of Rents, and preventing Frauds by Tenants, it is amongst other things enacted, that from and after the Twenty fourth Day of June One thousand feven hundred and thirty eight, if any Tenant holding any Lands, Tenements or Hereditaments at a Rack Rent, ( or where the Rent referved fhould be full Three fourths of the Yearly Value of the demifed Premises, who fhould be in Arrear for One Year's Rent, fhould defert the demised Premises, and leave the fame uncultivated or unoccupied, so as no fufficient Diftrefs could be had to countervail the Arrears of Rent, it fhould and might be lawful to and for Two or more Justices of the Peace of the County, Riding, Divifion or Place (having no Interest in the demifed Premises), at the Requeft of the Leffor or Landlord, Leffors or Landlords, or his, her or their Bailiff or Receiver, to go upon and view the fame, and to affix or caufe to be affixed on the most notorious Part of the Premises Notice in Writing what Day (at the Distance of Fourteen Days at least) they would return to take a Second View thereof; and if upon fuch Second View the Tenant, or fome Perfon on his or her behalf, fhould not appear and pay the Rent in Arrear, or there fhould not be fufficient Diftress upon the Premises, then the faid Juftices might put the Landlord or Landlords, Leffor or Leffors, into the Poffeffion of the faid demifed Premifes; and the Leafe thereof to fuch Tenant, as to any Demife therein contained only, fhould from thenceforth become void: And Whereas it is expedient, for the due Protection of the Intereft of Landlords, that fo much of the faid Act as requires a Tenant to be in Arrear for One Year's Rent 'fhould be altered, and that the Provifions of the faid Act fhould be ' extended to Tenancies where no Right of Entry in cafe of Non • Payment is referved to the Landlord;' Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the Extended to Te- fame, That from and after the paffing of this A&t the Provifions, nants in Arrear Powers and Remedies by the faid recited Act given to Leffors and Landlords in cafe of any Tenant deferting the demifed Premises and leaving the fame uncultivated or unoccupied, fo as no fufficient Diftrefs can be had to countervail the Arrears of Rènt, fhall be extended to the cafe of Tenants holding any Lands, Tenements or Hereditaments at a Rack Rent, or where the Rent reserved fhall be full Three fourths of the Yearly Value of the demifed Premises, and who fhall be in Arrear for One Half Years' Rent, (inftead of for One Year as in the faid recited A&t is provided and enacted,) and who fhall hold fuch Lands and Tenements or Hereditaments under any Demise or Agreement either written or verbal, and although no Right or Power of Re-entry be referved or given to the Landlord in cafe of Non Payment of Rent, who fhall be in Arrear for One Half Year's Rent, instead of for One Year, as in the faid recited A& is provided and enacted.

An Act for the more effectual Punishment of Murders and
Manflaughters committed in Places not within His Majefty's
Dominions.
[27th June 1817.]
WHEREAS grievous Murders and Manflaughters have been

committed at the Settlement in the Bay of Honduras in • South America, the fame being a Settlement, for certain Purposes, in the Poffeffion and under the Protection of His Majefty, but not within the Territory and Dominion of His Majefty, by Perfons refiding and being within the faid Settlement; and the like Of• fences have also been committed in the South Pacific Ocean, as well on the High Seas as on Land, in the Islands of New Zealand and Otaheite, and in other Islands, Countries and Places not within His Majesty's Dominions, by the Mafters and Crews of British Ships, and other Perfons who have for the moft Part deferted from or left their Ships, and have continued to live and refide amongst the Inhabitants of those Islands; whereby great Violence has been done, and a general Scandal and Prejudice raised against the Name and Character of British and other European Traders: And Whereas • fuch Crimes and Offences do escape unpunished, by reafon of the Difficulty of bringing to Trial the Perfons guilty thereof:' For Remedy whereof be it enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That from and after the paffing Murders and of this Act all Murders and Manflaughters committed or that shall Manslaughters be committed on Land at the faid Settlement in the Bay of Honduras committed by any Perfon or Perfons refiding or being within the faid Settlement, and all Murders and Manflaughters committed or that shall be committed in the faid Islands of New Zealand and Otaheite, or within any other Iflands, Countries, or Places not within His Matried in any of jesty's Dominions, nor fubject to any European State or Power, nor His Majesty's within the Territory of the United States of America, by the Foreign PlantaMaster or Crew of any British Ship or Veffel, or any of them, or by tions, in fame any Perfon failing in or belonging thereto, or that fhall have failed manner as Ofin or belonged to and have quitted any British Ship or Veffel to fences commitlive in any of the said Islands, Countries, or Places, or either of them, ted on the High or that shall be there living, fhall and may be tried, adjudged and punished in any of His Majefty's Islands, Plantations, Colonies, Dominions, Forts or Factories, under or by virtue of The King's Comimiffion or Commiffions, which fhall have been or which fhall hereafter be iffued under and by virtue and in pursuance of the Powers and Authorities of an Act paffed in the Forty-fixth Year of His prefent 46 G. 3. c. 54. Majefty, intituled An Ad for the more speedy Trial of Offences committed in diftant Parts upon the Sea, in the fame manner as if fuch Offence or Offences had been committed on the High Seas.

