1 "(f) The members of the initial or succeeding Boards 2 shall not, by reason of such membership, be deemed to be 3 employees of the United States Government. They shall, 4 while attending meetings of the Board or while engaged in 5 duties related to such meetings or in other activities of the 6 Board pursuant to this title, be entitled to receive compensa7 tion at the rate of $100 per day including traveltime, and 8 while away from their homes or regular places of business 9 they may be allowed travel expenses, including per diem 10 in lieu of subsistence, equal to that authorized by law (section 11 5703 of title 5, United States Code) for persons in the 12 Government service employed intermittently.

13 "(g) The Institute shall have a President and such other 14 executive officers and employees as may be appointed by 15 the Board at rates of compensation fixed by the Board. 16 No such executive officer or employee may receive any 17 salary or other compensation from any source other than 18 the Institute during the period of his employment by the 19 Institute.

20 "(h) The Institute shall establish, with the advice and 21 assistance of the Academies-Research Council, a Consulta22 tive Council, membership in which shall be available to a representative of all appropriate private trade, professional, 24 and labor organizations, private and public standards, code, 25 and testing bodies, public regulatory agencies, and consumer

1 groups, so as to ensure a direct line of communication be

2 tween such groups and the Institute and a vehicle for repre

3 sentative hearings on matters before the Institute.

"NONPROFIT AND NONPOLITICAL NATURE OF THE

INSTITUTE

6 "SEC. 1005. (a) The Institute shall have no power 7 to issue any shares of stock, or to declare or pay any 8 dividends.

9 "(b) No part of the income or assets of the Institute 10 shall inure to the benefit of any Director, officer, employee, or any other individual except as salary or reasonable compensation for services.

"(c) The Institute shall not contribute to or otherwise 14 support any political party or candidate for elective public 15 office.

"FUNCTIONS OF THE INSTITUTE

"SEC. 1006. (a) The Institute shall exercise its func18 tions and responsibilities in four general areas relating to 19 building regulation, as follows:

"(1) Development, promulgation, and maintenance

of nationally recognized performance criteria, standards,

and other technical provisions for maintenance of life,

safety, health and public welfare suitable for adoption by

24 building regulating jurisdictions and agencies, including

test methods and other evaluative techniques relating to

building systems, subsystems, components, products, and

materials.

"(2) Evaluation and prequalification of existing and new building technology in accordance with paragraph (1).

"(3) Conduct of needed investigations in direct support of paragraphs (1) and (2).

"(4) Assembly, storage, and dissemination of technical data and other information directly related to paragraphs (1), (2), and (3).

"(b) The Institute in exercising its functions and re12 sponsibilities described in subsection (a) shall assign and 13 delegate, to the maximum extent possible, responsibility for 14 conducting each of the needed activities described in subsec15 tion (a) to one or more of the private organizations, insti16 tutions, agencies, and Federal and other governmental en17 tities with a capacity to exercise or contribute to the exercise 18 of such responsibility, monitor the performance achieved 19 through assignment and delegation, and, when deemed neces

sary, reassign and delegate such responsibility.

"(c) The Institute in exercising its functions and respon22 sibilities under subsections (a) and (b) shall (1) give

particular attention to the development of methods for en24 couraging all sectors of the economy to cooperate with the 25 Institute and to accept and use its technical findings, and to

1 accept and use the nationally recognized performance cri2 teria, standards, and other technical provisions developed 3 for use in Federal, State, and local building codes and other 4 regulations which result from the prograin of the Institute; 5 (2) seek to assure that its actions are coordinated with re6 lated requirements which are imposed in connection with 7 community and environmental development generally; and 8 (3) consult with the Department of Justice and other agen9 cies of government to the extent necessary to insure that 10 the national interest is protected and promoted in the exer11 cise of its functions and responsibilities.

"FINANCING OF THE INSTITUTE'S ACTIVITIES

"SEC. 1007. (a) The Institute is authorized to accept

contracts and grants from Federal, State, and local govern15 mental agencies and other entities, and grants and donations

16

from private organizations, institutions, and individuals.

"(b) The Institute may, in accordance with rates and 18 schedules established with guidance provided by the 19 Academies-Research Council under section 1003 (b), estab20 lish fees and other charges for services provided by the In21 stitute or under its authorization.

"(c) Amounts received by the Institute under this 23 section shall be in addition to any amounts which may be 24 appropriated to provide its initial operating capital under 25 section 1009.

1 "COOPERATION BY FEDERAL GOVERNMENT AGENCIES AND

STATE AND LOCAL AGENCIES

"SEC. 1008. (a) Every department, agency, and estab4 lishment of the Federal Government, in carrying out any 5 building or construction, or any building- or construction6 related program, which involves direct expenditures, and in 7 developing technical requirements for any such building or 8 construction, shall be required to accept the technical findings 9 of the Institute, or any nationally recognized performance 10 criteria, standards, and other technical provisions for build11 ing regulations brought about by the Institute, which may 12 be applicable.

"(b) All projects and programs involving Federal as14 sistance in the form of loans, grants, guarantees, insurance,

or technical aid, or in any other form, shall, as a condition of 16 the assistance, accept, use, and comply with any of the 17 technical findings of the Institute, or any nationally recog18 nized performance criteria, standards, and other technical 19 provisions for building codes and other regulations brought 20 about by the Institute, which may be applicable to the pur

poses for which the assistance is to be used.

"(c) Every department, agency, and establishment of 23 the Federal Government having responsibility for building 24 or construction, or for building- or construction-related programs, is authorized and encouraged to request authorization
