Mr. Gilman has charged in his account nineteen dollars for stage fare, which is not properly or legally chargable against the State and to pay which, would be in controvention of the 26th Sec. of article four of the constitution.

The account of Joseph Atherton, one of the commissioners appointed in the Wisconsin Land District, has not yet been pre. sented.

The account of Phillip Aldrich, the commissioner appointed in the St. Croix District, cannot now be audited, as his reports to this department are not in such an authenticated form, as to show that he has rendered to the State any service.

As soon as these accounts are in a situation to be audited, they will be presented for your action.

I recommend that an appropriation be made for the account of the individuals as above stated.

The message and accompanying documents were referred to the committee on claims.

On motion of Mr. Kinney,

The Senate resolved itself into a committee of the whole on No. 11 (S.) A bill regulating the management of public property;

Mr. Norton in the chair.

After spending some time therein, the committee rose and by their chairman reported the bill back to Senate with sundry amendments.

And the question being on concurring in the said amend ments,

They were concurred in.

And the said bill No. 11 (S.) was ordered to be engrossed and read a third time.

The message of the Assembly was taken up,

And the following Resolution:

Resolved, (the Senate concurring,) That the Attorney, General be requested to give and furnish the President of the Senate for the purpose of being communicated to both branches of the Legislature, his opinion in writing, as to the authority of the Legislature passing an act at its present session, providing for the creation, organization and establishment of a separate Supreme Court, under the Constitution of the State;

Was considered and concurred in.

No. 1 (A.) A bill to organize the Kilbourn road district,
Was read a first and second times, and

On motion of Mr. Kinney,

Said bill was referred to the committee on roads and bridges. No. 4 (A.) A bill to establish a state road through part of the county of St. Croix, the county of Chippewa, and part of the county of Crawford.

Was read a first and second times.

No. 5, (A.) A Bill to provide for the custody of persons committed under the authority of the United States,

Was read a first and second times, and

On motion of Mr. Kinney,

Was reterred to the committee on State Affairs.

No. 8, (A.) A Bill to change the name of Archibald Heffle. finger to Archibald Coe, and the names of his three minor children, George, John and Emeline Hefflefinger, to George, John and Emeline Coe.

Was read a first and second times.

No. 9, (A.) A bill to change the name of Nils Cornelius Gulbrandsen to Nils Cornelius Bronson;

Which was read a first and second times.

Mr. Kinney moved to suspend rules in relation to Bill No. 12, Senate file, and that Senate now go into Committee of the whole on said Bill;

Which was agreed to; and

The Senate resolved itself into a committee of the whole on No. 12, (S.) A bill to provide for paying Nathaniel F. Hyer for his services as commissioner to locate the University Lands;

Mr. Smith in the chair.

After some time spent therein the committee rose and by their chairman reported back the Bill to the Senate,

Without amendment; and

Said Bill, No. 12, (S.) was ordered to be engrossed and read a third time.

On motion of Mr. Cothren,

Senate adjourned until 3 o'clock this afternoon.

Mr. Fisher from the committee on engrossed bills reported as correctly engrossed.

A message from the Assembly by their chief clerk:

Mr. President:—

I am directed to inform you that the Assembly have passed the following bills, to wit.

No. 3 (A.) A bill to organize a school district therein nam. ed, and

No. 10 (A.) A bil! amendatory to an act to provide for the division of the several counties under the county system of gov. ernment into towns;

In which the concurrence of the Senate is requested.

Mr. Kinney from the committee on claims, made the follow. ing

REPORT:

The committee to whom was referred bill No. 9 (S.,) a bill to appropriate to the county of Crawford the sums therein named, beg leave to report, that they have had the same under consideration, together with the evidences of the States' indebt

edness to said county, and so far as your committee are able to ascertain, said scrip and auditors warrants have not heretofore been allowed. Your committee would therefore report the bill to the Senate and recommend its passage.

Mr. Kinney from the same committee to whom was referred the account of George E. Graves for support of State prisoners, reported

No. 13, (S.) A bill to pay George E. Graves the several sums therein named ;

Which was read a first and second times.

Mr. Kinney offered the following resolution:

Whereas, C. S. Chase, Esq., has been disappointed in procuring the use of the Assembly Hall for the purpose of lecturing this evening; therefore

Resolved, That the use of the Senate Chamber be and is hereby tendered to that gentleman for that purpose;

Which was adopted.

And the ayes and noes being called for,

Those who voted in the affirmative, were

Messrs. Botkin, Chase, Cothren, Goodell, Kinney, Merrell, Norton, Sholes and Sprague-9.

Those who voted in the negative, were

Which was not agreed to.

Mr. Norton moved to reconsider the vote by which the reso.

lution granting the use of the Chamber to Mr. Chase,

Was adopted.

Mr. Cothren moved a call of the House;

And the roll being called, Messrs.,Gardner, Horn and Lakin were reported absent.

On motion of Mr. Smith, Mr. Gardner was excused.

Mr. Botkin moved to suspend all further proceedings on the call of the House,

Which was agreed to.

Mr. Norton withdrew the motion to reconsider the vote just taken.

Mr. Cothren moved that Senate adjourn,
