An Act to abolish the Punishment of Public Whipping on Female Offenders. [7th July 1817.] HEREAS the Punishment of Public Whipping of Female Offenders has been found inexpedient;' Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the paffing of this Act Judgment Judgment of fhall not be given and awarded against any Female or Females con- Public Whipping victed of any Offence that fuch Female Offender or Offenders do fhall not be fuffer the Punishment of being publicly whipped; any Law, Statute awarded on or Usage to the contrary notwithstanding.

II. And be it further enacted, That in all cafes where the Punifhment of Public Whipping on Female Offenders has hitherto formed the Whole or Part of the Judgment to be pronounced, it fhall and may be lawful for the Court before whom any fuch Offender fhall be tried, to pass fuch Sentence of Confinement to Hard Labour in the Common Gaol or House of Correction, in lieu of the Sentence of being publicly whipped, as to the faid Court shall feem most proper: Provided, that nothing herein contained fhall extend or be Provifo. conftrued to extend in any manner to change, alter or affect any Punishment what foever, which may now be by Law inflicted in refpect to any Offence, except only the Punishment of Public Whipping on Female Offenders, in manner as herein above is enacted.

An Act to amend an Act of the Fifty fourth Year of His present Majefty, to regulate the Payment of Drawback on Paper allowed to the Universities in Scotland.

[7th July 1817.] HEREAS by an Act made in the Fifty fourth Year of the 54 G. 3. C. X5 3. Reign of His present Majefty, intituled An Act to regulate the Payment of Drawback on Paper allowed to the Universities in Scotland, it is enacted, that no Allowance fhall be made for Paper used in the Printing of any Books in the Latin, Greek, Oriental or Northern Languages, within the faid Univerfities, unless the Chief Managers of the Prefs in fuch Universities fhall fubfcribe at the Foot of the Certificate mentioned in the faid A& an Oath in Writing, made before the Vice Chancellors of the fame, • that the Whole of the faid Edition of the Book fo printed is printed for the Use and Behoof of the Universities respectively for which the fame exprefs to be printed: And Whereas it is expedient that the faid Oath fhould be made in the Terms and before the Perfon or Perfons hereinafter mentioned:' Be it therefore enacted by The King's Moft Excellent Majesty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the paffing of this A&t fuch Oath to be mada Allowance as is by the faid recited A&t granted fhall be made for to certain Par57 GEO. the Drawback on Paper ufed in the printing fuch Books in the Latin, Greek, Oriental Paper allowed to or Northern Languages within the faid Univerfities, at any time the University from and after the Twenty eighth Day of July in the Year of our Lord One thousand eight hundred and fourteen, provided the Chief Manager or Managers of the Prefs in fuch Univerfities refpectively fhall fubfcribe at the Foot of fuch Certificate refpectively, as is in the faid Act mentioned, an Oath in Writing made before the Vice Chancellor, Principal or Rector, or by whatever other Name or Names the Principal of fuch Univerfities refpectively may be known or distinguished, that the Whole of the faid Edition of the Book fo printed was and is printed for the faid Univerfities refpectively for which the fame exprefs to be printed, and that no Bookfeller or Bookfellers or other Perfon or Perfons had or hath or have any Share or Intereft therein, or in the Drawback or Allowance payable on or in respect of the Paper on which the fame was and is printed, which Certificate to be Certificate fhall be produced to the Commiffioners of Excife or any Two of them, and without which the faid Commiffioners fhall not be and are not authorized to cause Payment to be made of fuch Drawback or Allowance of the Duties on the Paper fo ufed, or any Part thereof; and provided alfo, that all other the Conditions, Rules, Regulations, Restrictions and Provifions contained or referred to in the faid Act, be fully observed, performed and fulfilled.

An Act for extending the Provifions of an Act of the Fifty fourth Year of His prefent Majefty, for regulating the Payment of Army Prize Money; and for authorizing the Commiffioners of Chelsea Hofpital to fufpend the Pensions of such Persons as shall be guilty of Frauds in respect of Prize Money or Penfions. [7th July 1817.] W HEREAS an Act paffed in the Fifty fourth Year of the Reign of His prefent Majefty, intituled An Ad for regulating the Payment of Army Prize Money, and to provide for the Payment of unclaimed and forfeited Shares to Chelsea Hofpital: ‹ And Whereas Doubts may arife whether the faid Act, and the Provifions, Powers, Regulations, Pains and Penalties therein contained, are applicable and relate to Grants, Captures or Prizes 'made in any War or Hoftilities fubfequent to that which existed at the time when the faid recited Act was paffed: And Whereas it is expedient that the faid Doubts fhould be prevented or removed, and that the faid A&t fhould be explained, and the Provifions, Powers, Regulations, Pains and Penalties therein contained should be declared to extend to all Grants, Captures and Prizes made in any War or Hoftilities in which His Majefty has been engaged fince the paffing of the faid recited A&; Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Consent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the Provifions of re- fame, That all the Claufes, Enactments, Provifions, Rules, Regucited A&t appli- lations, Powers, Pains and Punishments, as well of Death as otherwife, and all Penalties, Forfeitures, matters and things in the said recited A&t contained, or thereby continued, and all Forms, matters and things in the Schedules to the faid recited Act fet forth and

