estimate of the financial and other responsibilities to be

borne by the Federal Government; and

(3) a report on the maintenance and operation of the National Reporting System for Family Planning Services on which services figures and program evalua

tions for the Department of Health, Education, and Welfare shall be based.

(c) On each January 1 thereafter for a period of five 9 years, the Secretary shall submit to the Congress a report

(1) compare results achieved during the preceding fiscal year with the objectives established for such year

under the plan;

(2) indicate steps being taken to achieve the objective during the remaining fiscal years of the plan and any revisions necessary to meet these objectives; and

(3) make recommendations with respect to any additional legislative or administrative action necessary

or desirable in carrying out the plan.

SPECIAL PROJECT GRANTS FOR FAMILY PLANNING

SERVICES

SEC. 8. (a) Grants under this section shall be made

23 according to regulations promulgated by the Secretary. 24 Funds shall be allocated after taking into account the num25 ber of patients to be served, the extent to which family plan

1 ning services are needed locally, the relative need of the

2 applicant and its capacity to make rapid and effective use of 3 such assistance.

(b) Any grant under this section shall be payable in 5 such installments and subject to such conditions as the Sec6 retary may determine to be appropriate to assure that such 7 grant will be effectively utilized for the purpose for which 8 it is made.

(c) For the purpose of making grants under this sec10 tion, there is authorized to be appropriated $244,000,000 11 for the fiscal year ending June 30, 1974, $286,000,000 for 12 the fiscal year ending June 30, 1975, $328,000,000 for the 13 fiscal year ending June 30, 1976.

14 (d) The acceptance of family planning services pro15 vided shall be voluntary and shall not be a prerequisite or 16 impediment to eligibility for or the receipt of other benefits or participation in any other programs of financial or medical

18 assistance.

SEC. 9. (a) There are authorized to be appropriated 22 $25,000,000 for the fiscal year ending June 30, 1974, 23 $35,000,000 for the fiscal year ending June 30, 1975, 24 $50,000,000 for the fiscal year ending June 30, 1976, to 25 enable the Secretary to make grants to State health agencies

1 to assist the States in planning, establishing, maintaining, co2 ordinating, and evaluating family planning services. The sum 3 so appropriated shall be used for making payments to States 4 which have submitted, and had approval by the Secretary, 5 State plans for a coordinated and comprehensive program of 6 family planning services.

(b) From the sums appropriated to carry out the provi

8 sions of this section, the several States shall be entitled for

9 each fiscal year to allotments determined by the Secretary

10

on the basis of the population and financial need of the re11 spective States.

(c) For the purposes of this section the term "State" 13 includes the Commonwealth of Puerto Rico, Guam, Ameri

14

can Samoa, the Virgin Islands, the District of Columbia, and 15 the Trust Territory of the Pacific Islands.

(d) The acceptance of family planning services provided 17 shall be voluntary and shall not be a prerequisite or impediment to eligibility for or the receipt of other benefits or par19 ticipation in any other programs of financial or medical

REGULATIONS AND PAYMENTS

SEC. 10. (a) Grants and contracts made under this Act

23 shall be made in accordance with such regulations as the

24 Secretary may promulgate.

(b) Grants under this Act shall be payable in such

1 installments and subject to such conditions as the Secretary 2 may determine to be appropriate to assure that such grants 3 will be effectively utilized for the purposes for which made. (c) A grant may be made or contract entered into for a 5 family planning service project or program only upon as

6 surances satisfactory to the Secretary that―

(1) priority will be given in such project or program to the furnishing of such services to persons from low-income families; and

(2) no charge will be made in such project or program for services provided to any person from a lowincome family except to the extent that payment will be

made by a third party (including a government agency)

which is authorized or is under legal obligation to pay such charge.

16 For purposes of this subsection, the term "low-income fam17 ily" shall be defined by the Secretary in accordance with 18 such criteria as he may prescribe.

19 (d) The funds authorized under this title are intended 20 and limited to the support of preventive family planning 21 services, infertility services and related medical, informa22 tional, and educational activities. Abortion is not included as a method of family planning under this title. The Act is 24 not intended to interfere with or limit programs conducted

25 in accordance with State or local laws and regulations which

SEC. 11. For the purpose of training the necessary 6 manpower required to fulfill the purposes of section 5 (a) 7 (1), the following sums shall be authorized and appropri8 ated: $6,000,000 for the fiscal year ending June 30, 1974; 9 $8,000,000 for the fiscal year ending June 30, 1975; 10 $10,000,000 for the fiscal year ending June 30, 1976; for 11 the purpose of program planning and evaluation required to 12 fulfill the purposes of section 5 (a) (1), the following sums 13 shall be authorized and appropriated: $6,000,000 for the 14 fiscal year ending June 30, 1974; $8,000,000 for the fiscal 15 year ending June 30, 1975; $10,000,000 for the fiscal year ending June 30, 1976.

RESEARCH GRANTS AND CONTRACTS

SEC. 12. For the purpose of making grants and entering 19 into contracts required to fulfill the purposes of section 5 (a) (2), there is hereby authorized to be appropriated $100,000,000 for the fiscal year ending June 30, 1974; $125,000,000 for the fiscal year ending June 30, 1975; 23 $150,000,000 for the fiscal year ending June 30, 1976.
