The subcommittee met, pursuant to other business, in the committee room, 1324 Longworth House Office Building, the Honorable Walter S. Baring (chairman of the subcommittee) presiding. Mr. BARING. We will now proceed to the next order of business. We have several bills, H.R. 5498 by Mr. Aspinall, H.R. 255 by Mr. Udall, and H.R. 106 by Mr. Rhodes, legislation to provide general authority for the sale of public lands. H.R. 5498 was introduced as the result of an executive communication from the Interior Department which recommends it in preference to the other bills. Without objection, the bills will be made a part of the record along with the departmental reports. Hearing no objection, it is so ordered. (The bills and reports follow :) [H.R. 106, 88th Cong., 1st sess.] A BILL To provide that certain public lands of the United States shall be disposed of for their highest and best use, and for other purposes Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, That the purpose of this Act is to provide for the orderly development of certain public lands of the United States located within the various States in accordance with the wishes of the people of the State, and to permit the Federal Government to realize a reasonable compensation for such lands, the head of each department, agency, and instrumentality of the United States having jurisdiction over public lands of the United States is authorized, upon the request of the State wherein such land is located, to conduct jointly with such State a study of any such land for the purpose of classifying its future development based upon the most probable highest and best use for such land. If agreement cannot be reached between the head of such department, agency, or instrumentality and the State as to such classification, the Secretary of Interior shall make such classification after notice and hearing. SEC. 2 (a) Whenever any public land is classified in accordance with the first section of this Act for immediate urban or industrial development or for such urban or industrial development within the ten-year period immediately following such classification, the head of the department, agency, or instrumentality of the United States having jurisdiction over such property shall, at the request of the State participating in the classification of such land, cause it to be appraised in order to determine its fair market value based upon such classification. (b) In the case of any public land appraised under subsection (a) of this section, the head of the department, agency, or instrumentality of the United States having jurisdiction over such land shall, upon request of the interested State, transfer jurisdiction of such land to such State. |
