be vested in the faid Comptroller, and that the faid Comptroller fhould be enabled to maintain and defend A&tions and Suits in relation to all Contracts made for the Service of the Barrack Department, or in any manner relating thereto;' Be it therefore enacted by The King's Moft Excellent Majefty, by and with the Advice and Confent of the Lords Spiritual and Temporal, and Commons, in this prefent Parliament affembled, and by the Authority of the fame, That immediately from and after the paffing of this Act all Meffuages, Lands, Tenements and Hereditaments which were by the faid Act vefted in the Commiffioners for the Affairs of Barracks for the time being, and also all Meffuages, Lands, Tenements and Hereditaments which have fince been purchased or taken or are in any manner now held by any Perfon or Persons whatever in Trust for or for the Ufe of His Majefty, His Heirs and Succeffors, for the Service of the Barrack Department, either in Fee or for any Lives, or any Term of Years of any other or leffer Intereft, and all Erections and Buildings which now are or which fhall be hereafter erected and built thereon, together with the Rights, Members, Eafements and Appurtenances to the fame respectively belonging, (other than and except fuch Meffuages, Lands, Tenements and Hereditaments as may be of Copyhold Tenure,) and from and after the Purchase and Conveyance, Grant or Demise thereof, all other Meffuages, Lands, Tenements and Hereditaments which fhall at any time or times hereafter be purchased by the Comptroller of the Barrack Department for the time being, or by any other Person or Perfons by his Order, for the Service of the Barrack Department, and all Erections and Buildings which now are or which fhall hereafter be erected and built thereon, with the Rights, Members, Easements and Appurtenances to the fame refpectively belonging, shall be and become, and remain and continue vefted in the Comptroller of the Barrack Department for the time being, and his Succeffor in the faid Office, according to the Nature and Quality and Eftate and Intereft of and in the fame Hereditaments and Premifes refpectively; and that upon the Death, Refignation or Removal of the prefent Comptroller, or of any future Comptroller or Comptrollers, all fuch Meffuages, Lands, Tenements and Hereditaments respectively (other than and except as aforefaid) fhall become vefted in. and be held by the fucceeding Comptroller, and fo in perpetual Succeffion according to the Nature and Quality and Eftate and Interest of and in the fame respectively, in Truft for His Majesty, His Heirs and Succeffors, for the Service of the Barrack Department, or for fuch other Public Service or Services as His Majefty, His Heirs and Succeffors, fhall from time to time be pleafed to dire&t: Provided always, that nothing herein contained fhall be conftrued to vest the faid Premifes upon other terms, with respect to former Proprietors, than those on which the fame are now vefted in the Perfon or Perfons holding the fame in Truft for His Majesty.

II. And be it further enacted, That it shall be lawful for the said Comptroller for the time being, with the Confent and Approbation of the Commiffioners of His Majefty's Treafury of the United Kingdom of Great Britain and Ireland, or any Three or more of them, (fuch Consent and Approbation to be certified by One of the Secretaries to the faid Commiffioners by Writing under his Hand,). to fell, or in any manner to difpofe of, or let or demife any of the Mef

III. And be it further enacted, That the Monies to arise and be produced by the Sale of any of the faid Meffuages, Lands, Tenements or Hereditaments which fhall be fold under the Provifions of this present Act, fhall be paid by the refpective Purchaser or Purchafers thereof into the Bank of England, and shall be there placed to the Account of the Comptroller of the Barrack Department for the time being, or to fuch other Account in the Bank of England as the faid Commiffioners of His Majefty's Treafury for the time being, or any Three or more of them, fhall direct; and the Receipt Receipt of any One of the Cashiers of the Bank of England for fuch Monies Cahier to be a fhall effectually discharge the Purchaser or Purchasers by whom or on whofe Account the fame fhall be fo paid into the Bank of England. IV. And be it further enacted, That it fhall be lawful for the Comptroller of the Barrack Department for the time being, and he is hereby authorized and empowered, to bring, profecute, maintain or defend any Action or Suit in refpect of or in relation to any Meffuages, Lands, Tenements or Hereditaments by this Act vefted in him as aforefaid, or of any Trefpafs committed thereon, or Damage or Injury done thereto, and alfo in refpect of or in relation to any Furniture, Stores or other Articles, Matters or Things, or any Goods or Chattels whatever belonging to the Barrack Department, or in the Cuftody or Charge of or ufed by any Officer of the Barrack Department or Perfon employed therein, and alfo for the Breach or Non Performance of any Contract or Agreement, or of any Covenant therein, or for any Matter or Thing in respect of or in relation to any Contract or Agreement made by any Perfon or Perfons whatever for the Service of the Barrack Department, or any other Matter or Thing relating to any of the Affairs under the Management or Control of the faid Comptroller; and in every fuch Action or Suit the faid Comptroller for the time being fhall be called The Comptroller of the Barrack Department," without naming him; and no fuch Suit or Proceeding commenced before the paffing of this A&t by the Commiffioners for the Affairs of Barracks fhall abate, but shall and may after the paffing thereof be carried on and proceeded in by or in the Name of the faid Comptroller,

