be conftrued to affect the fame;' Be it therefore enacted, That from and after the paffing of this Act, it fhall and may be lawful for His Majesty, by and with the Advice of His Privy Council, by any Order or Orders to be iffued from time to time, to give fuch Directions and make fuch Regulations touching the Trade and Commerce to and from the faid Islands, Colonies or Places, and the Territories and Dependencies thereof, as to His Majefty in Council fhall appear most expedient and falutary; any Thing contained in an A&t paffed in the Twelfth Year of the Reign of His Majefty King Charles the Second, intituled An Act for the encouraging and increafing of Shipping and Navigation, or in an Act paffed in the Seventh and Eighth Years of the Reign of His Majefty King William the Third, intituled An A&t for preventing Frauds and regulating Abuses in the Plantation Trade, or any other Act or Acts of Parliament now in force relating to His Majefty's Colonies and Plantations, or any other Act or Acts of Parliament, Law, Ufage or Custom to the contrary in anywife notwithstanding.

III. And be it further enacted, That if any Goods, Wares or Merchandize whatever shall be imported into or exported from any of the faid Islands, Colonies or Places, or the Territories and Dependencies thereof, or fhall be exported from any Part of His Majesty's Dominions to any of the faid Iflands, Colonies or Places, or the Territories and Dependencies thereof, or if any Goods, Wares or Merchandize fhall be fo imported or exported in any manner whatever contrary to any fuch Order or Orders of His Majefty in Council, the fame fhall be forfeited, together with the Ship or Veffel in which fuch Goods, Wares or Merchandize fhall respectively be imported or exported, with all her Guns, Ammunition, Furniture, Tackle and Apparel; and every fuch Forfeiture fhall and may be fued for, profecuted and recovered by fuch and the like Way, Means and Methods as any Forfeiture incurred by any Law refpecting the Revenue of Cuftoms may be fued for, profecuted and recovered in Places where refpectively the Offences fhall be committed; and the Produce thereof fhall be difpofed of, paid and applied in like manner in the faid Places refpectively; any Law, Custom or Usage to the Provifo for Eaft contrary in any wife notwithstanding: Provided always, that nothing India Company. herein contained fhall in any manner be conftrued to infringe the Rights, Privileges, and Advantages belonging to the United Company of Merchants of England trading to the East Indies as now by Law established.

An Act to empower His Majefty to fecure and detain such
Persons as His Majesty shall suspect are confpiring against
His Perfon and Government.
[4th March 1817.]
HEREAS a traiterous Confpiracy has been formed for the
Purpose of overthrowing by means of a general Infurrec-
tion, the established Government, Laws and Conftitution of this
Kingdom: And Whereas Designs and Practices of a treasonable
and highly dangerous Nature are now carrying on in the Metro-
polis, and in many other Parts of Great Britain: Therefore, for
the better Preservation of His Majefty's facred Perfon, and the fa-
cred Perfon of His Royal Hignefs The Prince Regent, and for fe-
curing the Peace and Laws and Liberties of this Kingdom, be it
enacted by The King's Moft Excellent Majefty, by and with the
Advice and Confent of the Lords Spiritual and Temporal, and
Commons, in this prefent Parliament affembled, and by the Autho-
rity of the fame, That all or any Perfon or Perfons that are or fhall
be in Prison within that Part of the United Kingdom, called Great
Britain, at or upon the Day on which this Act fhall receive His
Majefty's Royal Affent, or after, by Warrant of His faid Majefty's
Moft Honourable Privy Council, figned by Six of the faid Privy
Council, for High Treason, Sufpicion of High Treason, or Treafon-
able Practices, or by Warrant figned by any of His Majefty's Secre-
taries of State, for fuch Caufes as aforefaid, may be detained in fafe
Cuftody, without Bail or Mainprize, until the First Day of July
One thoufand eight hundred and feventeen; and that no Judge or
Justice of the Peace shall bail or try any fuch Perfon or Perfons fo
committed, without Order from His faid Majefty's Privy Council,
figned by Six of the faid Privy Council, until the First Day of July
One thousand eight hundred and feventeen; any Law or Statute
to the contrary notwithstanding.

