APPENDIX APPENDIX A-LEGISLATION PUBLIC LAW 86-108, JULY 24, 1959 * CHAPTER VI-CENTER FOR CULTURAL AND TECHNICAL INTERCHANGE BETWEEN EAST AND WEST STATEMENT OF PURPOSE SEC. 601. The purpose of this chapter is to promote better relations and understanding between the United States and the nations of Asia and the Pacific (hereinafter referred to as "the East") through cooperative study and research, by establishing in Hawaii a Center for Cultural and Technical Interchange Between East and West, either as a branch of an existing institution of higher learning or as a separate institution, where scholars and students, in various fields from the nations of the East and the Western World may meet, study, exchange ideas and views, and conduct other activities primarily in support of the objectives of the United States Information and Educational Exchange Act of 1948, as amended, and title III of chapter II of the Mutual Security Act of 1954 and other Acts promoting the international educational, cultural, and related activities of the United States. ESTABLISHMENT OF CENTER SEC. 602. In order to carry out the purposes of this chapter the Secretary of State (hereinafter referred to as Secretary), after consultation with appropriate public and private authorities, shall on or before January 3, 1960, prepare and submit to the Congress a plan and program for (1) the establishment and operation in Hawaii of an educational institution to be known as the Center for Cultural and Technical Interchange Between East and West through arrangements to be made with public, educational, or other nonprofit institutions; (2) grants, fellowships, and other payments to outstanding scholars and authorities from the nations of the East and Western World as may be necessary to attract such scholars and authorities to the Center; (3) grants, scholarships, and other payments to qualified candidates from the nations of the East and West as may be necessary to enable such students to engage in study at the Center; and (4) making the facilities of the Center available for study to other qualified persons on a reasonable basis. AUTHORIZATION OF APPROPRIATIONS SEC. 603. There are authorized to be appropriated, to remain available until expended, such amounts as may be necessary to carry out the provisions of this chapter. CONFERENCE REPORT ON MUTUAL SECURITY ACT OF 1959, HOUSE REPORT 695, 86TH CONGRESS, 1ST SESSION CENTER FOR CULTURAL AND TECHNICAL INTERCHANGE BETWEEN EAST AND WEST (SECS. 601-603) Chapter VI (secs. 601-603) of the Senate bill provided that, in order to promote better understanding between the peoples of the Far East and the United States, the Secretary of State should present a plan to Congress for the establishment in Hawaii of a Center, to be called the Center for Cultural and Technical Interchange Between East and West where students, scholars, and technicians from the East and West could meet and cooperate. The Senate amendment called for the submission to Congress on or before January 3, 1960, of a plan and program which shall provide for: 1. The establishment and operation in Hawaii of the Center through arrangements to be made with public educational and other nonprofit institutions; 2. Grants, fellowships, and other payments to outstanding scholars and authorities from the nations of the East and West; 3. Grants, scholarships, and other payments to qualified candidates for study at the Center from both East and West; and 4. Making the facilities of the Center available for study to other qualified persons on a reasonable basis. Provision is also made for such appropriations as may be necessary to carry out the provisions of the chapter. The managers on the part of the House accepted the Senate amendment with the deletion of the words "which shall provide." The language agreed upon is intended to give greater scope to those preparing the plan and program. It is understood that in submitting the plan the Secretary of State may also inform the Congress as to the feasibility and desirability of the entire program envisioned by the Senate amendment. Hawaii is the crossroads of the East and the West. Here the cultures of Asia and of Europe and of the Americas have met and have learned to live together. Consequently, it is most appropriate that a Center such as this should be established in Hawaii where cooperation has been the rule for many years. PUBLIC LAW 86-472, MAY 14, 1960 * CHAPTER VII-CENTER FOR CULTURAL AND TECHNICAL INTERCHANGE BETWEEN EAST AND WEST SEC. 701. This chapter may be cited as the "Center for Cultural and Technical Interchange Between East and West Act of 1960". SEC. 702. The purpose of this chapter is to promote better relations and understanding between the United States and the nations of Asia and the Pacific (hereinafter referred to as "the East") through cooperative study, training, and research, by establishing in Hawaii a Center for Cultural and Technical Interchange Between East and West where scholars and students in various fields from the nations of the East and West may study, give and receive training, exchange ideas and views, and conduct other activities primarily in support of the objectives of the United States Information and Educational Exchange Act of 1948, as amended, title III of chapter II of the Mutual Security Act of 1954, and other Acts promoting the international, educational, cultural, and related activities of the United