contained, fhall be and the fame are hereby declared to be applicable, as well to all Grants, Captures and Prizes made during the War which was in Existence at the time when the faid A&t was paffed, as to all Grants, Captures and Prizes made in or in confequence of any War or Hoftilities in which His Majefty has been engaged fince the paffing of the faid recited Act, and that as fully and effectually to all Intents and Purpofes, as if the faid Claufes, Enactments, Provifions, Rules, Regulations, Powers, Pains, Punishments, Penalties, Forfeitures, matters, Forms and things were feverally repeated and reenacted in the Body of, and made Part of

this Act.

II. And Whereas no fufficient Provifion is made for punifhing Frauds relating to Penfions or Prize Money, and it is expedient that Power should be given to the Commiffioners of the Royal Hofpital for Soldiers at Chelsea, to take away or fufpend the Penfions of fuch Perfons as fhall be guilty of Frauds or other grofs

• Mifconduct;' Be it therefore enacted, That from and after the Commiffioners paffing of this Act, it fhall and may be lawful for the Commiffioners of Chelfea Hofof the faid Royal Hofpital at Chelsea, and they are hereby autho- pital may fufrized and empowered upon Complaint and Proof being made to them Fend or take of any Fraud, either with refpect to the Receipt of Prize Money or Pension, or any other Money in the Nature of Allowance or Bounty Money, or of other grofs Misconduct attempted or practifed by any Perfon being a Penfioner of the faid Royal Hofpital, to fufpend or entirely to take away the Penfion of the Perfon fo offending, and to iffue to the Paymaster of Out Penfions of the faid Royal Hofpital a Certificate, under the Hand of the faid Commiffioners or Three or more of them, of any Penfion being fo fufpended or taken away; and upon the faid Certificate being iffued to the faid Paymafter of Penfions, he fhall fufpend the Payment of the Penfion therein mentioned, according to the Tenor of the faid Certificate any thing in any other Act contained to the contrary thereof in anywife notwithstanding. III. And be it further enacted, That it fhall and may be lawful Regimental for the Secretary at War for the time being, upon Proof having been fatisfactorily made to him that there were any Regimental Debts due from any Non Commiffioned Officer or Soldier at the time of his Death, and fuch Non Commiffioned Officer and Soldier had Prize Money due to him at his Decease, to iffue to the Agent for the faid Prize Money, or if the fame fhall have been paid over to Chelsea Hofpital, then to the Treasurer of the faid Hofpital or his Deputy, a Certificate of the Amount of fuch Regimental Debts, together with a Requisition that the fame may be paid out of the Prize Money of fuch Non Commiffioned Officer or Soldier; and the faid Agent or Treasurer of Chelsea Hofpital respectively fhall thereupon reserve out of the said Prize Money and pay over to the Perfon named in fuch Requifition the Amount fo due from the faid Non Commiffioned Officer or Soldier, before any other Claims upon the faid Prize Money fhall be paid; and the Order of the faid Secretary at War and the Receipt of the Payee in fuch Requifition named fhall be the full and fufficient Vouchers and Difcharge to the said Agent or Treasurer of Chelfea Hofpital refpectively, for the Amount fo paid by virtue of and in compliance with the faid Requifition. IV. And be it enacted, That all Sums of Money due in refpect S 2

of any Military Clothing, Appointments or Equipments, or in refpect of any Quarters, or of any Mefs or Regimental Accounts, and all Sums of Money due to any Agent or Paymaster or Quartermaster, or any other Officer upon fuch Account as aforefaid, or on account of any Advances made for any fuch Purpose as aforesaid, shall be deemed and taken to be Regimental Debts for the Purposes of this Act.

V. And be it further enacted, That this Act may be amended, altered or repealed by any Act or Acts to be passed in this Seffion of Parliament.

CAP. LXXVIII.

An Act for fixing the Rates of Subfiftence to be paid to
Innkeepers and others on quartering Soldiers.

[7th July 1817.]