V. And be it further enacted, That wherever any Accounts, or other Matters or Things relating to any Business or other Subjects or Tranfactions under the Management of the Comptroller of the Barrack Department, fhall be to be verified by any Oath or Affidavit of any Perfon or Perfons, it shall be lawful for the faid Comptroller of the Barrack Department, the Deputy Comptroller of the Barrack Department, or any Affiftant Infpector General of Barracks, or for any Juftice of the Peace or Magiftrate, to adminifter an Oath and take an Affidavit in that Behalf.

VI. And be it further enacted, That all Monies which shall at any time hereafter ftand or remain at the time of the Death or Refignation or quitting of Office of any Comptroller of the Barrack Department, in the Bank of England, in the Name of fuch Comptroller, fhall forthwith veft in the Comptroller for the time being; and from and after the Appointment of another Comptroller, all fuch Money shall forthwith veft in fuch Comptroller; and fo from time to time in Succeffion.

VII. And be it further enacted, That all Letters and Packets addreffed to the Comptroller of the Barrack Department refpectively for the time being, upon any Bufinefs or Affairs relating to the Duties of the Office of the faid Comptroller, fhall be free from the Duty of Postage; and also that all Letters and Packets sent by the Comptroller of the Barrack Department, or the Deputy Comptroller for the time being refpectively, upon any Business or Affairs relating to any of the Duties of the Barrack Department respectively, in manner and form hereinafter directed, fhall be fent free from the faid Duty of Postage; and all such Letters and Packets respectively fhall be under Cover, with the Words "Purfuant to A&t of Parliament," and "Barrack Office," printed upon the fame; and the Comptroller or his Deputy, or fome Perfon to be nominated from time to time for that purpose by fuch Comptroller, and whofe Appointment for that purpofe fhall be tranfmitted to the Poft Office, hall write his Name under the fame; and they and each of them are and is hereby ftrictly prohibited from enclosing or fending under fuch Covers any Writing, Paper, or Parcel whatever, excepting fuch as relate to the Duties of the faid Office.

VIII. And be it further enacted, That if any fuch Comptroller or Deputy or Clerk as aforefaid respectively shall prefume to fend or convey under any of the Covers aforefaid any Writing, Paper or Parcel other than thofe relating to the Duties of the Department, he fhall for every fuch Offence forfeit and pay the Sum of One hundred Pounds, to be recovered with full Cofts of Suit by any Perfon or Perfons by Action of Debt, Bill, Plaint or Information in any of His Majefty's Courts of Record at Westminster, wherein no Effoign, Privilege, Protection, Wager of Law or more than one Imparlance fhall be allowed; one Moiety of which Penalty fhall go to the Perfon who fhall fue for the fame, and the other Moiety thereof to and for the Ufe of His Majesty.

IX. And be it further enacted, That it fhall be lawful for all Bodies Politic or Corporate, Ecclefiaftical or Civil, and all Feoffees

or Trustees for charitable or other public Purpofes, and for all ment and for Tenants for Life and Tenants in Tail, and for the Hufbands, Sale of Lands, Guardians, Trustees, Committees, Curators or Attornies, or fuch of the Owners or Proprietors of or Perfons interested in any Lands or Hereditaments which have been taken or are now or which may hereafter be held by His Majefty, or by any Perfon in Truft for His Majefty, or in Truft for the Public Service, as fhall be Femes Covert, Infants, Lunatics, Idiots or Perfons beyond the Seas, or otherwife incapable of acting for themfelves, to contract and agree with fuch Comptroller or other Perfon or Perfons authorized by him, either for the abfolute Sale of any fuch Lands or Hereditaments, or for the Enfranchisement of any Copyhold, or Sale of any Reverfion after any Estate or Estates for Lives, or for the Grant of any Leafe, either for any Term of Years certain therein, or for fuch Period as the Exigency of the Public Service fhall require, and to convey, furrender, demife or grant the fame accordingly; and all Such Contracts, fuch Contracts, Sales, Conveyances, Enfranchifements, Surrenders, Leafes and Agreements fhall be valid and effectual in Law to all Intents and Purposes whatsoever.

