The Committee on the Library, having had under consideration Senate Joint Resolution 47, to provide for the erection of a memorial fountain at Chevy Chase Circle and to accept donations for such purposes, reports thereon favorably and recommends its passage.

One of the main approaches to the city of Washington is by way of Chevy Chase Circle. Under the resolution, it is contemplated to erect a memorial fountain of simple design with appropriate landscaping at this point.

Under the resolution, the character and design of the improvement will be under the control of the Director of Public Buildings and Public Parks of the National Capital, U. S. Grant 3d., and the National Commission of Fine Arts. The cost will be borne by certain donors who have indicated a desire to thus contribute to the capital's beauty. The expense of upkeep will be small and comparable to the expense of operating any other of the small fountains of the city, will approximate $125 per year.

BRIDGE ACROSS BIG SANDY RIVER BETWEEN KENOVA, W. VA., AND CATLETTSBURG, KY.

The Committee on Commerce, to whom was referred the bill (S. 2915) authorizing A. A. Lilly, M. B. Collingsworth, and A. E. Booth, their heirs, legal representatives, and assigns, to construct, maintain, and operate a bridge across the Big Sandy River at or near where it enters the Ohio River, and between the cities of Kenova, W. Va., and Catlettsburg, Ky., having considered the same, report favorably thereon, and recommend that the bill do pass with the following amendment:

Page 2, line 1, after the word "operate", insert "a bridge and approaches thereto across the Big Sandy River" and the amendment of the title to correspond to the amendment on page 2, line 1.

The bill has the approval of the Department of War as will appear by the annexed communications. It does not have the approval of the Department of Agriculture, and the Senate's attention is invited to the latter department's letter annexed hereto. The department calls attention to rival claims upon this bridge site which might be stressed by the State of West Virginia. The Committee on Commerce communicated with the public authorities of the State of West Virginia upon this score. The State, speaking through its State road commission and its State bridge commission, has responded to the committee in favor of the passage of the bill. These communications are annexed. The committee deems these exhibits conclusive in respect to its rule that public authorities shall have preference in respect to bridge rights.

DEAR SENATOR: Receipt is acknowledged of your letter of January 15, transmitting a copy of a bill (S. 2915) with request that the committee be furnished with such suggestions touching its merits and the propriety of its passage as the department might deem appropriate.

The title to this bill recites that it is to authorize A. A. Lilly, M. B. Collinsworth, and A. E. Booth, their heirs, legal representatives, and assigns, to construct, maintain, and operate a bridge across the Big Sandy River at or near where it enters into the Ohio River, and between the cities of Kenova, W. Va., and Catlettsburg, Ky. Apparently, however, there is an omission in section 1 after the word "operate," line 1, page 2, where it would seem that the words "a bridge across the Big Sandy River" should be inserted. Otherwise the bill conforms to the usual form of bridge bill.

The location indicated for the proposed bridge is on the system of Federal-aid highways approved for the States of West Virginia and Kentucky. Under date of March 3, 1931, Congress passed an act (46 Stat. 1499) to authorize the State of West Virginia, by and through the State Bridge Commission of West Virginia, to acquire, purchase, rebuild, improve, maintain, and operate a number of bridges, among which was one across the Big Sandy River at or near Kenova. This act carried a provision allowing two and four years, respectively, from the date of its approval, for the commencement and completion of any new bridge to be built under that authorization.

It is the view of the department that authority should not be granted to any private interest for the construction of a bridge at this point, particularly since the State Bridge Commission of West Virginia already has authority from Congress to construct a bridge at what appears to be the same location as that proposed in the pending bill. The department, therefore, recommends against favorable action on the bill.

Answering your telegram January 27, regarding authorization for construction by private interests of highway bridge at Kenova, W. Va., the members of bridge commission direct me to advise that under the existing conditions of bond market the bridge commission has no objections to granting of franchise in this particular case, if provision is made for recapture by the public.

GENTLEMEN: There has come to our attention Senate bill No. 2915, introduced January 7, 1932, by Hon. Henry D. Hatfield, United States Senator from West Virginia. This bill proposes the authorization for erection of a bridge across the Big Sandy River between Kenova, W. Va., and Catlettsburg, Ky.

The erection of a bridge as contemplated by this bill would, in our opinion, be the proper location as relates to our roads in that vicinity and particularly to United States route No. 60, and is in line with our road program on said route. Very truly yours, C. P. FORTNEY, Chairman.
