Plan and location submitted by the company October 12, 1889, not being in conformity with the provisions of the act of October 12, 1888, were not approved. Plans and locations submitted February 7, 1880, and January 24, 1891, were reported upon adversely by the Missouri River Commission, and were not approved. August 20, 1891, Captain Symons reported the completion of the bridge in practical conformity with the approved plans.

27. Bridge of St. Clair, Madison and St. Louis Belt Railroad Company across Mississippi River at Alton, Illinois.-Act approved August 29, 1890.

Plan and location submitted by the company April 8, 1891; approved by the Assistant Secretary of War August 1, 1891, on condition that the opening on each side of pier VII should not be closed until a good channel should be established through the draw and rendered permanent by the action of the Government dike now under construction, the company agreeing to maintain the channel from the lower end of the dike through the draw; copy sent to Maj. A. M. Miller, Corps of Engineers, August 5, 1891.

28. Temporary and permanent bridges of Chicago and North-Western Railway Company across North Branch of Chicago River near Kinzie Street, Chicago, Illinois.-Section 7 of the river and harbor act approved September 19, 1890, and ordinance of the Common Council of the city of Chicago.

Bridge of Chicago and North Michigan Railroad Company across Pine Lake near Charlevoix, Michigan.-Section 7 of the river and harbor act approved September 19, 1890, laws of the State of Michigan, and assent of Board of Supervisors of Charlevoix County, Michigan, to the construction of the proposed bridge.

31. Bridge of commissioners of public parks of the city of New York

across Harlem River at 155th street and McComb Dam Road, New York City, to replace the McComb Dam Bridge.-Section 7 of the river and har bor act approved September 19, 1890, and act of the legislature of the State of New York.

BRIDGE OF NORTH RIVER BRIDGE COMPANY ACROSS HUDSON RIVER AT NEW YORK CITY.

Under the provisions of act of Congress approved July 11, 1890, the North River Bridge Company, on December 1, 1890, -submitted plan and location for proposed bridge across Hudson River at New York City. The plans were, December 4, 1890, referred to The Board of Engineers for examination and report. Their report, dated April 23, 1891, with the views and recommendations of this office, and the action of the War Department indorsed thereon, is submitted as Appendix B B B 1.

BRIDGES OBSTRUCTING NAVIGATION.

Under the requirements of sections 9 and 10 of the river and har bor act of August 11, 1888, the Secretary of War notified the corporations owning or controlling certain bridges obstructing navigation to so alter the same as to render navigation through or under them free, easy, and unobstructed, and prescribed in each case a reasonable time when such alteration is to be made, as follows:

Notice dated

1. Bridge across the Ashley River, South Carolina. August 27, 1890, was served on the president of the New Bridge Company of South Carolina, September 8, 1890, prescribing July 1, 1891, as the time when the required alteration is to be made and completed. The officer in charge of the engineer district in which the bridge is located has reported the alterations made and completed.

2. Bridge across the Swinomish Slough, Washington.-Notice dated September 17, 1890, served on the president and on the general manager of the Seattle and Northern Railroad Company at Seattle, Wash., October 17, 1890. Alteration to be made and completed on or before January 1, 1891. Time informally extended to April 1, 1891. The of ficer in charge of the engineer district in which the bridge is located has reported that the work will probably be completed by October 9, 1891.

The river and harbor act approved September 19, 1890, provides as follows:

SEC. 4. That section nine of the river and harbor act of August eleventh, eighteen hundred and eighty-eight, be amended and reënacted so as to read as follows:

That whenever the Secretary of War shall have good reason to believe that any railroad or other bridge now constructed, or which may hereafter be constructed over any of the navigable water-ways of the United States is an unreasonable obstruction to the free navigation of such waters on account of insufficient height, width of span, or otherwise, or where there is difficulty in passing the draw-opening or the draw-span of such bridge by rafts, steam boats, or other water-craft, it shall be the duty of the said Secretary, first giving the parties reasonable opportunity to be heard, to give notice to the persons or corporations owning or controlling such bridge so to alter the same as to render navigation through or under it reasonably free, easy, and unobstructed; and in giving such notice he shall specify the changes required to be made, and shall prescribe in each case a reasonable time in which to make them. If at the end of such time the alteration has not been made, the Secretary of Way shall forthwith notify the United States district attorney for the district in wach such

bridge is situated, to the end that the criminal proceedings mentioned in the succeeding section may be taken.

SEC. 5. That section ten of the river and harbor act of Angust eleventh, eighteen bundred and eighty-eight, be amended and reënacted so as to read as follows:

That if the persons, corporation, or association owning or controlling any railroad or other bridge shall, after receiving notice to that effect as hereinbefore required from the Secretary of War and within the time prescribed by him, willfully fail or refuse to remove the same, or to comply with the lawful order of the Secretary of War in the premises such persons, corporation or association shall be deemed guilty of a misdemeanor and, on conviction thereof, shall be punished by a fine not exceed ing five thousand dollars, and every month such persons, corporation, or association shall remain in default in respect to the removal or alteration of such bridge shall be deemed a new offense, and subject the persons, corporation, or association so offending to the penalties above prescribed.

