4 SEC. 106. In the performance of, and with respect to, 5 the functions, powers, and duties vested in him by this title, 6 the Secretary shall (in addition to any authority otherwise 7 vested in him) have the functions, powers, and duties set 8 forth in section 402 (except subsections (a) and (c) (2)) of 9 the Housing Act of 1950.

TITLE II-BUSINESS DISTRICT RENEWAL

11 SEC. 201. It is the purpose of this title to assist local 12 nonprofit development companies in the exterior rehabilita13 tion, restoration, and beautification of small community busi14 ness districts in order to encourage community development. SEC. 202. The Secretary of Housing and Urban Devel16 opment (hereinafter referred to as the "Secretary") is au17 thorized to provide assistance as specified in section 204 to 18 any local nonprofit development company in any small com19 munity in the United States to aid in the exterior rehabilita

20 tion, restoration, and beautification of small community busi

SEC. 203. As used in this title

(1) The term "small community" means any com

24 munity, municipality, town, or village, which has a popula

25 tion of less than fifteen thousand according to the most

1 recent decennial census, and is not part of a metropolitan

2 area.

3 (2) The term "metropolitan area" means a standard 4 metropolitan statistical area, as established by the Office of 5 Management and Budget, subject however, to such modifica6 tions or extensions as the Secretary deems to be appropriate 7 for the purpose of this title.

8 (3) The term "appropriate governmental unit" means 9 the governmental unit which the Secretary determines to 10 have continuous exercise of primary authority over the per11 formance of public functions for the community, municipal12 ity, town, or village.

(4) The term "business district" means any area 14 offering a diversity of commercial facilities not under single

15 ownership.

SEC. 204. (a) In providing assistance to any local non17 profit development company to aid in the exterior rehabilita18 tion, restoration, and beautification of a community business 19 district, the Secretary is authorized to make planning grants 20 to local nonprofit development companies to help finance 21 the planning and design of the exterior rehabilitation, restora22 tion, and beautification of the community business district. (b) A planning grant under subsection (a) of this sec

24 tion shall not exceed two-thirds of the estimated cost of the

25 planning work for which the grant is made.

SEC. 205. In providing assistance to any local non

2 profit development company to aid in carrying out the plan

3 for exterior rehabilitation, restoration, and beautification of

4 the business district, the Secretary shall

(1) loan to such local nonprofit development com

pany an amount equal to two-thirds of the cost of rehabilitating, restoring, and beautifying the facade of the business district; and

(2) make grants to such local nonprofit development company in an amount equal to two-thirds the cost of rehabilitating, restoring, and beautifying the pub

lic areas of the district if the plan has been approved by the appropriate governmental unit.

SEC. 206. (a) Loans under this title, and any payments 15 thereto, shall be made upon such terms and conditions, in such 16 manner and form, and in accordance with such procedures 17 as the Secretary may determine to be reasonable and pre18 scribe in regulations.

19 (b) The Secretary may set such further terms and con20 ditions for assistance under this title as he determines to be 21 desirable.

22 SEC. 207. The Secretary shall take such action as may 23 be necessary to insure that all laborers and mechanics em24 ployed by contractors or subcontractors in the performance 25 of construction work assisted under this title shall be paid

1 wages at rates not less than those prevailing on similar con2 struction in the locality as determined by the Secretary of 3 Labor in accordance with the Davis-Bacon Act, as amended. 4 The Secretary shall not approve any such assistance without 5 first obtaining adequate assurance that these labor standards 6 will be maintained upon the construction work. The Sec7 retary of Labor shall have, with respect to the labor standards 8 specified in this section, the authority and functions set forth 9 in Reorganization Plan Numbered 14 of 1950, and section 10 276c of title 40.

A BILL

To amend title I of the Housing Act of 1949 to permit a city whose population falls to below fifty thousand to convert any outstanding urban renewal projects from a two-thirds to a three-fourths capital grant formula.
