TITLE V-MISCELLANEOUS PROVISIONS

SEC. 401. All payments made and supplies issued under sections 9385-9387 of title 10, United States Code, in connection with the training of a person at an Air Force Reserve Officers' Training Corps unit while such person was a student at a civil educational institution where a unit of the corps was not established, are hereby validated.

SEC. 402. If a part of this Act is invalid, all valid parts that are severable from the invalid part remain in effect. If a part of this Act is invalid in one or more of its applications, the part remains in effect in all valid applications that are severable from the invalid applications.

SEC. 403. Insofar as it relates to the Army program and the Air Force program, section 2107 (h) of title 10, United States Code, becomes effective on September 1, 1968. Until that date, not more than four thousand cadets may be in either of those programs at any one time. So far as it relates to the Navy program, section 2107 (h) of title 10 becomes effective on September 1, 1965.

CHAPTER IV. SUMMARY OF THE LEGISLATION

A. BILLS REPORTED FROM THE SENATE COMMITTEE ON LABOR AND PUBLIC WELFARE

Enactments by the 88th Congress concerning education and training ranged from grants for construction of teaching facilities for medical, dental, and other health personnel, as provided in Public Law 88-129, which was called in the press the "first new education measure since 1958," to Public Law 88-210, which includes provisions affecting education at all levels.

In 1963 and 1964 the Committee on Labor and Public Welfare considered numerous measures concerning education and training. Enactments involving such activities which, in the earlier form of bills, were reported from that committee, include the following:

Public Law 88-126, September 23, 1963, which provides for State approving agency approval of courses under the war orphans' educational assistance program.

Public Law 88-129, September 24, 1963, the Health Professions Educational Assistance Act of 1963, which authorizes matching grants for the construction of teaching facilities for the training of persons for specified health professions, and loans to students of medicine, dentistry, and optometry.

Public Law 88-164, October 31, 1963, the Mental Retardation Facilities and Community Mental Health Centers Construction Act of 1963, which, among other provisions, authorizes grants for the construction of university-affiliated facilities for the mentally retarded and expands the program for training teachers of handicapped children so as to include all handicapped children.

Public Law 88-204, December 16, 1963, the Higher Education Facilities Act of 1963, which authorizes grants and loans to public and other nonprofit institutions of higher education in financing the construction, rehabilitation, or improvement of needed classrooms, laboratories, libraries, and related facilities in undergraduate and graduate institutions.

Public Law 88-210, part A, December 18, 1963, the Vocational Education Act of 1963, which broadens the definition of vocational education; authorizes grants to States to assist them to maintain, extend, and improve their programs of vocational education for persons of all ages; and authorizes grants for work-study programs and residential vocational education schools.

Public Law 88-210, part B, December 18, 1963, the National Defense Education Act amendments, which extend for 1 year and increase the authorization for the student loan program; and extend for 1 year and in some instances amend the programs for national defense fellowships; guidance, counseling, and testing; modern foreign language study: research and experimentation with teaching aids; and improvement of educational statistics.

Public Law 88-210, part C, December 18, 1963, school assistance to federally affected areas extension, which continues to June 30, 1965, the programs of Federal assistance for public school construction, operation, and maintenance in certain federally affected localities.

Public Law 88-214, December 19, 1963, the Manpower Development and Training Act amendments, which extend and expand the training programs under this act.

Public Law 88-269, February 11, 1964, the Library Services and Construction Act, which increases Federal aid for the development of library services, extends such aid to urban as well as rural areas, and provides for Federal assistance for the construction of public library buildings.

Public Law 88-361, July 7, 1964, which provides for educational assistance to the children of veterans totally and permanently disabled from service-connected disabilities.

Public Law 88-368, July 9, 1964, which extends the Juvenile Delinquency and Youth Offenses Control Act of 1961 for 2 years, and provides for a special study of school attendance and child labor laws, and for a national juvenile delinquency demonstration project.

