1 other Federal departments and agencies, including the Na2 tional Endowment for the Arts, and employ maximum par3 ticipation of private industry in the development of standards 4 and systems of signs developed for those purposes. 5 "(2) For purposes of this subsection, signs providing 6 directional information about facilities providing goods and 7 services in the interest of the traveling public are defined to 8 be those giving directional information about gas and auto9 motive services, food, lodging, campgrounds, truckstops, re10 sorts, recreational areas, tourist attractions, historic sites, and 11 such other facilities as a State, with the approval of the Sec12 retary, may deem appropriate.

"(3) Among other things the Secretary shall encourage 14 States to adopt programs to assure that removal of signs pro15 viding necessary directional information, which also were 16 providing directional information on June 1, 1972, about 17 facilities in the interest of the traveling public, be deferred 18 until all other nonconforming signs are removed.

19 "(4) The owner or operator of any facility providing 20 goods and services in the interest of the traveling public shall 21 have the right to continue using no more than one non22 conforming sign in each direction on any highway subject 23 to controls under a State law enacted to comply with this 24 section, which sign is providing directional information 25 about such facility, and which had been providing directional

1 information as of June 1, 1972, and which is within seventy2 five miles, or such other distance as the State in which the 3 sign is located may determine, until the Secretary determines 4 directional information about such facility is being adequately 5 provided to motorists traveling in that direction on such 6 controlled highway by conforming signs authorized by sub7 section 131 (d) of this title, by signs advertising activities 8 conducted on the property on which they are located, by 9 signs authorized by subsections 131 (c) (1) or 131 (f) of this 10 title, by any other nonconforming signs, or by such other means as the State in which the sign is located deems to b 12 adequate.".

TRAINING PROGRAMS

SEC. 111. The second sentence of subsection (b) of sec 15 tion 140 of title 23, United States Code, is amended to rea 16 as follows: "Whenever an apportionment is made under sub 17 sections 104 (b) (1), (b) (2), (b) (3), (b) (5), and (b) 18 (6) of this title for the fiscal years 1972, 1973, 1974, 1975 19 1976, the three-month period ending September 30, 1976 and the fiscal years 1977 and 1978, the Secretary shall de 21 duct from such apportionments such sums as he may deer 22 necessary not to exceed $5,000,000 per fiscal year for th 23 fiscal years 1972 and 1973, $10,000,000 per fiscal year fo 24 the fiscal years 1974, 1975, and 1976, $2,500,000 for th 25 three-month period ending September 30, 1976, and $10,

1 000,000 per fiscal year for the fiscal years 1977 and 1978, 2 for administering the provisions of this subsection to be 3 financed from the appropriation for the Federal-aid systems.".

DEFINING STATE

SEC. 112. Section 152 and section 153 of title 23, 6 United States Code, are amended by adding at the end of

7 each such section the following new subsection:

"(f) For the purposes of this section the term 'State'

9 shall have the meaning given it in section 401 of this title.".

OFF-SYSTEM ROADS

SEC. 113. Subsection (e) of section 219 of title 23, 12 United States Code, is amended by striking out “in a rural 13 area".

LANDSCAPING AND SCENIC ENHANCEMENT

SEC. 114. (a) Section 319 of title 23, United States

16 Code, is amended to read as follows:

17 "§ 319. Landscaping and scenic enhancement

"The Secretary may approve as a part of the construction of Federal-aid highways the costs of land and roadside 20 development, including acquisition and development of pub21 licly owned and controlled rest and recreation areas and 22 sanitary and other facilities reasonably necessary to accom23 modate the traveling public, and for acquisition of interests 24 in and improvement of strips of land necessary for the resto25 ration, preservation, and enhancement of scenic beauty ad26 jacent to such highways.".

1 (b) All sums authorized to be appropriated to carry 2 section 319 (b) of title 23, United States Code, as in ef 3 immediately before the date of enactment of this section sl 4 continue to be available for appropriation, obligation, a 5 expenditure in accordance with such section 319 (b), n 6 withstanding the amendment made by the first section 7 this Act.

SEC. 201. This title may be cited as the "Highway

HIGHWAY SAFETY

SEC. 202. The following sums are hereby authorized to 9 be appropriated:

(1) For carrying out section 402 of title 23, United 11 States Code (relating to highway safety programs), by the 12 National Highway Traffic Safety Administration, out of the Highway Trust Fund, $37,500,000 for the three-month 14 period ending September 30, 1976, $150,000,000 for the 15 fiscal year ending September 30, 1977, and $150,000,000 16 for the fiscal year ending September 30, 1978.

17 (2) For carrying out section 403 of title 23, United 18 States Code (relating to highway safety research and de19 velopment), by the National Highway Traffic Safety Ad20 ministration, out of the Highway Trust Fund, $16,250,000 21 for the three-month period ending September 30, 1976, 22 $65,000,000 for the fiscal year ending September 30, 1977, 23 and $65,000,000 for the fiscal year ending September 30, 24 1978.