In obedience to the above requirements, the Secretary of War notified the persons, corporations, or associations owning or controlling certain bridges, after giving them a reasonable opportunity to be heard, to so alter said bridges as to render navigation through or under them reasonably free, easy, and unobstructed, specifying in the notice the changes required to be made, and prescribing a reasonable time in which to make them, as follows:

1. Bridge across Green River (below Lock No. 1) at Spottsville, Ken tucky.-Notice dated October 27, 1890, was served on the president of the Louisville, St. Louis, and Texas Railroad Company at New York City, November 3, 1890. Alteration required: Widening the west draw opening to 160 feet and placing the west pier 52 feet to the west of its present position. Alteration to be made and completed on or before July 31, 1891. Time extended to (ctober 31, 1891.

2. Bridge across the Muskingum River between Marietta and Harmar, Ohio.-Notice dated January 22, 1891, served on the vice-president of the Baltimore and Ohio South western Railroad Company at Cincinnati, Ohio, January 24, 1891. Alteration required: The insertion of a draw span in the northeastern end of the bridge opposite the outlet of the ice-harbor lock, with a clear width of opening adjacent to the abutment of 80 feet, as shown on map attached to notice. Alteration to be made and completed on or before October 31, 1891. Time extended to January 1, 1892.

3. Bridge across the Muskingum River between Taylorsville and Duncan Falls, Ohio.-Notice dated February 25, 1891, served on the commissioners of Muskingum County, Ohio, at Zanesville, March 3, 1891. Alteration required: The construction of a draw span below Lock No. 9 in accordance with the plan shown on the map accompanying the notice. Alteration to be made and completed on or before September 30, 1891.

4. Bridge across the canal of the Muskingum River at foot of Main street, Zanesville, Ohio.-Notice dated February 25, 1891, served on the commissioners of Muskingum County, Zanesville, Ohio, March 3, 1891. Alteration required: The center of the pivot pier to be 29 feet east of its present position, the minimum length of the longer arm of the draw span to be 69 feet, and the western shore of the canal to be extended so as to reach the end of the draw when closed, said alterations being shown upon the map attached to the notice, and permitting of the outlines of the canal being made to conform to the curves marked on said map. Alteration to be made and completed on or before December 1, 1891. April 9, 1891, the Secretary of War extended the time to December 1, 1892, to be then further extended or abandoned if Government work of constructing Lock and Dam No. 11 be not commenced.

5. Bridge across the Bayou Plaquemine, Louisiana.-Notice dated

March 3, 1891, served on the president of Texas and Pacific Railway Company at New York City, May 4, 1891. Alteration required: Modification of the bridge by the insertion of a draw span having a clear opening of 75 feet in width, the pivot pier of the draw to be located on the northern margin of the channel. Alteration to be made and completed on or before April 15, 1892.

6. Bridge across the channel leading to Back Cove, Portland Harbor, Maine.-Notice dated March 20, 1891, was served on the agent at Portland, Me., of the Grand Trunk Railway Company of Canada, March 24, 1891. Alteration required: Modification of the draw span so as to afford a clear width of opening of 75 feet; modification of the east and west ends of the draw pier, and construction of approaches to the draw in the nature of guard pier, dolphins, etc., all as shown on map attached to the notice. Alteration to be made and completed on or before January 1, 1892.

7. Bridge across the Savannah River below Augusta, Georgia.-Notice, dated March 20, 1891, served on the president of the Port Royal and Augusta Railway Company, at Savannah, Ga., March 23, 1891. Alteration required: (1) A method of locking the draw span in place when open. (2) Groups of fender piling or a rest pier for the open draw, to prevent steamboats by high winds or cross currents being drifted against the open bridge or the piers. Alteration to be made and com pleted on or before November 1, 1891.

8. Bridge across the Tennessee River at Florence, Alabama.-Notice, dated April 22, 1891, served on the president of the East Tennessee, Virginia and Georgia Railway Company, at New York City, April 25, 1891. Alteration required: (1) Removing the old pier in the North Channel of the draw, the removal to be complete to the bottom of the river, including all surrounding crib work or riprap. (2) Removing completely the two piers from the South Channel. (3) Removing the southeast corner of north abutment 7 feet back and 7 feet on face, as shown on drawing attached to the notice. Alteration to be made and completed on or before September 1, 1891. Alteration has been made and completed.

9. Bridge across the Little Tennessee River near Nile's Ferry, Tennessee.-Notice, dated May 20, 1891, served on the receiver of the Marietta and North Georgia Railway Company, at Marietta, Ga., May 27, 1891. Alteration required: Raising one span of the bridge 23 feet above its present height; forming one navigation span with a clear height of 56 feet above low water and with a clear width between piers of 130 feet, as, shown on the map attached to the notice. Alteration to be made and completed on or before January 1, 1892. 10. Bridge across Spuyten Duyvil Creek, New York.-Notice, dated June 9, 1891, served on the general manager (in the absence of the president) of the New York Central and Hudson River Railroad Company, at New York City, June 13, 1891. Alteration required (mutually agreed upon by the parties in interest as a temporary measure to meet the necessities of the existing navigation): Enlargement of the draw opening so as to afford a clear opening of not less than 50 feet in width, as shown on plan attached to notice; a new line of piles to act as a guide through the draw opening, and the maneuvering of the draw by a steam motor. Alteration to be made on or before December 1, 1891.

11. Bridge across Trout Creek, Florida.-Notice, dated July 2, 1891, served on the general manager of the Florida Central and Peninsular Railroad Company, at Jacksonville, Fla., July 7, 1891. Alteration re