Public Law 88-452, August 20, 1964, the Economic Opportunity Act of 1964, which, while not an education bill as such, contains a number of educational and training provisions.

Public Law 88-497, August 27, 1964, the Graduate Public Health Training Amendments of 1964, which extends the authorization for assistance in the provision of graduate or specialized public health training.

Public Law 88-579, September 3, 1964, which provides for a National Council on the Arts and establishes a National Arts Foundation.

Public Law 88-581, September 4, 1964, which amends the Public Health Service Act to increase the opportunities for training professional nursing personnel.

Public Law 88-654, October 13, 1964, which amends title VII of the Public Health Service Act so as to extend to qualified schools of optometry and students of optometry those provisions thereof relating to student loan programs.

Public Law 88-665, October 16, 1964, titles I-X, the National Defense Education Act Amendments, 1964, which extends and broadens the provisions of the National Defense Education Act of 1958, as amended.

Public Law 88-665, October 16, 1964, title XI, which extends for 1 year the program of financial assistance to "federally impacted" school districts, and includes for the first time schools in the District of Columbia.

B. BILLS REPORTED FROM OTHER COMMITTEES OF THE SENATE

Eighty-eighth Congress enactments concerning education and training, which, in the form of bills, were reported from Senate committees other than the Committee on Labor and Public Welfare included the following:

Public Law 88-2, March 28, 1963, universal military training and service extension to July 1, 1967, which generally affects the education and training of the Nation's young men.

Public Law 88-136, October 11, 1963, Labor, Health, Education, and Welfare appropriations, fiscal 1964, which include among the larger appropriations affecting education and training, $219,620,000 for grants, loans, and payments under the National Defense Education Act, and $110 million for manpower development and training activities of the Office of Manpower, Automation, and Training, Department of Labor.

Public Law 88-149, October 17, 1963, Department of Defense appropriations, fiscal 1964, which appropriate billions of dollars for the Armed Forces, much of which goes for the training of personnel, including vocational training in many fields.

Public Law 88-200, December 13, 1963, Peace Corps Act amendments, authorizing, for fiscal 1964, an appropriation of $102 million for the Peace Corps program, which operates largely through educational institutions.

Public Law 88-205, December 16, 1963, Foreign Assistance Act of 1963, which contains several provisions affecting education and training activities, widely involved in foreign aid.

Public Law 88-206, December 17, 1963, the Clean Air Act, containing a number of provisions for training and research, which will be carried out largely at educational institutions.

Public Law 88-210, December 23, 1963, Indian vocational training amendments, increasing the authorization for and otherwise enlarging the adult Indian vocational education program.

Public Law 88-215, December 19, 1963, independent offices appropriations, fiscal 1964, which include the appropriation of $323,200,000 for salaries and expenses of the National Science Foundation, an agency "whose primary concern is education." 1

Public Law 88-245, December 30, 1963, Departments of State, Justice, and Commerce, the judiciary and related agencies appropriations, fiscal 1964, which include appropriation of $42,625,000 for the mutual educational and cultural exchange activities, and appropriations for other programs involving education and training.

Public Law 88-246, December 30, 1963, which provides for the preparation and printing of materials relating to annual national high school and college debate topics.

Public Law 88-276, March 3, 1964, which changes provisions for the nomination and selection of candidates for appointment to the Military, Naval, and Air Force Academies.

Public Law 88-352, July 2, 1964, the Civil Rights Act, which contains several titles affecting education and training.

Public Law 88-379, July 17, 1964, which establishes water resource research centers at land-grant colleges and State universities and otherwise promotes a national program of water research.

Public Law 88-560, September 2, 1964, the Housing Act of 1964, which includes provision for two new programs for training specialists in city planning and community development.

Public Law 88-605, September 19, 1964, which makes appropriations for the Departments of Labor, and Health, Education, and Welfare for fiscal 1965, including appropriations for new educational and training programs.
