V. REFERENCES TO INDEFINITE APPROPRIATIONS, EIGHTY-SECOND CONGRESS, SECOND SESSION

Deficiency and Supplemental Appropriation Acts, 1952, 1953:

For payment of interest on judgments rendered against the District of Columbia, so much as may be necessary is appropriated, payable from the revenues of such District (p. 34).

For the payment of interest (as and when specified in such judgments or in certain of the settlements of the General Accounting Office or provided by law), and such additional sums due to increases in rates of exchange as may be necessary to pay claims in foreign currency (pp. 28, 253). The Department of State is authorized to utilize for carrying out the purposes of the appropriation "Government in Occupied Areas," including unforeseen contingencies, without dollar reimbursement from this or any other appropriation (1) currencies deposited in Germany by the Federal Republic of Germany and in Austria by the Republic of Austria in accordance with section 115 (b) (6) of the Economic Cooperation Act of 1948, as amended, and which may be made available by the Director for Mutual Security, (2) currencies otherwise deposited in Germany by the Federal Republic of Germany and which become available for use of the Government of the United States, its representatives or agencies in Germany, in such quantities and under such terms and conditions as may be determined by the Secretary of State after consultation with the Director for Mutual Security, (3) other currencies derived from activities carried on under this appropriation, or in the possession of or under the control of the Department of State in Germany and Austria (p. 246).

Department of Agriculture Appropriation Act, 1953:

Collections in an amount not to exceed $2,322,100 from Federal Farm Credit agencies of assessments and charges, to be advanced by transfer and counterwarrant to the appropriation "Farm Credit Administration," are made available to cover the cost of Farm Credit Administration facilities, examinations, and other services rendered to such agencies (p. 56).

Department of Defense Appropriation Act, 1953:

Not to exceed 15 percent of the fiscal year 1953 receipts of the Alaska communication system shall be available for the operation, maintenance, and improvement of the Alaska communication system (p. 77).

District of Columbia Appropriation Act, 1953:

For salary of the Engineer Commissioner, so much as may be necessary to make the salary of the Army officer holding that position equal to such rate in grade 8 of the professional service of the Classification Act of 1923, as amended, as the Board of Commissioners may determine, is appropriated for the fiscal year 1952 (p. 95).

The amounts collected from street-railway companies for repairing pavements shall be credited to the appropriation for capital outlay, Street and Bridge Divisions, for the fiscal year 1953, and be available for reexpenditure (p. 106). The Commissioners are authorized and empowered to pay the purchase price and the cost of installation of new meters or devices installed from fees collected from such new meters or devices, which fees are hereby appropriated for such purpose, until such time as contracts of purchase have been paid (p. 107). Independent Offices Appropriation Act, 1953:

The foregoing appropriation shall be credited with (1) advances or reimbursements for salaries and administrative expenses chargeable against other appropriations of the General Services Administration, and such salaries and expenses may be paid from this appropriation; (2) cost of maintenance, upkeep,

and repair included as part of rentals received from Government corporations pursuant to law (40 U. S. C. 129); (3) reimbursements for services performed in respect to bonds and other obligations under the jurisdiction of the General Services Administration, issued by public authorities, States, or other public bodies, and such services in respect to such bonds or obligations as the Administrator deems necessary and in the public interest may, upon the request and at the expense of the issuing agencies, be provided from this appropriation; and (4) appropriations or funds available to other agencies, and transferred to the General Services Administration, in connection with property transferred to the General Services Administration pursuant to the Act of July 2, 1948 (50 U. S. C. 451ff), and such appropriations or funds may, with the approval of the Bureau of the Budget, be so transferred (p. 121). Funds received as proceeds from sale or other disposition of strategic and critical materials on account of rotation of such materials shall be deposited to the credit, and be available for expenditure for the purposes, of the appropriation 'Strategic and Critical Materials (Act of July 23, 1946)" (p. 123). Certain premiums shall be credited to the appropriation "National service life insurance," Veterans' Administration (p. 131).

