Chapter 342.

An act to amend the charter of the Camden Village Corporation.

Be it enacted by the Senate and House of Representatives in Legislature assembled, as follows:

SECT. 1. Section two of "an act to incorporate the Act of 1867, Camden Village Corporation," approved February fourteen, eighteen hundred and sixty-seven, as amended by act of eighteen hundred and seventy-six, is hereby further amended by adding thereto the following words: and for seating, and for apparatus for lighting and warming said village hall, the amount invested for that purpose not to exceed twelve hundred dollars, to be raised by assessment, or loan on a time not exceeding ten years, as the corporation may decide,' so that said section, as amended, shall read as follows:

An act additional to an act, entitled "an act to supply the people of Augusta with pure water," approved March twelve, eighteen hundred and seventy.

Be it enacted by the Senate and House of Representatives in Legislature assembled, as follows:

SECT. 1. The said corporation may issue its bonds for the construction, extension and improvement of its works, upon such rates and time as it may deem expedient, not exceeding in all the sum of ten thousand dollars, and secure the same by a mortgage of the franchises and property of said company.

SECT. 2. This act shall take effect when approved.

Chapter 344.

An act to incorporate the Fifty Associates of Ellsworth.

Be it enacted by the Senate and House of Representatives in Legislature assembled, as follows:

SECT. 1. Aurelius A. Bartlett, Charles B. Partridge, Harvard Greely, Arthur W. Greely, Hollis C. Black, Horace H. Emerson, Lewis Friend, Owen Byrn, Joseph Emerson, Albert W. Cushman, George W. Newbegin, Owen Moran, Austin H. Joy, and their associates, successors and assigns, are hereby created a body corporate under the name of the Fifty Associates of Ellsworth, for the purpose of deriving profit from the loan and use of money, and with all powers necessary for that purpose, and subject to all the liabilities imposed on corporations.

SECT. 2. The capital stock of said corporation shall be CHAP. 345 five thousand dollars, which may be increased from time to Capital stock. time by said corporation to the extent of fifty thousand

dollars. Said capital stock shall be divided into shares of Shares. one hundred dollars each.

SECT. 3. Said corporation shall be located at Ellsworth, Where located. in the county of Hancock.

SECT. 4. This act shall take effect when approved.

Chapter 345.

An act additional, relating to the city of Portland, limiting its power to create debt.

Be it enacted by the Senate and House of Representatives in Legislature assembled, as follows:

SECT. 1. Neither the inhabitants of the city of Portland, nor the city council, nor any officer or officers thereof, shall hereafter create any debt or debts, liability or liabilities, on behalf of said city, which shall, singly, or in the aggregate with other debts and liabilities hereafter or heretofore created in behalf of said city, exceed five per cent. of the valuation of said city for the year in which it is proposed to create said debt or liability, nor shall create such debt or liability, so long as the aggregate debts and liabilities of said city exceed five per cent., as aforesaid, nor shall issue any notes, bonds, or any certificates or evidences of indebtedness, for any such debt or liability; nor shall the credit of said city be directly or indirectly loaned in any case, and no existing statute, whether public or private, shall be construed as vesting any authority to loan such credit, nor to create such debt or liability, or issue such bond, note or other evidence of indebtedness, nor shall any statute, public or private, hereafter passed, be construed as vesting such authority, unless express reference is made therein to the provisions of this act.

SECT. 2. This act shall not apply to any fund which said city may receive in trust, nor to any loan for municipal purposes, for payment of which, provision is made by assessment of the amount in the municipal tax during the municipal year in which the same is incurred, nor to any loan issued for the

When to take effect.

SECT. 3. The supreme judicial court shall have jurisdiction in equity to prevent violation of this act, on application of any one or more taxable inhabitants of said city.

SECT. 4. This act shall take effect on the fifteenth day of March, in the year of our Lord one thousand eight hundred and seventy-seven.

Chapter 346.

An act to promote the efficiency of the police force of the city of Portland. Be it enacted by the Senate and House of Representatives in Legislature assembled, as follows:

SECT. 1. The city marshal, deputy marshals and policeand policemen of men, of the city of Portland, shall hereafter be appointed by the mayor, by and with the advice and consent of the aldermen, and shall hold office during good behavior, subject, however, to removal at any time by the mayor, for inefficiency or other cause.

Inconsistent acts repealed.

SECT. 2. All acts and parts of acts inconsistent with this act are hereby repealed.

Protection of fish in Otter ponds.

Chapter 347.

An act for the protection of fish in certain ponds in the town of Standish.

Be it enacted by the Senate and House of Representatives in Legislature assembled, as follows:

Whoever, without authority, takes fish, in any manner, from the Otter ponds, so called, situate in the town of Standish, in the lands known as the Chadbourne plains, shall be punished, on complaint and proof thereof, by fine not exceeding ten dollars for each offense, and upon default of payment of such fine, shall be imprisoned not exceeding thirty days.

Chapter 348.

An act to amend "an act to incorporate the Trustees of the Sailors' Home, in

Portland."

Be it enacted by the Senate and House of Representatives

in Legislature assembled, as follows:

SECT. 1. The first section of "an act to incorporate the Act of 1854, sec. 1, Trustees of the Sailors' Home, in Portland," approved March twenty-four, eighteen hundred and fifty-four, is hereby amended, by adding, after the word "hold," in the seventh line, the words 'manage, sell and dispose of;' by adding, after the word "Portland," in the eleventh line, the words ' and such other purposes, for such improvement and benefit, as to said corporation may seem fit;' and by striking out the last two words at the end of said section, and substituting therefor, the words those objects,' so that said first section, as amended, shall read as follows:

SECT. 1. Israel Richardson, Nathan Cummings, John M. Corporators. Wood, Philip Greely, Saint John Smith, John B. Brown, William W. Thomas, Samuel Tyler, Joshua B. Osgood, William Chase, Byron Greenough, and Eben Steel, their associates and successors, are hereby constituted a body politic and corporate by the name of the Trustees of the Corporate name. Sailors' Home in Portland; and by that name shall have power to take and hold, manage, sell and dispose of, real and Powers and personal estate, to an amount not exceeding twenty-five thousand dollars, for the purpose of establishing and maintaining, for the improvement and benefit of seamen, a sailors' home in Portland, and such other purposes for such improvement and benefit, as, to said corporation, seem fit; and shall be authorized to receive, hold and manage all such gifts and grants as shall be made to them for those objects.'