X. And be it further enacted, That in every fuch case of Pur- Purchase Money chase of any Lands or Hereditaments, or of any fuch Reverfion as to be paid to aforefaid, or of the Enfranchisement of any Copyhold, or Purchase Deputy Reof any other Interest belonging to any fuch Body or other Perfon or Exchequer, for Perfons under any Difability or Incapacity, or not having the abfo- Owners of Lands, lute Intereft therein, the fame fhall be paid into the Hands or into the Name of the Deputy of the King's Remembrancer of His Majefty's Court of Exchequer at Westminster, Edinburgh, or Dublin respectively, for the time being, for the Ufe and Benefit of the Owners and Proprietors of fuch Lands and Hereditaments, who is hereby authorized and required to receive or accept and to give a Difcharge for the fame, and upon the Acceptation or Receipt thereof to fign a Certificate to the Barons or Judges of the faid Courts of Exchequer respectively under his Hand, purporting and fignifying that fuch Money or other Confideration was received or accepted by and paid to him in pursuance of this Act, for the Ufc and Benefit of fuch Owners or Proprietors who fhall be named and defcribed in fuch Certificate; and the faid Certificate shall be filed or depofited Copy of Certifi in the faid Court of Exchequer at Westminster, Edinburgh or Dublin cate figned by refpectively; and a true Copy thereof, figned by the Deputy Re- Deputy Remembrancer of fuch Court, fhall and may be read and allowed as Evidence. Evidence for the Purposes hereinafter mentioned; and the faid Deputy Remembrancer is hereby required, upon Receipt of any fuch Sum or Sums of Money as aforefaid, to pay the fame into the Bank of England, or Bank of Scotland or Royal Bank of Scotland, or Bank of Ireland, as the cafe may require; and immediately upon the filing or depositing of fuch Certificate the faid Lands or Hereditaments fhall be and become vested in the faid Comptroller or other Perfon for the Public Service, to the Ufe of His Majefty, His Heirs and Succeffors.

on behalf of any Perfon or Perfons interested in or entitled to the Benefit of the Money so paid to and received by the Deputy Remembrancer, or the Intereft or Produce thereof, and upon reading the Certificate directed to be figned by the faid Deputy Remembrancer concerning the fame as aforefaid, and receiving fuch further Satisfaction as they fhall think neceffary, to make and pronounce fuch Orders and Directions for paying the said Money or any Part of the fame, or for placing out fuch Part thereof as fhall be Principal in the Public Funds, or upon Government or Real Securities, and for Payment of the Dividends or Intereft thereof, or any Part thereof, to the respective Perfons entitled to receive the fame, or for laying out the Principal or any Part thereof in the Purchase of other Lands or Hereditaments, to be conveyed and fettled to, for and upon the fame Ufes, Trufts, Intents and Purposes as the faid Lands and Hereditaments fo taken ftood fettled at the time of the Payment of fuch Money as aforefaid, as near as the fame can be done, or otherwife concerning the difpofing of the faid Money or any Part thereof, and the Interest of the fame or any Part thereof, for the Benefit of the Perfon and Perfons entitled to and interested in the fame respectively, or for appointing any Perfon or Persons to be Trustee or Trustees for all or any of fuch Purposes, as the said Court shall think just and reasonable.

On Death, or XII. And be it further enacted, That upon the Death or Removal Removal of Deputy Rememfuch Deputy Remembrancer, all Stocks and Securities vested any brancer, Money in him by virtue of this Act fhall veft in the fucceeding Deputy Remembrancer, for the Purposes hereinbefore mentioned, without any Affignment or Transfer; and all Monies paid into the faid Banks refpectively in pursuance of this Act, or remaining in the Hands of any Deputy Remembrancer at his Death or Removal, and not vested in the Funds, or placed out on Securities as aforefaid, shall be paid over to the fucceeding Deputy Remembrancer for the time being.

XIII. And be it further enacted and declared, That if in any case the King's Remembrancer fhall execute the faid Office in Perfon, then and in such case the several Trufts, Powers and Authorities by this A&t vested in the faid Deputy Remembrancer and his Succeffors, fhall, during such time as no Deputy Remembrancer shall be · appointed, be vefted in and be executed by the faid King's Remembrancer for the time being.