Payments received by the United States Maritime Commission for utilities, services, and repairs in connection with any lease, contract, or occupancy involving Government property under control of the Commission shall be credited to the appropriation charged with the cost thereof (p. 136). Interior Department Appropriation Act, 1953:

For construction, purchase, and maintenance of range improvements pursuant to the provisions of sections 3 and 10 of the Act of June 28, 1934, as amended (43. U. S. C. 315), sums equal to the aggregate of all moneys received as range improvement fees under section 3 of said Act and of 25 percent of all moneys received under section 15 of said Act during the current and prior fiscal years but not yet appropriated, to remain available until expended (p. 145). For carrying out the provisions of the Act of February 26, 1944, as amended (16 U. S. C. 631a-631q), amount equal to 60 percent of the proceeds covered into the Treasury during the next preceding fiscal year from the sale of sealskins and other products (p. 154).

Twenty-five percent of the proceeds covered into the Treasury during the next preceding fiscal year from the sale of sealskins and other products shall be available for expenditure during the current and next succeeding fiscal years. for management and investigation of fish and wildlife resources in Alaska (p. 154).

Labor-Federal Security Appropriation Act, 1953:

Such an amount as may be necessary for the payment of compensation and other benefits authorized by law and accruing during the current or any prior fiscal year, Bureau of Employees Compensation (Employees' Compensation Fund) (p. 164).

Grants to States, next succeeding fiscal year: For making, after May 31 of the current fiscal year, payments to States under title III of the Social Security Act, as amended, and under the Act of June 6, 1933, as amended, for the first quarter of the next succeeding fiscal year, such sums as may be necessary, the obligations incurred and the expenditures made thereunder for payments under such title and under such Act of June 6, 1933, to be charged to the appropriation therefor for that fiscal year (Department of Labor) (p. 164). The aggregate of advance deposits during the current fiscal year to cover payment of fees by applicants for certification or inspection of such products, to remain available until expended, are available for "Salaries and expenses, certification and inspection services, Food and Drug Administration" (p. 166). The District of Columbia shall pay by check to Freedmen's Hospital at the beginning of each quarter such amount as the Surgeon General calculates will be earned on the basis of rates approved by the Bureau of the Budget (Federal Security Agency) (p. 167),

Receipts from non-Federal agencies representing reimbursement for subsistence and other expenses of travel of employees of the Office of Education performing advisory functions to such agencies shall be credited to the appropriation, "Salaries and expenses, Office of Education" (p. 168).

Payments to States (including Alaska, Hawaii, and Puerto Rico), next succeeding fiscal year: For making, after May 31 of the current fiscal year, payments to States in accordance with the Vocational Rehabilitation Act, as amended (including the objects specified in the appropriation "Payments to States (including Alaska, Hawaii, and Puerto Rico), Office of Vocational Rehabilitation") for the first quarter of the next succeeding fiscal year such sums as may be necessary, the obligations incurred and the expenditures made thereunder to be charged to the appropriation therefor for that fiscal year: Provided, That the payments made pursuant to this paragraph shall not exceed the amount paid to the States for the first quarter of the current fiscal year (p. 168). Together with the aggregate of amounts received from certificate, supervision, and examination fees collected from Federal credit unions as authorized by law (p. 172).

Grants to States, next succeeding fiscal year: For making, after May 31 of the current fiscal year, payments to States under titles I, IV, V, X, and XIV, respectively, of the Social Security Act, as amended, for the first quarter of the next succeeding fiscal year, such sums as may be necessary, the obligations incurred and the expenditures made thereunder for payments under each of such titles and under such Act of June 6, 1933, to be charged to the appropriation therefor for that fiscal year (p. 173).

