(3) the federally funded community mental health centers have had a major impact on the improvement

of care by fostering coordination and cooperation between various agencies resulting in a decrease in overlapping services and more efficient utilization of available resources, bringing comprehensive community care to all in need within a specific geographic area regardless of ability to pay, and by developing a system of care which insures continuity of care for all patients.

(b) The Congress further declares that the obligation 11 for insuring the expansion of the community mental health 12 center concept in the United States and the provision of 13 comprehensive community care to all in need rests with the 14 Federal Government, and declares further that Federal funds 15 should continue to be made available for the purposes of 16 initiating new community mental health centers and new 17 services within existing centers, and for the monitoring of 18 the performance of all federally funded centers to insure 19 their responsiveness to community needs and national goals

20 relating to community mental health care.

AMENDMENTS TO THE COMMUNITY MENTAL HEALTH

CENTERS ACT

SEC. 3. (a) Section 201 of the Community Mental

24 Health Centers Act (42 U.S.C. 2681) is amended to read as 25 follows:

"SEC. 201. There are authorized to be appropriated

for grants for facilities of public and other nonprofit com3 munity mental health centers under this title $15,000,000 4 for the fiscal year ending June 30, 1973; $15,000,000 for 5 the fiscal year ending June 30, 1975; and $15,000,000 6 for the fiscal year ending June 30, 1976."

7 (b) (1) Section 202 (b) of such Act is amended by 8 striking in the first sentence the words "a project for the 9 construction of a community mental health center" and 10 inserting in lieu thereof "construction, acquisition, and reno11 vation of a community mental health center facility".

(2) The second sentence of such section is amended. 13 by striking the words "construction of the center" and 14 inserting in lieu thereof the words "the center facility". 15 (c) Section 204 (a) (4) of such Act is amended by 16 striking the words "construction of community mental health 17 centers" and inserting in lieu thereof the words "acquisition and renovation of community mental health center facilities”. 19 (d) Section 204 (a) (8) of such Act is amended by 20 striking the word "construction" and inserting in lieu thereof 21 "facility".

(e) Section 205 (a) of such Act is amended by striking the word "construction" and inserting in lieu thereof the

words "the acquisition or renovation of a community mental

health center facility".

1 (f) Section 205 (a) (4) of such Act is amended by

2 striking the words "construction of the".

3 (g) The third sentence of section 205 (a) is amended

4 by striking the words "of the cost of construction".

(h) Section 207 of such Act is amended to read as 6 follows:

"SEC. 207. No grant may be made under any provision 8 of the Public Health Service Act for any fiscal year for any 9 project described in this title unless the Secretary determines 10 that funds are not available under this title to make a grant 11 for such project."

12 (i) The title of part A of such Act is amended to read 13 "PART A-GRANTS FOR FACILITIES".

SEC. 4. (a) The heading for part B of the Community 15 Mental Health Centers Act is amended to read as follows:

16

"PART B-GRANTS FOR PORTION OF THE COSTS OF

17

OPERATION OF CENTERS".

(b) (1) Section 220 (a) of such Act is amended by 19 striking the words "compensation of professional and tech20 nical personnel for the initial operation" and by inserting 21 in lieu thereof the words "compensation for operational 22 costs for the operation of new community mental health 23 centers or of new services in community mental health 24 centers".

(2) Section 220 (a) of such Act is further amended.

1 by adding at the end thereof immediately before the period 2 the words "such as services for children and the elderly".

3 (3) Section 220 (b) of such Act is amended to read as 4 follows:.

5 "(b) (1) Grants under this section for costs for any 6 center may be made only for the period beginning with 7 the first day of the first month for which such a grant 8 is made and ending with the close of eight years after 9 such first day; and except as provided in paragraph (2), 10 such grants with respect to any center may not exceed 70 per centum of such costs for the first year after such 12 first day, 65 per centum of such costs for the second year 13 after such first day, 60 per centum of such costs for the 14 third year after such first day, 45 per centum of such 15 costs for the fourth year after such first day, 30 per centum of such costs for the fifth year after such first 17 day, 15 per centum of such costs for the sixth year after such first day, 15 per centum of such costs for the seventh 19 year after such first day, and 15 per centum of such costs 20 for the eighth year after such first day.

"(2) In the case of any center providing services for 22 persons in an area designated by the Secretary as an urban

23

or rural poverty area, grants under this section for such costs 24 may not exceed 90 per centum of such costs for the first year

25 after such first day, 90 per centum of such costs for the

1 second year after such first day, 90 per centum of such costs 2 for the third year after such first day, 75 per centum of such 3 costs for the fourth year after such first day, 60 per centum 4 of such costs for the fifth year after such first day, 50 per centum of such costs for the sixth year after such first day, 6 40 per centum of such costs for the seventh year after such 7 first day, and 30 per centum of such costs for the eighth year 8 after such first day.".

9 (e) Section 221 (a) of such Act is amended by(1) striking the word "and" at the end of para

(2) striking the period at the end of paragraph (5) and inserting in lieu thereof a semicolon; and

"(6) the services to be provided by the center are made available to any health maintenance organization serving residents within the catchment area for such center;

"(7) such center has made adequate arrangements to secure all available third party payments for its

services;

"(8) such center has established an evaluation program, either directly or by contract;

"(9) such center has a program whereby it screens,