And be it further enacted by the Authority aforefaid, That Act in Scotland the Act made in Scotland in the Year of our Lord One thousand of 1701, fo far feven hundred and one, intituled An Ad for preventing wrongous Imprisonment, and against undue Delays in Trials, in fo far as the fame may be conftrued to relate to the cafes of Treafon and Sufpicion of Treason, with refpect to Perfons fo committed as aforefaid, be fufpended until the First Day of July One thoufand eight hundred and feventeen; and that until the First Day of July One thoufand eight hundred and seventeen no Judge, Juftice of Peace or other Officer of the Law in Scotland, fhall liberate, try or admit to Bail any Perfon or Persons that is, are or shall be in Prifon within Scotland, under a Warrant or Warrants fo figned as aforefaid, for fuch Caufes as aforefaid, without Order from His faid Majefty's Privy Council, figned by Six of the faid Privy Council.

IV. V. Provided nevertheless, That any Person or Perfons in Prison at the time of paffing this Act, against whom any Bill or Bills of Indictment for High Treafon have been already found, shall and may be tried on the said Indictment as if this A&t had never passed.

• VI. And Whereas divers Perfons are now in Custody on Charges of High Treafon and Sufpicion of High Treafon, under Warrants from One of His Majefty's Principal Secretaries of State, or from His Majesty's Privy Council, and it may be highly important that 'fuch Perfons as have been or fhall be fecured and detained on fuch Charges under and by virtue of fuch Warrant or Warrants should be kept wholly feparate and apart from each other, fo as to prevent all Communication between them and with other Perfons, except • fuch Communication as His Majefty may think fit to permit, and < under fuch Reftrictions as may be advisable, and Doubts may arife how far the Powers of His Majefty's Principal Secretaries of State ( to change the Places of Confinement of Perfons fo committed extend; and it is expedient to provide that the fame fhall not be fo • exercised as to deprive the Perfons fo committed of any Right to be tried or discharged which they might refpectively have had if their respective Places of Confinement had not been changed:' Now, to obviate all Doubts and Difficulties in respect thereof, be it further enacted and declared, That it fhall be lawful for One of His Majefty's Principal Secretaries of State, as he fhall fee Occafion, to order any Perfon committed to any Gaol or other Prison on any Charge of High Treason, Sufpicion of High Treason, or Treafonable Practices, either before or after Indictment found, to be conveyed to and detained in any other Gaol or other Prison, until difcharged by due Courfe of Law, and to iffue all Warrants neceffary for fuch Purposes: Provided always nevertheless, that no Perfon who fhall be removed by any fuch Warrant as aforefaid, fhall be by means of fuch Removal deprived of fuch Right to be tried or difcharged, as fuch Person would by Law have been entitled to if not so removed; and in every cafe in which any fuch Perfon would have been entitled to have been tried or discharged if fuch Perfon had continued in the Gaol or Prifon to which fuch Perfon was before committed, it shall be lawful for such Perfon to apply to be bailed or discharged in the fame Manner as fuch Perfon might have done if fuch Perfon had remained in the Gaol or Prifon to which fuch Perfon was before committed as aforefaid.

VII. And be it further enacted, That this A&t fhall continue in force until the First Day of July One thousand eight hundred and feventeen.

VIII. And be it further enacted, That this Act may be altered, varied or repealed by any Act or Acts to be made in this present Seffion of Parliament.

An Act to extend the Privileges of the Trade of Malta to the
Port of Gibraltar.

WHEREAS it is expedient to extend to the Port of Gibraltar

all the Privileges which were granted to the Trade of Malta

by an Act paffed in the Fifty fifth Year of the Reign of His pre- 55 G. 3. c. 29. fent Majefty, intituled An Act to regulate the Trade between Malta and its Dependencies and His Majefty's Colonies and Plantations in America; and alfo between Malta and the United Kingdom;' Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the authority of the fame, That from and after the paffing of this Act the Trade between Gibraltar and His Majefty's Colonies and Plantations in America, and alfo between Gibraltar and the United Kingdom, fhall and may be carried on in like manner and under under recited the like Rules, Regulations, and Reftrictions, and subject to the Act. like Penalties and Forfeitures, as are provided by the faid recited Act with respect to Malta and His Majefty's Colonies and Plantations in America, and alfo between Malta and the United Kingdom, as if the fame were particularly and exprefsly repeated and re-enacted in the Body of this A&t; any Thing in any Act or A&ts to the contrary notwithstanding.

CAP. V.

