Mr. CASE introduced the following bill; which was read twice and referred to the Committee on Banking, Housing and Urban Affairs

A BILL

To amend the National Flood Insurance Act of 1968 to suspend until December 31, 1973, the provisions making flood insurance coverage a condition of Federal disaster assistance, to extend for two years the date by which an area must have adopted adequate land use and control measures in order to qualify for flood insurance coverage and the date as of which the existing authority for emergency Federal implementation of the program will expire, and to provide that coverage shall be available under the national flood insurance program for all residential properties.

SECTION 1. Section 1314 (a) (2) of the Housing and

5 Urban Development Act of 1968 is amended—

(1) by inserting "(or subsequent to December 31, 1973, if later)" after "located" in clause (A); and

(2) by inserting "(or on December 31, 1973, if later)" after "at that date" in clause (B).

SEC. 2. (a) Section 1305 (c) (2) of the Housing and 13 Urban Development Act of 1968 is amended by striking out 14 "December 31, 1971" and inserting in lieu thereof "De15 cember 31, 1973".

(b) Section 1315 of such Act is amended by striking 17 out "December 31, 1971" and inserting in lieu thereof "De

18 cember 31, 1973".

21 SEC. 3. Section 1336 (a) of the Housing and Urban

22 Development Act of 1968 is amended by striking out

23 "December 31, 1971" and inserting in lieu thereof "Decem24 ber 31, 1973".

SEC. 4. (a) Section 1305 (a) of the Housing and Urban 4 Development Act of 1968 is amended by striking out “resi5 dential properties which are designed for the occupancy of 6 from one to four families" and inserting in lieu thereof “resi7 dential properties".

8 (b) Section 1305 (b) of such Act is amended by strik9 ing out clause (A), and by redesignating clauses (B) 10 through (E) as clauses (A) through (D), respectively. (c) Section 1306 (b) (1) (A) of such Act is amended 12 to read as follows:

"(A) in the case of residential properties

"(i) (I) for a one-family residence or other dwelling structure containing one dwelling unit, an aggregate liability of $17,500,

"(II) for a single dwelling structure containing two dwelling units, an aggregate liability of

$30,000, or

"(III) for a single dwelling structure containing more than two dwelling units, an aggregate lia

bility equal to the sum of $30,000 plus $10,000 for

each such unit in excess of two; and

"(ii) an aggregate liability of $5,000 per

dwelling unit for any contents related to such unit;".

3 (d) Section 1306 (b) (1) (C) (ii) of such Act is 4 amended by striking out "per dwelling unit for any contents 5 related to such unit in the case of residential properties, or", 6 and by striking out "in the case of any other properties".

JOINT RESOLUTION

Amending the provision of law which denies Federal disaster assistance to properties which could have been covered by flood insurance but were not.
