205 1 ing the planning of research and the utilization of research 2 findings in their areas of competence and interest. 3 4 "Subchapter III-Conduct of Research "SEC. 1186. (a) The facility shall follow, and comply 5 with, the appended Statement on the Use of Human Sub6 jects for Research of the American Association on Mental 7 Deficiency, and with the statement of assurance on research 8 involving human subjects required by the United States De9 partment of Health, Education, and Welfare for projects 10 supported by that Agency. 11 66 "(b) Investigators and others directly involved in the 12 research shall 13 14 15 16 17 "(1) adhere to the ethical standards of their professions concerning the conduct of research; and "(2) have access to the record of informed consent. "Subchapter IV-Reporting Research Results "SEC. 1187. (a) The principal investigator of each re18 search project shall be responsible for communicating to the 19 staff of the facility the purpose, nature, outcome, and possible 20 22 21 practical or theoretical implications of the research. Copies of the reports resulting from research projects shall be main22 tained in the facility. 23 "(b) Where research findings are made public, care 24 shall be taken to assure the anonymity of individual residents 25 and parents. 206 1 "(c) Clearly defined mechanisms shall exist for inform 2 ing staff members of new research findings that have ap 3 plicability to the programs and administration of the facility. 4 There shall be evidence that currently applicable research 5 results are being implemented in the facility's programs. "Chapter 6.-SAFETY AND SANITATION 6 7 8 "Subchapter I-Safety "SEC. 1188. (a) The requirements of the Secretary 9 shall be met, with specific reference to the following 10 11 12 13 14 15 16 "(1) provision of adequate and alternate exits and exit doors; "(2) provision of exit ramps, with nonskid surface and slope not exceeding one foot in twelve; and "(3) provision in handrails on stairways. "(b) There shall be records that document strict compliance with the regulations of the state or local fire safety 17 authority that has primary jurisdiction over the facility— "(1) aisles and exits shall be free from all encum brances and floors shall be uncluttered; "(2) flammable materials shall be properly stored and safeguarded; "(3) attics and basements shall be kept orderly and free of rubbish; and "(4) there shall be records of periodic fire safety inspections and reports. 31-151 O 74 Pt. 1 - 23 207 1 " (c) There shall be a written staff organization plan and 2 detailed, written procedures, which are clearly communicated 3 to, and periodically reviewed with, staff, for meeting all 4 potential emergencies and disasters pertinent to the area, such · 5 as fire, severe weather, and missing persons. 20 21 222 "(1) The plans and procedures should include "(A) plans for the assignment of personnel to specific tasks and responsibilities; "(B) instructions relating to the use of alarm systems and signals; "(C) information concerning methods of fire containment; "(D) systems for notification of appropriate persons; "(E) information concerning the location of firefighting equipment; and "(F) specification of evacuation routes and procedures. "(2) the plans and procedures shall be posted at suitable locations through the facility. "(d) Evacuation drills shall be held at least quarterly, 22 for each shift of facility personnel and under varied condi 23 tions, in order to 24 25 "(1) insure that all personnel on all shifts are trained to perform assigned tasks; 1 2 3 4 5 6 7 8 9 10 11 12 13 14 208 "(2) insure that all personnel on all shifts are famil iar with the use of the firefighting equipment in the facility; "(3) evaluate the effectiveness of disaster plans and procedures; "(4) evacuation drills shall include actual evacuation of residents to safe areas during at least one drill each year, on each shift. There shall be special provisions for the evacuation of the physically handicapped, such as fire chutes and mattress loops with poles; and "(5) there shall be a written, filed report and evaluation of each evacuation drill. "(e) An active safety program shall be maintained by a multidisciplinary safety committee that investigates all 15 accidents and makes recommendations for prevention. Rec16 ords of the activities of the safety committee shall be kept. 17 There shall be adequate safety shields on the moving parts 18 of all dumb waiters, elevators, and other machinery, as pro19 vided for in applicable standards and codes. 20 "(f) All buildings and outdoor recreation facilities con21 structed after 1971 shall be accessible to, and usable by, the 22 nonambulatory and shall meet standards of the Secretary 23 for making buildings accessible to, and usable by, the physi24 cally handicapped- 25 "(1) all existing buildings and outdoor recreation 209 “(2) existing facilities shall provide 1 facilities shall be modified so as to conform to the above 2 standards by December 31, 1976; and 3 4 5 6 7 8 9 10 11 12 66 "(A) entrance ramps wide enough for wheelchairs, not exceeding a rise of one foot in twelve, with nonslip surfaces, and with rails on both sides; "(B) doorways and corridors wide enough for wheelchairs; and "(C) grab bars in toilet and bathing facilities. (g) Paint used in the facility shall be lead free. Old paint or plaster containing lead shall have been removed, or covered in such manner that it is not accessible to resi 13 dents. 14 15 16 17 18 19 20 "(h) Appropriate provisions shall be made for emergency auxiliary heat by means of alternate sources of electric power, alternate fuels, and/or standby equipment. "Subchapter II-Sanitation "SEC. 1189. (a) There shall be records that document strict compliance with the sanitation, health, and environ mental safety codes of the State or local authorities having 21 primary jurisdiction over the facility.