For an annual premium to provide for the payment of all annuities, pensions, and death benefits in accordance with the provisions of the Railroad Retirement Acts of 1935 and 1937, as amended, for crediting to the Railroad Retirement Account an amount equal to amounts covered into the Treasury (minus refunds) during the current fiscal year (p. 176).

Legislative Branch Appropriation Act, 1953:

All sums received from sales of waste paper, other waste material, and condemned property, and for losses or damage to Government property, shall be deposited to the credit, on the books of the Treasury Department, of the appropriation made for the working capital of the Government Printing Office for the year in which the work is done, and be subject to requisition by the Public Printer (p. 194).

Departments of State, Justice, Commerce, and the Judiciary Appropriation Act, 1953: Sums received from States, counties, municipalities, and other public authorities

for expenses incurred in the maintenance and operation of airport-traffic-control towers may be credited to the appropriation "Salaries and expenses, Civil Aeronautics Administration" (p. 210).

Treasury and Post Office Departments Appropriation Act, 1953:

An amount equal to the difference between the revenues of the Post Office Department and the total of the appropriations to the Post Office Department is appropriated out of any money in the Treasury not otherwise appropriated (p. 228).

Public Law 306, approved April 9, 1952:

The Secretary of the Treasury is authorized and directed to pay to all persons who were awarded administrative pay increases as temporary indefinite ungraded employees of the Department of the Navy through administrative error such amounts as have been paid by them, or deducted from their salaries, or account of overpayments of compensation occasioned by such unauthorized increases (p. 259).

Private Law 729, approved June 27, 1952:

The Secretary of the Treasury is authorized and directed to pay to Louis R. Chadbourne an amount equal to the difference between the amount of retired pay to which he would have been entitled during the period in question and the amount of the disability compensation benefits received during the same period (p. 503).

Private Law 773, approved July 3, 1952:

The Secretary of the Treasury is authorized and directed to pay to Dr. James F. Spindler a sum representing compensation for the unused leave standing to the credit of the said Dr. Spindler on September 8, 1943, when he resigned from the Reserve Corps of the United States Public Health Service in order to accept a commission in the United States Army (p. 503).

Private Law 779, approved July 3, 1952:

The Secretary of the Treasury is authorized and directed to pay (not to exceed $3,764.91) to Carl M. Campbell, Greenwood, Massachusetts, to satisfy a judgment obtained by him against Frederick J. Powers, Boston, Massachusetts, and to James R. White, Wakefield, Massachusetts (not to exceed $4,148.88), to satisfy the judgment recovered by him against Frederick J. Powers, and to Frederick J. Powers (not to exceed $7,913.79 less any amounts paid by the Secretary of the Treasury to Messrs. Campbell and White (p. 503)).

Private Law 820, approved July 10, 1952:

The Secretary of the Treasury is authorized and directed to pay to David Braithwaite not to exceed $176.01 to satisfy the judgment and court costs recovered by him against Orvin E. Wilde and to Orvin E. Wilde a sum equal to $176.01 less the amount paid by the Secretary to David Braithwaite (p. 504).

Private Law 850, approved July 12, 1952:

The Secretary of the Treasury is authorized and directed to pay to Homer C. Boozer, Terry Davis, Leopold A. Fraczkowski, Earl W. Keating, and Charles A. Paris an amount equal to the aggregate of the amounts paid by them, respectively, or withheld from sums otherwise due them, respectively, in complete or partial satisfaction of the claims of the United States for refund of the compensation received by said persons as employees of the United States Post Office, Wilmington, Delaware, while they were also employed by the General Services Administration and were receiving dual compensation at a combined annual rate in excess of $2,000 (p. 504).

Private Law 853, approved July 12, 1952:

The Secretary of the Treasury is authorized and directed to pay to the Alma Cooperative Equity Exchange, Alma, Nebraska, and others the fair value of certain property, as determined by the Secretary of the Army, which was rendered useless by the United States in connection with the construction of the Harlan County Dam and Reservoir project (p. 504).