II. Provided always, That nothing herein contained fhall repeal or affect, or be conftrued to repeal or affect, the Provifions of an Act made and paffed in the Thirty third Year of King Henry the Eighth, intituled An Act to proceed by Commiffion of Oyer and Terminer against fuch Perfons as fhall confefs Treafon, etc. without remanding the fame to be tried in the Shire where the Offence was committed.

An Act to enable the Commiffioners of His Majesty's Woods, Forefts and Land Revenues to make and maintain a Road from Millbank Row, Weftminster, to the Penitentiary. [27th June 1817.] THEREAS in purfuance and under the Authority of an Act of Parliament paffed in the Fifty fecond Year of the Reign of His present Majefty, intituled An Act for the Erection of a Penitentiary Houfe for the Confinement of Offenders convided within the City of London and County of Middlefex; and for. making Compenfation to Jeremy Bentham Efquire for the Non Performance of an Agreement between the faid Jeremy Bentham and the Lords Commiffioners of His Majefty's Treafury, respecting the Cuftody and Maintenance of Convicts, a Penitentiary for the Confinement and Employment of Male and Female Convicts has been • erected at Millbank, in the County of Middlefex, on Lands now • vested in His Majesty, His Heirs and Succeffors, by virtue of the • faid Act, for the Ufe of the Public and the Purposes of the said Act; and the fame is now completed and fit for the Reception of Part of the Perfons intended to be confined therein; but no Carriage Way has yet been fet out for paffing and repaffing between the faid Penitentiary and the City of Westminster And Whereas it is neceffary and expedient, for opening a Communication with the faid Penitentiary, that a free and public Carriage Way should be made and maintained from the South End of Millbank Row, in the Liberty of Westminster, over a Piece or Parcel of Land belonging to the Earl Grofvenor, and now in the Poffeffion of Thomas Sargent as Occupier thereof, and by him used as a Wharf, and to be continued along the Bank of the River Thames in the • Line of the old Foot Path, to the Lodge or Gate of the faid Penitentiary And Whereas the whole of the Land required for the Purpofe of making the faid intended Road, except the Piece or Parcel of Land which fo belongs to the Earl Grosvenor as ‹ aforefaid, being the Property of His Majefty in Right of His Crown, it is expedient that the Commiffioners for the time being of His Majefty's Woods, Forefts and Land Revenues fhould be <authorized and empowered to appropriate so much of the Land fo belonging to His Majefty in Right of His Crown as aforefaid, as fhall be requifite for that Purpose, to be used for the faid intended Road, and to make and maintain fuch intended Road, and to make Compensation to the faid Earl Grofvenor, and all Perfons lawfully claiming under him, for fuch Part of the faid Parcel of Land < belonging to him as shall be taken and required by virtue of this Act by and out of the Land Revenue of the Crown:' May it therefore please Your Majesty that it may be enacted; and be it enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the AuthoCommiffioners. rity of the fame, That the Commiffioners for the time being of His

Majefty's Woods, Forefts and Land Revenues fhall be and they are hereby appointed Commiffioners for carrying this A&t into Execution; and that it shall and may be lawful for fuch Commiffioners, Public Carriage by and with the Confent and Approbation of any Three or more Road to be made of the Commiffioners of His Majefty's Treafury of the United from the South Kingdom of Great Britain and Ireland for the time being, to be fignified by any Minute in Writing, or by Letter from any one of their Secretaries, in purfuance of such Minute, to fet out and make, and hereafter to maintain and keep in Repair an open, free and public Carriage Road, commencing from the South End of Millbank Row, in the Liberty of Westminster, through and over a Piece or Parcel of Ground belonging to the Earl Grofvenor, and now in the Poffeffion of Thomas Sargent as Occupier, and from thence to be continued over the Crown Lands along the Bank of the River to the Lodge or Gate of the Penitentiary lately erected under the faid recited Act; fuch Road to be a free and public Road, to be ufed by all His Majefty's Subjects on Foot or on Horseback, and for the Paffage of Carriages, Carts, Waggons and other Vehicles. II. And be it further enacted, That that Part of the faid intended Road which shall be made through and over the said Piece or Parcel of Land belonging to the faid Earl Grosvenor, fhall not exceed in Width Thirty Feet to be measured from a Line ranging with the Face of the Front Area of the laft or Southernmoft House in Millbank Row, and including in the faid Width of Thirty Feet the prefent Footway.