States. SEC. 703. In order to carry out the purpose of this chapter the Secretary of State (hereinafter referred to as the "Secretary") shall provide for (1) the establishment and operation in Hawaii of an educational institution to be known as the Center for Cultural and Technical Interchange Between East and West, through arrangements with public, educational, or other nonprofit institutions; (2) grants, fellowships, and other payments to outstanding scholars and authorities from the nations of the East and West as may be necessary to attract such scholars and authorities to the Center; (3) grants, scholarships, and other payments to qualified students from the nations of the East and West as may be necessary to enable such students to engage in study or training at the Center; and (4) making the facilities of the Center available for study or training to other qualified persons. SEC. 704. (a) In carrying out the provisions of this chapter, the Secretary may utilize his authority under the provisions of the United States Information and Educational Exchange Act of 1948, as amended. (b) The Secretary may, in administering the provisions of this chapter, accept from public and private sources money and property to be utilized in carrying out the purposes and functions of the Center. In utilizing any gifts, bequests, or devises accepted there shall be available to the Secretary the same authorities as are available to him in accepting and utilizing gifts, bequests, and devises to the Foreign Service Institute under the provisions of the title X, part C of the Foreign Service Act of 1946, as amended. For the purposes of Federal income, estate, and gift taxes, any gift, devise, or bequest accepted by the Secretary under the authority of this chapter shall be deemed to be a gift, devise, or bequest to or for the use of the United States. (c) The Secretary shall make an annual report to the Congress with respect to his activities under the provisions of this chapter, and such report shall include any recommendations for needed revisions in this chapter. SEC. 705. There are authorized to be appropriated, to remain available until expended, such amounts as may be necessary to carry out the provisions of this chapter. CONFERENCE REPORT ON MUTUAL SECURITY ACT OF 1960, HOUSE REPORT 1593, 86TH CONGRESS, 2D SESSION CENTER FOR CULTURAL AND TECHNICAL INTERCHANGE BETWEEN EAST AND WEST (CH. VII) The committee of conference agreed to the language in the Senate amendment providing for the authorization of an appropriation to establish a Center for Cultural and Technical Interchange Between East and West. The activities to be carried out by the Center are those that will support the objectives of the U.S. Information and Educational Exchange Act of 1948 (the Smith-Mundt Act) and other acts promoting the international, educational, cultural, and related activities of the United States. Last year the Congress directed the Secretary of State to submit to Congress before January 3, 1960, a plan and program for the establishment in Hawaii of an educational institution, for grants, fellowships, and other payments to outstanding scholars and to qualified students from the nations of the East and the West. The Secretary of State filed a comprehensive report, as required. The language in the bill will permit the Secretary of State to carry out the recommendations contained in the report through any appropriate Federal or State agency or department. The establishment of such a Center is in keeping with the objectives of the mutual security program and will constitute a significant contribution toward better understanding between the people of Asia and the Pacific area and of the United States. EXCERPT FROM DEPARTMENTS OF STATE AND JUSTICE, THE JUDICIARY, AND RELATED AGENCIES APPROPRIATION ACT, 1961, PUBLIC LAW 86-678 CENTER FOR CULTURAL AND TECHNICAL INTERCHANGE BETWEEN EAST AND WEST To enable the Secretary of State to provide for carrying out the provisions of the Center for Cultural and Technical Interchange Between East and West Act of 1960, by grant to any appropriate agency of the State of Hawaii, $10,000,000. The former amendment is needed to carry out the program recommended by the Secretary of State's report to Congress of December 31, 1959, regarding the establishment and operation in Hawaii of a center for cultural and technical interchange between East and West. The Secretary's recommendations were recently enacted into law in the Mutual Security Act of 1960 and funds are required now in order to proceed with immediate establishment of the center. The funds would be used for the Federal contribution toward construction of facilities and, during the first 3 years, costs of operating the center; scholarships for Asian, Pacific, and American students; grants to Asian, Pacific, and American scholars; and advisory services. CENTER FOR CULTURAL AND TECHNICAL INTERCHANGE BETWEEN EAST AND WEST (Departments of State and Justice, the Judiciary, and related agencies appropriation bill, 1961, S. Rept. 1777, 86th Cong., 2d sess., June 29, 1960) The budget estimate presented in Senate Document 106 called for $8,300,000 to cover the costs of a 3-year program to carry out the establishment and operation in Hawaii of a center for cultural and technical interchange between East and West, as authorized by chapter VII of the Mutual Security Act of 1960, Public Law 86-472, approved May 14, 1960.
