otherwise be paying to shelter, especially when the "shelter" is the same building which can be used for permanent housing. The cost of operating a shelter for 12 months is extraordinary. The same units which are being required to be used as shelter could be returned to the permanent housing stock immediately upon rehabilitation, thus saving the federal, state and local governments this extremely high cost of operation, while allowing these displaced persons to return to decent, affordable housing far more quickly.

FEMA's method of implementation of the settlement has effectively prevented the successful use of the excellent remedies put forth in the settlement agreement. FEMA's charge to provide relief to communities affected by natural disaster should certainly encourage innovative attempts to adapt to situations unique to each locale, rather than the apparent attempt to avoid the provision of appropriate aid, as seems to be the case in this instance.

The City has requested that FEMA restructure the method of implementation of the settlement so that an equitable, substantive provision of the remedies outlined in that settlement occurs; that proper notice be given to all eligible applicants; that written guidelines for application be provided; that the method for the determination of the number of eligible units be revised in accordance with the City's letter of March 22; and that an adequate and reasonable time period, both for application and for implementation, be provided.
