Section 301 of the Comprehensive Alcohol Abuse and Alcoholism Prevention, Treatment, and Rehabil 5 itation Act of 1970 is amended by striking out "each of the 6 next two fiscal years" and inserting in lieu thereof "each of 7 the next five fiscal years". 8 9 10 TITLE III-DEVELOPMENTAL DISABILITIES SHORT TITLE; REFERENCES TO SECTIONS SEC. 301. (a) This title may be cited as the "Develop 11 mental Disabilities Amendments of 1974". 12 (b) Unless the context otherwise requires, whenever 13 in this title an amendment or repeal is expressed in terms 14 of an amendment to, or repeal of, a section or other provision, the reference shall be considered to be made to a section or 16 other provision of the Development Disabilities Services and 17 Facilities Construction Act. 15 18 19 EXTENSION OF AUTHORIZATIONS SEC. 302. (a) Section 122 (b) is amended by striking 20 out "and" before "$9,250,000" and by inserting before the 21 period at the end thereof ", and such sums as may be neces22 sary for the fiscal year ending June 30, 1975, and for each 23 of the next two fiscal years". 24 (b) Section 131 is amended by striking out "and" be 25 fore "$32,500,000" and by inserting before the period at the 9 1 end thereof ", and such sums as may be necessary for the 2 fiscal year ending June 30, 1975, and for each of the next 3 4 two fiscal years". MINIMUM ALLOTMENT FOR TERRITORIES 5 SEC. 303. Section 132 (a) (1) is amended by striking 6 7 out "any State (other than the Virgin Islands, American Samoa, Guam, and the Trust Territory of the Pacific Is8 lands)" and inserting in lieu thereof "the Virgin Islands, 9 American Samoa, Guam, and the Trust Territory of the 10 Pacific Islands for any such fiscal year shall not be less 11 than $50,000, and the allotment of each other State". 12 13 14 ELIMINATION OF REQUIREMENTS OF FEDERAL APPROVAL OF EACH CONSTRUCTION PROJECT SEC. 304. (a) (1) Sections 135 and 136 are stricken, 15 and sections 137, 138, and 139 are redesignated as sections 16 135, 136, and 137, respectively. 17 (2) Section 123 (a) (2) is amended by striking out 18 "139" and inserting in lieu thereof "137". 19 (3) Section 134 (b) is amended by striking out "and” 20 after the semicolon at the end of paragraph (17), by re21 designating paragraph (18) as paragraph (20), and by 22 inserting the following new paragraphs after paragraph 23 (17): 24 25 “(18) provide reasonable assurance that adequate financial support will be available to complete the con 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 10 struction of, and to maintain and operate when such construction is completed, any facility, the construction of which is assisted by funds made available pursuant to section 132; "(19) provide reasonable assurance that all laborers and mechanics employed by contractors or subcontractors in the performance of work on any construction project assisted with funds made available pursuant to section 132 will be paid wages at rates not less than those prevailing on similar construction in the locality as determined by the Secretary of Labor in accordance with the Davis-Bacon Act, as amended (40 U.S.C. 276a-276a-5); and the Secretary of Labor shall have with respect to the labor standards specified in this paragraph the authority and functions set forth in Reorganization Plan Numbered 14 of 1950 (15 F.R. 3176; 5 U.S.C. 133z-15) and section 2 of the Act of June 13, 1934, as amended (40 U.S.C. 276c); and”. (4) The heading of the section redesignated as section 20 135 by paragraph (1) of this subsection is amended by 21 inserting "CONSTRUCTION," after "PLANNING,”. 22 233 (5) The heading of the section redesignated as section 23 136 by paragraph (1) of this subsection is amended by 24 inserting "CONSTRUCTION," after "PLANNING,", 11 1 (6) The section redesignated as section 135 (a) (1) 2 by paragraph (1) of this subsection is amended by striking 3 out", other than expenditures for construction,". 4 (7) Section 140 is amended by striking out so much 5 thereof as precedes subsection (b) (other than the section 6 heading), by striking out "(b)" and inserting in lieu thereof 7 "SEC. 138.", and by inserting "construction," after 8 "planning,". 9 (8) Section 142 (a) (2) (A) is amended by inserting 10 "which was used by the State in which the facility is located" 11 before "to assist in financing the construction of the facility". 12 (b) (1) Section 401 (h) (1) of the Mental Retardation 13 Facilities and Community Mental Health Centers Construc14 tion Act of 1963 is amended by striking out "part C of title 15 I or". 16 (2) Section 401 (h) (2) of such Act is amended by 17 striking out "(A) for any project under part C of title I 18 may not exceed 66 per centum of the costs of construction 19 of such project; and (B)". (3) Section 401 (h) (3) of such Act is amended by 21 striking out "under part C of title I or". 225 22 (4) Section 403 (a) of such Act is amended by striking 23 out "section 134 in the case of a facility for the mentally 24 retarded or persons with other developmental disabilities, 12 1 or" and by striking out "section 136 or" and "as the case 2 may be," from clause (2) thereof. 3 (5) Section 403 (b) of such Act is amended by striking 4 out "135 or". 5 (6) Section 404 of such Act is amended by striking 6 out "135 or" and "136 or" from the first sentence thereof. 7 (7) Section 405 of such Act is amended by inserting 8 or section 135” after section 403. 9 (8) Section 405 (1) of such Act is amended by strik10 ing out "135 or" from clause (A) thereof and by inserting 11 "(in the case of a community mental health center)” after 12 205 in such clause. 13 14 AMENDMENTS TO FEDERAL SHARE PROVISION SEC. 305. The section redesignated as section 135 (b) 15 by section 304 (a) (1) of this Act is amended to read as 16 follows: 17 "(b) The Federal share' with respect to any State for 18 purposes of this section shall be 70 per centum for the fiscal 19 year ending June 30, 1975; 60 per centum for the fiscal 20 year ending June 30, 1976; and 50 per centum for the fiscal year ending June 30, 1977." INCLUSION OF LAND ACQUISITION COSTS SEC. 306.
