"(E) transportation services as required for adequate patient care.

"(2) The term 'supplemental health services' means—

"(A) inpatient hospital services;

"(B) home health services;

"(c) (1) The Secretary may make grants to public and 11 nonprofit private entities to assist in (1) the establishment 12 and initial operation of neighborhood health centers which 13 will serve a medically underserved area or group, and (2) 14 meeting the cost of the continued operation of such centers. 15 For purposes of this paragraph, the term 'medically under16 served area or group' means an urban or rural area or pop17 ulation group designated by the Secretary as an area or pop18 ulation group with a shortage of personal health services.

"(2) Each neighborhood health center which receives a grant under paragraph (1) of this notification shall review 21 its catchment area to (A) insure that the size of such area 22 is such that the services to be provided through the center 23 (including its satellites) are available and accessible to the 24 residents of the area promptly, as appropriate, (B) insure 25 that the boundaries of such area conforms, to the extent

1 practicable, with relevant boundaries of political subdivisions, 2 schools, and Federal and State health and social service 3 programs, and (C) insure that the boundaries of such area 4 eliminates, to the extent possible, barriers to access to the 5 services of the center, including barriers resulting from the 6 area's physical characteristics, its residential patterns, its 7 economic and social groupings, and available transportation. "(d) No grant may be made under subsection (c) 9 unless an application therefor has been submitted to and 10 approved by the Secretary. Such application shall be sub11 mitted in such form and manner and shall contain such 12 information as the Secretary shall prescribe. The Secretary 13 may not approve an application for a grant for a neigh14 borhood health center unless he determines that

"(1) the center will compile and report such statistics and other information as the Secretary may re

quire with respect to (A) the cost of its operations,

(B) the patterns of utilization of its services, (C) the availability, accessibility, and acceptability of its services, and (D) such other matters as the Secretary may require;

"(2 the center will demonstrate its financial responsibility by the use of accounting procedures and other requirements as may be prescribed by the Sec

retary in order to insure that the center maintains a

solvent operation;

"(3) the center (A) has or will have a contrac

tual or other arrangement with the agency of the State in which it provides services which administers or super

vises the administration of a State plan approved under title XIX of the Social Security Act for the payment of

all or a part of the center's costs in providing primary health services to persons who are eligible for medical assistance under such a State plan, or (B) has made or will make every reasonable effort to enter into such an

arrangement; and

"(4) the center has made or will make and will

14 continue to make every reasonable effort to collect ap15 propriate reimbursement for its costs in providing primary health services to persons who are entitled to insurance benefits under title XVIII of such Act, to medical assistance under a State plan approved under title XIX of such Act, or to assistance for medical expenses

under any other public assistance program or private

health insurance program.

"(e) For the purpose of making payments under grants 23 under subsection (c), there are authorized to be appropriated 24 $220,000,000 for the fiscal year ending June 30, 1975, and 25 $240,000,000 for the fiscal year ending June 30, 1976.".

A BILL

To amend the Community Mental Health Centers Act to revise the various programs of assistance authorized by that Act and to extend it to the fiscal year 1976.

SEC. 2. The Congress finds that

(1) community mental health care is the most effective and humane form of care for a majority of men

tally ill individuals;

(2) the federally funded community mental health centers have had a major impact on the improvement of mental health care by

(A) fostering coordination and cooperation

between various agencies responsible for mental health care which in turn has resulted in a decrease

in overlapping services and more efficient utilization

of available resources,

(B) bringing comprehensive community mental health care to all in need within a specific geographic area regardless of ability to pay, and

(C) developing a system of care which insures continuity of care for all patients, and

thus are a national resource to which all Americans

should enjoy access;

(3) there is currently a shortage and maldistribution of quality community mental health care resources in the United States; and

(4) until such time as legislation is enacted and becomes effective which insures all Americans financial

access to the mental health services which are presently available through community mental health centers,

Federal funds should continue to be made available for

the purposes of initiating new community mental health

goals relating to community mental health care.

SEC. 3. The Community Mental Health Centers Act
