISION OF DISAPPROVED PLAN.-In

14 any case in which the Administrator disapproves a State 15 plan under subsection (b), the State shall make revisions 16 to the plan to correct the deficiencies in the plan and shall 17 resubmit the plan to the Administrator not later than 90 18 days after the Administrator disapproves the State plan. 19 A revised plan shall be subject to the approval and dis20 approval procedures of subsection (b) in the same manner 21 as the original submission of the plan.

"(e) FINAL EPA ACTION ON STATE PLANS.-The 23 Administrator shall respond (by approving or dis24 approving) to all revised State plans submitted pursuant 25 to subsection (d) not later than 42 months after the date

1 of the enactment of the National Waste Reduction, Recy

2 cling, and Management Act.

"(f) CONDITIONAL APPROVAL.-The Administrator 4 is not required to disapprove a plan or a revised plan 5 based on a failure of a State to make the certification 6 under section 4003(a)(16) if the plan contains a commit7 ment of the State to adopt specific measures to provide 8 the legal authority referred to in such section by a date 9 certain not later than 36 months after the date of enact10 ment of the National Waste Reduction, Recycling, and 11 Management Act. Any such conditional approval shall be 12 treated as disapproval if the State fails to comply with 13 such commitment.

"(g) REVIEW.-The Administrator shall review each

15 approved plan 3 years after the plan was approved to de16 termine if the plan is being fully implemented. If the Ad17 ministrator determines a State is not implementing the 18 plan

"(1) the plan is deemed to be disapproved as of the date of the Administrator's determination, and

the Administrator shall notify the State in writing of such disapproval;

"(2) the authority provided by section 4013(a) shall terminate as of the date of such disapproval;

"(3) the operation of any combustion or land disposal facility pursuant to a permit issued by the

State on or after the date of such disapproval shall

not be considered to be an activity carried out in ac

cordance with a permit issued pursuant to section 4206.".

(b) TABLE OF CONTENTS AMENDMENT.-The table

8 of contents for subtitle D (contained in section 1001) is 9 amended by striking out the item relating to section 4007 10 and inserting in lieu thereof the following:

"Sec. 4007. Submission, approval, and implementation of State plan.”.
