120 Such list may combine multiple determinations on the same or similar items. "(B) A description of the progress made in carrying out the requirements of subsection (d), including the actions taken to delete discrimina tory specifications and internal policies and pro cedures and actions taken to revise such specifications, policies, and procedures. "(C) Information on the amount and value of items procured by the agency which complied with the guidelines prepared pursuant to sub section (e) and prepared by the agency pursu ant to subsection (c)(2) (E) (set forth separately for each type of guideline), as well as informa tion on the amount and value of items procured by the agency which did not comply with such guidelines. The information required by this subparagraph also shall be set forth as percentages of the total amount of all goods purchased by the agency. "(D) A description of the agency's procurement program developed pursuant to subsection (c). In the description, the agency shall highlight its successes in developing and complying with its own guidelines for procurement 1 2 3 4 5 6 7 8 9 10 121 items, with the guidelines prepared by the Administrator pursuant to subsection (e), and any other innovative measures the agency has carried out that have led to the purchase of items containing recovered materials or items which reduce the generation of waste by the agency. The agency also shall identify actions that it needs to take to improve its procurement program.". (g) COORDINATION.-Subsection (g) of section 6002 11 is amended to read as follows: 12 "(g) COORDINATION.-The President shall designate 13 a person or entity to coordinate the implementation of the 14 requirements of this section throughout the Federal Gov15 ernment. Every 2 years such coordinator shall submit to 16 Congress a report on actions taken by Federal agencies 17 to implement this section.". 18 (h) CLEARINGHOUSE.-Section 6002 is further 19 amended by redesignating subsection (h) as subsection (i) 20 and by adding after subsection (g) the following new sub21 section (h): 22 "(h) PROCUREMENT INFORMATION CLEARING 23 HOUSE.-The Administrator, in consultation with the Ad24 ministrator for Federal Procurement Policy, shall estab25 lish within the Environmental Protection Agency a clear 122 1 inghouse to provide information to the public and procur2 ing agencies about procurement of items pursuant to this 3 section. The clearinghouse shall maintain a list of persons 4 who produce items which comply with the guidelines pre5 pared pursuant to subsection (e) or with individual Fed6 eral agency guidelines and persons who produce items not 7 covered by guidelines but which are produced with recov8 ered material. Each Federal agency shall provide to the 9 clearinghouse lists of persons who produce items which 10 comply with the guidelines under subsection (e) or with 11 individual Federal agency guidelines.". 12 (i) CLARIFICATION OF DEFINITION OF PROCURING 13 AGENCY.-Paragraph (17) of section 1004 is amended to 14 read as follows: 15 16 17 18 19 20 "(17) The term 'procuring agency' means "(A) a Federal agency; or "(B) a State agency, or agency of a politi cal subdivision of a State, which is using appro priated Federal funds for the procurement of a procurement item. 21 SEC. 305. DUTIES OF THE SECRETARY OF COMMERCE. 22 23 24 25 Subtitle E is amended as follows: (1) Section 5002 is amended (A) in the first sentence, by striking out "shall, after public hearings, and not later than 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 123 two years after September 1, 1979, publish" and inserting in lieu thereof "shall publish and periodically update"; (B) in the third sentence, by striking out ", to the extent feasible,"; and (C) by inserting after the third sentence the following: "The Secretary shall establish and implement a program to provide technical assistance to States and local governments for the development of expertise in the marketing of recovered materials, for purposes of assisting States in complying with the requirement of section 4003(a)(12) in developing State plans.". (2) The heading of section 5002 is amended by striking out "SECONDARY" and inserting in lieu thereof "RECOVERED". (3) Section 5003 is amended by striking out "within two years after September 1, 1979,". (4) Section 5006 is repealed. 5 (a) ASSISTANCE TO STATES FOR STATE PRO6 GRAMS.-(1) Section 2007(f)(2) of the Solid Waste Dis7 posal Act is amended by striking "fiscal years 1985 8 through 1988" and inserting "fiscal years 1993 through 9 1998". 10 (2) Section 9009(f)(3) and section 9010 of the Solid 11 Waste Disposal Act are each amended by striking "section 12 2007(g)" and inserting "section 2007(f)" in each place 13 it appears. 14 (b) USE OF LEAKING UNDERGROUND STORAGE 15 TANK TRUST FUND.-(1) Section 2007(f) of the Solid 16 Waste Disposal Act is amended by adding the following 17 at the end thereof: 18 19 20 21 22 23 24 "(3) Notwithstanding any other provision of law, amounts in the Leaking Underground Storage Tank Trust Fund established pursuant to the Superfund Amendments and Reauthorization Act of 1986 shall be available, as provided in appropriation Acts, for purposes of making expenditures pursuant to section 9003 (i).
