DAC #76-42 28 FEBRUARY 1983 CONTRACT CLAUSES AND SOLICITATION PROVISIONS (c) The following clause may be used in lieu of the one at 7-104.27 (a) whenever the contract specifies the option quantity as a percentage of the basic contract quantity or as an additional quantity of a specific line item. OPTION FOR INCREASED QUANTITY (1983 FEB) The Government may increase the items called for herein by the quantities stated and at the unit prices specified elsewhere in this contract. The Contracting Officer may exercise this option at any time within the period specified in the contract by giving written notice to the Contractor. Delivery of items added by exercise of this option shall be in accordance with the delivery schedule set forth elsewhere in this contract. (End of clause) (d) The Discontinuance Repricing clause may be inserted in the solicitation when the Government considers it appropriate to do so. (See 4-1104.22(b)(5).) The contract may contain this contractual provision when the contracting parties mutually agree to its insertion. The offeror is provided an opportunity to indicate its position by checking the appropriate box in the solicitation/contract provision. DISCONTINUANCE REPRICING (1983 FEB) (a) By the incorporation of this clause in this solicitation, the Government indicates its willingness to incorporate the contract provision entitled Discontinuance of Rental and Repricing into the contract resulting from this solicitation. The pro vision provides an alternative to standard termination for convenience procedures in appropriate circumstances. DISCONTINUANCE OF RENTAL AND REPRICING (1983 FEB) (a) The Government may, in lieu of a termination under the clause of this contract entitled Termination for the Convenience of the Government, during the initial or any option period of performance of this contract, discontinue rental of any equipment or software on a date specified in a written notice provided to the Contractor not less than 30 days prior to the specified discontinuance date. The Government may discontinue the rental on shorter notice when agreed to by the Contractor. (b) In the event of discontinuance of rental under (a) above, the Government shall pay termination repricing charges to the Contractor as computed in accordance with this paragraph (b).
