Act of congress of March 4, 1913, designed to regulate the taking and killing of migratory and insectivorous birds is unconstitutional. The power to regulate the capturing of wild game was not conferred by the federal constitution on congress: hence that power still resides in the states. (Me.) State v. Sawyer, 94 A 886

Federal game law, generally known as the migratory bird law, has been declared unconstitutional by judges of U. S. district courts in Arkansas and Kansas; held that congress has no jurisdiction under the interstate commerce clause over game in any of the states. It is announced that the government will appeal from the decision (Press rept, Mr 24 '15) Fund of $10,000 is being raised by the Nat. assn. of Audubon societies to "bring back the birds."
