XXXVII. And be it further enacted, That this Act and every Commencement Clause and Provifion therein contained shall commence and have Effect of A&t. on and from the Twenty fifth Day of June One thoufand eight hundred and feventeen, and not fooner.

WHEREAS

CAP. LVII.

An Act to empower His Majefty to suspend Training, and to regulate the Quotas of the Militia. [30th June 1817.] HEREAS it is expedient that His Majefty fhould be empowered to fufpend the calling out the Militia for the Purpose of being trained and exercifed, and alfo to caufe the Quotas of the feveral Counties to be regulated;' Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Cominons, in this prefent Parliament affembled, and by the Authority of the fame, That it fhall be lawful for His Majefty, by any Order or Orders in Council, to fufpend the calling out of the Militia of the United Kingdom, or any Part of the United Kingdom, or of any County, Riding, Shire, Stewartry, City, Town or Place, for the Purpofe of being trained and exercised in any Year, and to order and direct that no training or exercifing of the Militia of the United Kingdom, or of any Part of the United Kingdom, or of any County or Counties, Riding or Ridings, Shire or Shires, Stewartry or Stewartries, City or Cities, Town or Towns or Place or Places, fpecified in any fuch Order or Orders in Council, fhall take place in any Year; any thing contained in any Act or Acts of Parliament relating to the Militia to the contrary notwithstanding.

II. And Whereas by an Act paffed in the Forty fecond Year 42 G. 3. c. 90. of the Reign of His prefent Majefty, intituled An Act for amending the Laws relating to the Militia in England, and for augmenting the Militia, the Quotas of the Militia of the feveral Counties, Ridings, Shires, Cities, Towns and Places in Great Britain were specified, and Provifions made for fettling and afcertaining other Quotas at Periods fpecified in the faid Act; but the Quotas fpecified in the faid A&t have fince remained and continued, but may require to be regulated before the Expiration of the next Period fpecified in the faid Act; and it is therefore expedient that His Majesty should be empowered to caufe the Quotas of the Militia to be regulated when the fame may become neceffary;' Be it therefore enacted, That it fhall be lawful for His Majefty to order and direct that the Quotas of the feveral and refpective Counties, Ridings, Shires, Cities, Towns and Places in Great Britain, fhall be ascertained, fettled, appointed and fixed by His Majefty's Privy Council, in the Manner fpecified in the faid Act, if His Majefty fhall deem it neceffary, before the Expiration of the next Period fixed

in the said A& for fettling and ascertaining fuch Quotas; and all fuch Quotas, when fo afcertained, fettled, appointed, and fixed in pursuance of any fuch Order of His Majefty, fhall be deemed to be Quotas afcertained, fettled and fixed under the Provifions of the faid A&t; and all fuch Proceedings fhall be had thereon, for the Purpose of giving Effect thereto, and apportioning the fame refpectively among the Hundreds, Rapes, Lathes, Wapentakes or other Divifions of each County, Riding, Shire, City, Town or Place, and the feveral Parishes, Tithings and Places therein refpectively, in like manner in any respect, and all Powers, Authorities, Regulations, Provifions, Claufes, Penalties and Forfeitures, contained in any A& or Acts relating to the Militia of Great Britain shall be used, applied and enforced for giving effect to fuch Quotas and Apportionments, and carrying the Laws relating to the Militia into Execution in relation thereto, in like manner in every respect, and as fully and effectually to all Intents and Purpofes, as if fuch Quotas had been ascertained, fettled and fixed at any Period specified in the faid recited A&; any thing contained in the faid recited A&t, or any other Act or As of Parliament relating to the Militia, to the contrary notwithstanding.