WHEREAS by Two Acts paffed in the prefent Seffion of

Parliament for punishing Mutiny and Defertion, and for the better Payment of the Army and their Quarters, it is enacted, that Officers and Soldiers fhall be furnished with Diet and Small Beer upon paying and allowing for the fame the several Rates that are or shall be established by any Act or Acts of Parliament; and an Option is given to Innholders, and others upon whom Officers and Soldiers are quartered and billetted, to furnish certain Articles gratis in lieu of Diet and Small Beer; and it is juft and expe'dient that an adequate Allowance shall be made and established for Provifion and other Articles furnished to Officers and Sol

• diers' May it therefore pleafe Your Majefty that it may be enacted; and be it enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this present Parliament affembled, and by the Authority of the fame, That every Non Commiffioned Officer and Private Soldier who fhall be furnished with Diet and Small Beer, within thofe Parts of the United Kingdom specified in the faid recited Acts, by the Innholders or other Perfons on whom fuch Non Commiffioned Officers or Private Soldiers fhall be quartered and billetted by virtue of the faid Acts, shall pay and allow for the fame the Sum of Ten pence per Diem until the Twenty fourth Day of July inclufive, and from and after that Day the Sum of One Shilling and Two pence per Diem; and that for fuch Allowances of Ten pence and One Shilling and Two pence the Innholder or other Perfon fhall furnish One Meal; videlicet, a hot Dinner, if required, in each Day to each Non Commiffioned Officer, Trumpeter, Drummer and Private Soldier quartered and billetted on him, to coufift of fuch Quantities of Diet and Small Beer as have been or shall be specified and fixed in and by any Regulations made or to be made from time to time by His Majesty in that Behalf, but not to exceed One Pound and a Quarter of Meat previous to being dressed, One Pound of Bread, One Pound of Potatoes or other Vegetables previous to being cooked, and Two Pints of Small Beer, and Vinegar, Salt and Pepper; and that the Accounts of the fame fhall be rendered, and Payment thereof made, in like manner as is directed by the faid Acts.

II. And be it further enacted, That in cafe any Innholders, or other

other Persons on whom any Non Commiffioned Officers or Private Further AllowMen fhall be quartered within the aforefaid Parts of the United ance of One Kingdom, fhall, by virtue of the faid Option in the faid Acts, fur- Halfpenny per nifh fuch Non Commiffioned Officers or Soldiers with the Articles therein mentioned in lieu of furnishing Diet and Small Beer, at the Rate prescribed by this Act, fuch Innholders or other Perfons on whom fuch Non Commiffioned Officers or Soldiers are quartered, and by whom the faid Articles fhall have been fo supplied, fhall receive in confideration thereof One Halfpenny per Diem for each Non Commiffioned Officer and Soldier; which Sum of One Halfpenny per Diem shall be accounted for and paid in like manner as is directed touching the Rate aforefaid.

III. And be it further enacted, That the Sum to be paid to the Innholder or other Perfon within the aforefaid Parts of the United Kingdom, on whom any of the Hories belonging to His Majefty's Forces fhall be quartered by virtue of the faid Acts, for Hay and Straw, fhall be Ten pence per Diem for each Horse until the Twenty fourth Day of July inclufive, and from and after that Day One Shilling per Diem.

IV. And be it further enacted, That all Non Commiffioned Officers and Soldiers fhall be entitled to receive their Diet and Small Beer from the Innholders or other Perfons on whom they may be billetted, within the aforefaid Parts of the United Kingdom, at the Rate hereinbefore prescribed while on the March, as also on and for the Day of their Arrival at the Place of their final Destination, and on the Two fubfequent Days, unless either of the Two subsequent Days fhall be a Market Day in and for the Town or Place where fuch Officers or Soldiers fhall be billetted, or within the Distance of Two Miles thereof; in which cafe it fhall be lawful for the Innholder or other Perfon as aforefaid to difcontinue on and from fuch Market Day the Supply of Diet and Small Beer, and to furnish in lieu thereof the Articles in the faid recited Act fpecified, and at the Rate hereinbefore prescribed.

V. Provided always, That if any Victualler or other Person liable by the faid recited Acts to have Soldiers billetted or quartered on him or her fhall pay any Sum or Sums of Money to any Non Commiffioned Officer or Soldier on the March, in lieu of furnishing in Kind the Diet and Small Beer to which fuch Non Commiffioned Officer or Soldier is entitled under the faid Acts, every fuch Victualler or other Perfon may be proceeded against and fined in like manner as if he or he had refused to furnish or allow, according to the Directions of the faid recited Acts, the feveral things respectively directed to be furnished to Non Commiffioned Officers or Soldiers fo quartered or billetted on him or her as aforefaid.

VI. Provided alfo, and be it further enacted, That if any Regiment, Troop, Company or Detachment, when on the March, shall be halted, either for a limited or indefinitive time, at any intermediate Place, the Non Commiffioned Officers and Soldiers belonging thereto fhall be entitled to receive their Diet and Small Beer from the Perfons on whom they fhall be billetted at fuch intermediate Place, for fuch time only for which they would be entitled to receive the fame after arriving at the Place of their final Destination, according to this A&.