III. Provided, and it is hereby further enacted, That it fhall and may be lawful for the Commiffioners for carrying this Act into Execution, and they are hereby authorized and empowered, if they hall think it expedient fo to do, by and with the Confent of the faid Commiffioners of the Treasury for the time being, or any Three or more of them, to be fignified in manner aforefaid, to extend and continue the faid intended Road from the faid Lodge or Gate of the Penitentiary over the Crown Lands in a Southern Direction, until it shall meet the Branch or Road now forming leading towards the Penitentiary from and out of the High Road from Vauxhall Bridge to Pimlico, and fhall form a Junction therewith.

IV. And be it further enacted, That it fhall and may be lawful for the faid Commiffioners for the time being for carrying this A&t into Execution, and they are hereby authorized and empowered, by and with the Confent and Approbation of any Three or more of the faid Commiffioners of His Majefty's Treasury for the time being, to be fignified as aforefaid, from time to time to appropriate, lay out and expend fo much of the Money arifing from the Land Revenues of the Crown under their Management as may be neceffary for making and afterwards maintaining and keeping in Repair the faid intended Road, and for paying fuch Sums of Money as Compenfations to the faid Earl Grosvenor and Thomas Sargent, or any other Perfons having any Eftate, Right or Interest therein, for the Value of fuch Ground, and of their refpective Eftates or Interefts therein, and for any Injury or Damage they may refpectively fuftain by the making of fuch Road, as may be agreed upon and fettled between the faid Commiffioners and the faid Earl Grosvenor and other Perfons, or which may be awarded and afcertained by the Verdict of a Jury in manner hereinafter directed.

V. And be it further enacted, That it fhall and may be lawful for the faid Commiffioners for the time being for carrying this A&t into Execution, and they are hereby authorized, by and with fuch Confent and Approbation as aforefaid, to treat and agree with the faid Earl Grosvenor and Thomas Sargent, or any fuch other Perfon or Perfons as aforefaid, for the abfolute Purchase of the faid Piece or Parcel of Ground, of or belonging to him or them, hereby authorized to be taken for the Purposes of this A&t, and of all their refpective Estates and Interefts therein, and for the fettling what Compenfations fhall be paid or given to the faid Earl and Thomas Sargent, or fuch other Perfon or Perfons as aforesaid, either in Money or other Equivalent, for any Injury which may be fuftained by or occafioned to them by the making and maintaining of fuch intended Road; and if the faid Earl Grosvenor and Thomas Sargent, or any fuch other Perfon or Perfons having and proving an Intereft in the faid Ground and Premifes, fhall neglect or refufe to treat, or fhall not agree in the Premifes, or from any Cause fhall be prevented from treating with the faid Commiffioners for the time being, or with the Perfon or Perfons authorized by them to treat and agree on their Behalf, then and in fuch cafe the High Bailiff of the City and Liberty of Weftminster, or his Deputy, fhall, upon the Warrant of the faid Commiffioners for the time being for carrying this Act into Execution in manner hereinafter mentioned, and he is hereby authorized and required to caufe it to be enquired into and afcertained, upon the Oaths of a Jury of Twelve indifferent Men of the faid City or Liberty of Westminster, which Oaths the faid High Bailiff or his Deputy is hereby empowered to adminifter, what Damages will be fuftained by, and what Recompence and Satisfaction fhall be made to the faid Earl Grosvenor as Owner, and the faid Thomas Sargent as Occupier, or to any other Perfon or Perfons claiming or proving any Intereft therein as aforefaid, for the Value of fuch Piece or Parcel of Land to be taken and occupied for the Purposes of this Act, and of the proportionable Value of their refpective Interefts therein, and fhall affefs and award the Sum or Sums of Money to be paid to them respectively for the fame; and in order thereto the faid High Bailiff or his Deputy is hereby empowered and reWitneffes called quired from time to time, as Occafion fhall require, to fummon before Jury. and call before the faid Jury and examine upon Oath all and every Perfon and Perfons whomfoever who fhall be thought neceffary and proper to be examined as a Witnefs or Witneffes touching or concerning the Premifes, which Oath the faid High Bailiff or his Jury to view if Deputy is hereby empowered to adminifter; and the faid High Bailiff or his Deputy fhall order and cause the faid Jury to view the Place in queftion if there be Occafion, and to use all other Ways and Means, as well for their own as for the Jury's better Information in the Premifes, as fuch High Bailiff or his Deputy fhall think fit; and after the faid Jury fhall have enquired of and ascertained fuch Value, Damages and Compenfation, the faid High Bailiff or his Deputy fhall thereupon order the Sum or Sums of Earl Grofvenor Money fo affeffed by the faid Jury to be paid by the Commiffioners for the time being for carrying this Act into Execution to the faid Earl Grosvenor and Thomas Sargent, and to any other Perfon or Perfons to whom any fuch Compensation fhall or may be awarded