III. And Whereas Doubts have arifen whether Officers, Serjeants or other Perfons enlifting Men to ferve the United Company of Merchants of England trading to the East Indies, are fubject to the Penalties, Forfeitures and Proviñons contained in the said recited Act of the Forty fecond Year aforefaid, in relation to enlifting into His Majefty's other Forces Men enrolled or engaged • to serve in the Militia; and whether Militia men fo enlifting or Militia men offering themfelves to ferve for any other Parish or Place than the Parish or Place for which they are firft enrolled, are within the Provifions of the faid A&t contained in relation to offering to be enrolled in any other Regiment, Battalion or Company of Militia;' For Remedy whereof be it declared and enacted, That every Officer, Serjeant or Person who shall wilfully or know. ingly enlift any Man to ferve the United Company of Merchants of England trading to the East Indies, who at the time of fuch enlifting shall be enrolled or engaged to ferve in the Militia, fhall be and be deemed to be within the Provifions of the faid recited Act, and fhall be subject to the Penalties and Forfeitures therein contained for enlifting Militia men to serve in His Majefty's other Forces; and that every Militia man offering to enlift to ferve the United Company of Merchants of England trading to the East Indies, who fhall deny to the Officer, Serjeant or other Perfon recruiting Men for such Service, that he is at the time of fuch offering a Militia man, or who fhall offer himself to be enrolled and be enrolled as a Militia man for any other Parish or Place than the Parish or Place for which he shall be then enrolled and ferving, although in the fame Regiment, Battalion or Corps, fhall be fubject and liable to the Provifions in the said A& contained for the Punishment and fubfequent Service of Militia men offering to enlift in His Majesty's other Forces, or to be enrolled and ferve in any other Regiment, Battalion or Corps of Militia; any thing in the faid recited Act contained to the contrary notwithstanding.

IV. And Whereas by Two Acts paffed in the Forty fecond Year of His prefent Majesty's Reign, relating to the Militias of England and

and Scotland refpectively, the Number of Serjeants, Corporals and • Drummers to be appointed to the Militia, when not in actual Service, was fixed at the following Proportions; that is to fay, One Serjeant and One Corporal to every Thirty Private Men, and One • Drummer to every Company, with the Addition of One Drummer to each Flank Company of Regiments or Battalions confisting of more than Five Companies: And Whereas it is expedient that His Majefty fhould be empowered to diminish thofe Numbers ;' Be it

HEREAS by a Convention of Commerce between Great Convention beBritain and the United States of America, figned at London on the Third Day of July One thousand eight hundred and fifteen, in Article the Second it is provided amongst other Matters, that no higher or other Duties or Charges be impofed in either of the Two Countries on the Exportation of any Articles to His Britannic Majefty's Territories in Europe or to the United States respectively, than fuch as are payable on the Exportation of the like Articles to any other Foreign Country: And Whereas by an A& paffed in the Fifty fixth Year of His prefent Majefty's Reign, intituled An Act to carry into Effect a Convention of Commerce con'cluded between His Majesty and the United States of America, it is enacted, that upon the Exportation from the United Kingdom of any Goods, Wares or Merchandize, the Growth, Production or Manufacture of the faid United Kingdom, or any of His Majefty's Territories in Europe, direct to any of the Territories of the United States of America, in any Ship or Veffel built in the faid States or condemned as Prize there, and being owned by Subjects of the faid States, and whereof the Mafter and Three Fourths of the Mariners are alfo Subjects of the faid States, no higher or other Duties fhall be paid or payable than fuch as are charged or impofed upon fuch Goods, Wares or Merchandize when exported in a British built Ship or Veffel navigated and regiftered according to Law: And Whereas it is expedient that the faid • United States of America fhould be placed, with respect to the • Duties on Goods, Wares and Merchandize of the Produce of • Great Britain exported thither, on the fame Footing as when the fame are exported to any other Foreign Country whatever;' Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, 57 GEO. and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the Third Day of July One thousand eight hundred and fifteen the fame Duties fhall be paid or payable on the Exportation of all Goods, Wares and Merchandize of the Growth, Produce or Manufacture of Great Britain, exported direct from thence to any Port or Place within the Territories of the United States of America in British built Ships owned, registered and navigated according to Law, or in Ships built in the United States of America, or condemned as Prize there, and being owned by Subjects of the faid States, and whereof the Mafter and Three Fourths of the Mariners are alfo Subjects of the faid States, as are or shall be payable on the like Exportation to any other Foreign Country whatever.

