§ 515. Penalties.

(a) Any person who violates any of the provisions of this chapter shall be guilty of a felony, and, upon conviction thereof, shall be fined not more than $10,000 or imprisoned not more than five years, or both.

(b) Any person who willfully makes, aids, or assists in the making of, or procures, counsels, or advises in the preparation or presentation of, a false or fraudulent statement in any application made pursuant to this chapter shall be guilty of a misdemeanor, and, upon conviction thereof, shall be fined not more than $2,000 or imprisoned for not more than one year, or both. § 516. Burden of proof of exemptions; presumptions.

It shall not be necessary to negative any exemptions set forth in this chapter in any complaint,

information, indictment, or other writ or proceeding laid or brought under this chapter and the burden of proof of any such exemption shall be upon the person claiming its benefit. In the absence of proof by such person that he is the duly authorized holder of an appropriate license or quota issued under this chapter, he shall be presumed not to be the holder of such license or quota and the burden of proof shall be upon him to rebut such presumption. § 99. General duty to account for fees.

All fees, official or unofficial, received by any officer in the Consular Service for services rendered in connection with the duties of his office or as a consular officer, including fees for notarial services, and fees for taking depositions, executing commissions or letters rogatory, settling estates, receiving or paying out moneys, caring for or disposing of property, shall be accounted for and paid into the Treasury of the United States, and the sole and only compensation of such officers shall be by salaries fixed by law. AMENDMENTS

1946-Act Aug. 13, 1946, repealed clause providing "but this shall not apply to consular agents, who shall be paid one-half of the fees received in their offices, up to a maximum sum of one thousand dollars in any one year, the other half being accounted for and paid into the Treasury of the United States."
