States which have an approved State plan, and which expend an amount equal to that used from the Federal allotment for the training of individuals as highly skilled technicians.

b. Funds paid to the States may be used for the following activities:

(1) The maintenance of adequate programs of administration, supervision, and teacher training.

(2) The payment of salaries and necessary travel expenses of State or local school personnel.

(3) The payment of travel expenses of advisory committees or State boards.

(4) The purchase, rental, maintenance, and repair of instructional equipment.

(5) Purchase of instructional supplies and teaching aids.

(6) Providing for the necessary costs of transportation of students.

(7) The securing of necessary educational information and data as a basis for the proper development of area vocational education and guidance.

(8) Providing for training and work experience programs for out-of-school youths.

(9) Providing for related instruction for apprentices.

(10) Determining the need for area vocational education programs, and planning and developing such

programs.

c. Equipment and teaching aids that are purchased with the appropriated funds are to become the property of the States.

3. Definitions descriptive of the scope of the program: a. The term "State" includes the Virgin Islands, Puerto Rico, the District of Columbia, and Guam.

b. The term "area vocational education program" means a program consisting of one or more, less than college grade courses conducted under public supervision and control, and on an organized, systematic class basis. The program must be designed to prepare either junior high school graduates or individuals over sixteen years of age for useful employment as technicians or skilled workers in recognized occupations that require scientific or technical knowledge. The program must be available to residents of the State or an area of the State, designated and approved by the State board.

4. Amount and apportionment of the matching grants: a. A total appropriation of $15 million is authorized for each fiscal year from 1959 to 1964. The yearly allotment to each State is to be apportioned among the States in the proportion that the sum received under the GeorgeBarden Act, as amended, bears to the total amount appropriated under that Act for the year concerned.

b. When a State does not utilize its full allotment, Sec. that amount in excess of its requirements is to be periodi- 15bbb (b) cally made to other States in proportion to their original allotments.

c. The law authorizes an annual appropriation to the 15fff Department of Health, Education, and Welfare in the amount necessary to administer the program.

a. For each dollar of Federal funds expended under 15ccc (a) (1) this Act, an equal amount must be spent by the States. b. Federal funds granted under this Act used to match grants obtained under the Smith-Hughes or George-Barden Acts; but State or local funds raised under those Acts, but in excess of their requirements, may be used to match the Federal appropriations under this Act.

c. The funds shall be used exclusively for the train- 15ccc (a) (3) ing and preparation of individuals for work of a highly skilled nature that requires scientific knowledge. Such work must be in fields necessary for the national defense.

d. To be eligible to participate in the program a 15eee (a) State must amend the State plan formulated under the provisions of the Smith-Hughes Act, by adding the following:

(1) The State board must be designated as the sole agency for administration or supervision of this pro

gram.
(2) Minimum qualifications must be established
for teachers, teacher trainers, supervisors, directors, and
others having responsibilities under the plan.

(3) There must be shown the plans, policies, and methods to be followed in carrying out this part of the State plan.

(4) It must provide for accounting, budgeting, and other fiscal methods and procedures to the extent necessary for the proper and efficient administration of the plan.

(5) The State board is to be required to make reports to the Commissioner of Education containing such information as the Commissioner finds necessary to perform his functions.

e. The Commissioner of Education may diminish or 15eee (c) stop payment to the States when the State plan has been improperly changed, or where there has been a failure to comply with the plan in the program's administration. 6. Administration of the program:

a. The Commissioner of Education of the Department of Health, Education, and Welfare is charged with the administration of the Federal aspect of the program. b. The training program in the States is to be administered or supervised by the State board which was

established under the requirement of the Smith-Hughes Act.

c. An estimation of the amount due each State is to be prepared by the Commissioner of Education each calendar quarter, or other period prescribed by him. The amount determined will be paid to the States in installments and may be adjusted from period to period to compensate for prior payments that were greater or less than the amount due the State.

d. Reasonable notice and opportunity for hearing shall be provided by the Commissioner of Education before he diminishes or stops payment of funds to the States for failure to comply with the requirement of the Act. When the State is dissatisfied with the results of the Commissioner's hearing, it may appeal to a United States court of appeals, whose determination, in turn, will be subject to review by the Supreme Court.