II. And be it further enacted, That it fhall and may be lawful for the Commiffioners of His Majefty's Treafury of the United Kingdom of Great Britain and Ireland, or any Three or more of them, and they are hereby authorized and directed, in all cafes where a greater Duty has been charged and paid on the Exportation of any Goods, Wares or Merchandize of the Growth, Produce or Manufacture of Great Britain, to the United States in manner aforefaid, than has been paid on the Exportation to any other Foreign Country, to cause the fame to be repaid.

III. And be it further enacted, That this Act fhall continue in force fo long as the Convention between His Majesty and the United States of America fhall continue in force.

CAP. LIX.

An Act for letting to Farm the Poft Horse Duties, and for
better fecuring and facilitating the Recovery of the faid
Duties.

WHEREAS by an Act paffed in the Twenty feventh Year

of His prefent Majesty's Reign, intituled An Ad to enable the Lord High Treasurer, or Commiffioners of the Treafury for the time being, to let to Farm the Duties granted by an A& made in the Twenty fifth Year of His prefent Majefty's Reign on Horfes let to Hire for travelling Poft and by time, to fuch Perfons as fhould be willing to contra&t for the fame, the Commiffioners of the Treasury were empowered to let to Farm the feveral Duties on Horfes let • to Hire therein particularly fet forth and mentioned to have been 'granted by the said Act of the Twenty fifth Year of His Majesty's Reign, for any Term not exceeding Three Years, under certain Regulations and Restrictions expreffed and contained in the said Act of the Twenty feventh Year of His Majefty's Reign: And Whereas by an Act paffed in the Forty fourth Year of His Ma44 G. 3. c. 98. jefty's Reign, intituled An Ad to repeal the feveral Duties under § 1, 2. and Sch. the Commiffioners for managing the Duties upon ftamped Vellum, (B.) • Parchment and Paper, in Great Britain, and to grant new and • additional Duties in lieu thereof, the several Duties granted by the faid Act of the Twenty fifth Year of His Majefty's Reign on Horfes let to Hire as therein mentioned, and extended in certain • Cases by an A&t paffed in the Forty fecond Year of His Majefty's Reigu, for enlarging the time for which Horfes might be let to Hire without being fubject to any annual Duty, and other Pur

poses, were repealed; and in lieu thereof it was enacted, that from and after the Tenth Day of October One thousand eight hundred • and four, there should be raised, levied, collected and paid unto His Majefty, His Heirs and Succeffors, the feveral Duties following; (that is to fay,) For and in respect of every Horse, Mare or Gelding hired by the Mile or Stage, to be used in travelling in Great Britain, the Sum of One Penny Halfpenny for every Mile fuch Horfe, Mare or Gelding fhould be hired to travel; • and for and in respect of every Horfe, Mare or Gelding hired for a less Period of time than Twenty eight fucceffive Days, for drawing on any public Road any Coach or other Carriage ufed in travelling Poft or otherwise, if the Distance at the time of hiring fhould be ascertained, the Sum of One Penny Halfpenny for every Mile • fuch Horfe, Mare or Gelding should be hired to travel; and for and in respect of every Horfe, Mare or Gelding fo hired as laft ‹ above mentioned, in any cafe where the Distance should not at the time of hiring be ascertained, the Sum of One Shilling and Nine < pence for each Day for which fuch Horse, Mare or Gelding fhould be fo hired, with an Exception of Horfes, Mares and Geldings ufed in licensed Hackney Coaches, where the same should be employed to go no greater Diftance than Ten Miles from the City of London or Westminster, or the Suburbs thereof; which faid several 'Duties are now fecured, raised, levied and collected by and under the Provifions and Regulations of the faid Acts of the Twenty fifth and Forty fecond Years of His Majesty's Reign relating to the faid Duties fo repealed as aforefaid, and by and under the