An Act for continuing to His Majefty certain Duties on
Malt, Sugar, Tobacco and Snuff in Great Britain; and on
Penfions, Offices and Perfonal Eftates, in England; and for
receiving the Contributions of Perfons receiving Pensions and
holding Offices; for the Service of the Year One thousand
eight hundred and feventeen.

to the Sections that are here retained.]

· XXXVIII. And Whereas His Royal Highness The Prince Regent has been graciously pleased to direct certain Sums to be contributed and paid, from the Civil Lift Revenue, in aid of the Public Service of the Year One thousand eight hundred and seventeen: And Whereas many Perfons holding Offices and Places in His Majefty's Service, and others having or holding Penfions or ' other Emoluments derived from the Public, are defirous of contributing Proportions of their refpective Official Incomes, Salaries, • Penfions or other Emoluments, for the fame Purpose ;' Be it therefore enacted, That it shall be lawful for the Commiffioners of His Majefty's Treasury of the United Kingdom of Great Britain and Ireland, or any Three or more of them, or for the Lord High Treafurer of the United Kingdom of Great Britain and Ireland for the time being, to give fuch Directions, for One Year, commencing the Fifth Day of April One thousand eight hundred and feventeen, to the Officers of the Exchequer, and of the feveral Departments of the Civil Lift of Great Britain respectively, as may be neceffary for

XL. And Whereas by the faid A&t paffed in the Thirty eighth • Year of the Reign of His prefent Majefty, intituled An Act for making perpetual, fubject to Redemption and Purchase in the manner therein stated, the feveral Sums of Money now charged in Great Britain, as a Land Tax for One Year from the Twenty fifth Day of March One thousand seven hundred and ninety eight, it was enacted, that the feveral Duties impofed on Sugar by Three A&s of the • Twenty feventh, Thirty fourth, and Thirty feventh Years of the Reign of His prefent Majefty, on Malt, by an A& made in the Twenty seventh Year of the Reign of His prefent Majefty, and the • Duties of Excife on Tobacco and Snuff, by an Act made in the Twenty ninth year of the Reign of His present Majefty, should ⚫ continue in force until the Twenty fifth Day of March One thou• fand seven hundred and ninety-nine and no longer, but should from thenceforth cease and determine, unless the fame fhould be spe⚫cially continued by Parliament; which faid feveral Duties were by an Act made and paffed in the Thirty ninth Year of the Reign of His prefent Majefty, intituled An Act for continuing and granting to His Majesty a Duty on Penfions, Offices, and Perfonal Eftates, in England, Wales, and the Town of Berwick upon Tweed, and • certain Duties on Sugar, Malt, Tobacco and Snuff, for the Service of the Year One thousand seven hundred and ninety nine, further continued until the Twenty fifth Day of March One thoufand eight ‹ hundred; and which, by feveral fubfequent Acts, were further ⚫ continued until the Twenty fifth Day of March One thoufand eight hundred and eleven: And Whereas by an A&t passed in the Forty ninth Year of the Reign of His present Majefty, intituled • An Act for repealing the feveral Duties of Customs chargeable in Great Britain, and for granting other Duties in lieu thereof; and by one other Act made in the Fifty fourth Year of the Reign of His prefent Majefty, intituled An A&t to repeal the Duties of Cuftoms payable on Goods, Wares and Merchandize imported into Great • Britain from any Port or Place within the Limits of the Charter granted to the United Company of Merchants of England trading to the Eaft Indies, and to grant other Duties in lieu thereof; and to eftablish further Regulations for the better Security of the Revenue on • Goods fo imported; and to alter the Periods for making up and prefenting certain Accounts of the faid Company to Parliament; to continue in force until the Tenth Day of April One thousand eight hundred • and nineteen; the said feveral Duties on Sugar imported from the Eaft Indies were repealed, and other Duties granted on Sugar fo imported in lieu thereof: And Whereas by another Act, paffed in the Forty third Year of the Reign of His prefent Majefty, intituled • An Act to repeal the Duties of Excife payable in Great Britain, and to grant other Duties in lieu thereof, certain of the faid Duties on Licences to be taken out by Dealers in Tobacco and Snuff, and ⚫ certain Duties on Tobacco, were repealed, and other Duties granted in lieu thereof: And Whereas the faid Duties on Sugar, and the faid Duties on Malt, Tobacco and Snuff, together with the faid • Duties
