TITLE II-COMMUNITY MENTAL HEALTH

CENTERS

SEC. 201. This title may be cited as the "Community

8 Mental Health Centers Amendments of 1973".

SEC. 202. The Congress finds that

(1) community mental health care is the most ef

fective and humane form of care for a majority of mentally ill individuals;

(2) the federally funded community mental health centers have had a major impact on the improvement of mental health care by

(A) fostering coordination and cooperation between various agencies responsible for mental health care which in turn has resulted in a decrease in overlapping services and more efficient utilization

of available resources,

(B) bringing comprehensive community mental health care to all in need within a specific geo

graphic area regardless of ability to pay, and

(C) developing a system of care which insures

continuity of care for all patients, and

thus are a national resource to which all Americans

should enjoy access;

(3) there is currently a shortage and maldistribution of quality community mental health care resources in the United States; and

(4) until such time as legislation is enacted and becomes effective which insures all Americans financial

access to the mental health services which are presently available through community mental health centers, Federal funds should continue to be made available for

the purposes of initiating new community mental health

centers responsive to community needs and national goals relating to community mental health care.

SEC. 203. The Community Mental Health Centers Act

is amended to read as follows:

"SEC. 201. (a) For purposes of this title, the term 22 'community mental health center' means a legal entity (1) 23 through which comprehensive mental health services are 24 provided in the area served by the center (referred to in 25 this title as a 'catchment area') in the manner prescribed by

1 subsection (b), and (2) which is organized in the manner 2 prescribed by subsection (c)..

3. "(b) (1) The comprehensive mental health services 4 which shall be provided through a community mental health 5 center shall include

"(A) services for individuals who are inpatients in

a hospital or other health services delivery facility, outpatient services, day care and similar partial hospitalization services, and emergency services;

"(B) detoxification and referral services for the 11 treatment of alcohol abuse, alcoholism, and other drug

abuse and drug dependence problems (including narcotic addiction);

"(C) consultation and education services for health professionals, schools, State and local law enforcement

and correctional agencies, public welfare agencies, health

services delivery agencies, and other appropriate entities; "(D) assistance to courts and other public agencies 19 in screening residents of the center's catchment area who

are being considered for referral to a State mental health

facility for treatment to determine if they should be so

referred and provision, where appropriate, of treatment

for such persons through the center as an alternative to

treatment at such a facility;

"(E) provision of followup care for residents of its

catchment area who have been discharged from a State mental health facility; and

"(F) provision of each of the following service pro

grams (other than a service program which the Secretary determines the center is unable to provide or for which there is not sufficient need (as determined by the Secretary) in the center's catchment area):

"(i) A specialized program for the mental health of children, including a full range of diagnostic, treatment, liaison, and followup services (as prescribed by the Secretary).

"(ii) A program of comprehensive specialized services for the mental health of the elderly, including a full range of diagnostic, treatment, liaison, and followup services (as prescribed by the Secretary).

"(iii) A comprehensive program for the prevention and treatment of alcoholism and alcohol

abuse.

"(iv) A comprehensive program for the prevention, treatment, and rehabilitation of drug addicts, drug abusers, and other persons with drug dependency problems.

"(2) The provision of comprehensive mental health

25 services through a center shall be coordinated with the

1 provision of services by other health and social service agen2 cies in the center's catchment area to insure that persons 3 receiving services through the center have access to all such 4 health and social services as they may require. The center's 5 services (A) may be provided at the center or satellite 6 centers through the staff of the center or through appropriate 7 arrangements with health professionals and others in the 8 center's catchment area, (B) shall be available and accessible 9 to the residents of the area promptly, as appropriate, and 10 in a manner which assures continuity and which overcomes 11 geographic, cultural, or economic barriers to the receipt of 12 services, and (C) when medically necessary, shall be avail13 able and accessible twenty-four hours a day and seven days 14 a week.

"(c) (1) The governing body of a community mental 16 health center shall be composed of individuals who reside 17 in the center's catchment area and who, as a group, represent 18 the residents of that area taking into consideration the em19 ployment, age, sex, and place of residence of the members 20 of the governing body. At least one-third of the members 21 of such body shall be individuals who are not providers of 22 health care services. For purposes of this paragraph, the 23 term 'provider of health care services' means an individual 24 who receives (either directly or through his spouse) more 25 than one-tenth of his gross annual income from fees or other
