H.R. 8763-TO ESTABLISH THE OREGON DUNES NATIONAL RECREATIONAL AREA IN THE STATE OF OREGON, AND FOR OTHER PURPOSES

Mr. TAYLOR. The Subcommittee on National Parks and Recreation will come to order.

The legislation before the subcommittee this morning is H.R. 8763, by our colleague, Mr. Dellenback. If enacted this legislation would authorize the establishment of the Oregon Dunes National Recreation Area.

The subject is not new to the members of this subcommittee. Back in 1966 the subcommittee and the full committee recommended and the House approved legislation authorizing the establishment of the Oregon Dunes National Seashore. This legislation was not considered in the other body and did not become law.

In the years that have followed the gentleman from Oregon has spent a great deal of time and made a real effort to resolve the difficulties involved with the legislation.

Late last Congress, we held field hearings in Florence, Oreg. We held hearings on a similar bill-H.R. 778. Time did not permit us to follow up the hearings with action in that Congress and I am pleased that our colleague has reintroduced the legislation this year.

We discovered at the field hearings that there were differences of opinion as to the details, but that the project had strong support. I don't think we have conducted any field hearings in which there was more unanimity of support for a project than we had for this one.

Also, the members of the subcommittee were impressed by what they saw when they were visiting the area. There are wide beaches and blue lakes and sand dunes as impressive as any I have seen anywhere in America.

In the absence of objection a copy of the bill H.R. 8763, a copy of the Report of the Department of Agriculture dated October 8, 1971, and the material attached to it, and a copy of the report of the Department of Interior dated September 27, 1971, will be made a part of the record at this point.

Mr. DELLENBACK introduced the following bill; which was referred to the Committee on Interior and Insular Affairs

A BILL

To establish the Oregon Dunes National Recreation Area in the State of Oregon, and for other purposes.

Be it enacted by the Senate and House of Representa2 tives of the United States of America in Congress assembled, 3 That, in order to provide for the public outdoor recreation 4 use and enjoyment of certain ocean shorelines and dunes, 5 forested areas, fresh water lakes, and recreational facilities 6 in the State of Oregon by present and future generations and 7 the conservation of scenic, scientific, historic, and other values 8 contributing to public enjoyment of such lands and waters, 9 there is hereby established, subject to valid existing rights, 10 the Oregon Dunes National Recreation Area (hereinafter 11 referred to as the "recreation area"). The boundaries of the

1 recreation area shall be those shown on the map referred 2 to in section 4 of this Act.

3 SEC. 2. The administration, protection, and development 4 of the recreation area shall be by the Secretary of Agriculture 5 (hereinafter called the "Secretary") in accordance with the 6 laws, rules, and regulations applicable to national forests, in 7 such manner as in his judgment will best contribute to attain8 ment of the purposes set forth in section 1 of this Act.

SEC. 3. The area delincated as the "Inland Sector" on 10 the map referenced in section 4 of this Act is hereby estab11 lished as an inland buffer sector in order to promote such

management and use of the lands, waters, and other proper13 ties within such sector as will best protect the values which

contribute to the purposes set forth in section 1 of this Act. SEC. 4. The boundaries of the recreation area and the 16 inland sector shall be as shown on a map entitled "Proposed 17 Oregon Dunes National Recreation Area" dated May 1971, which is on file and available for public inspection in the Office of the Chief, Forest Service, Department of Agricul20 ture, and to which is attached and hereby made a part thereof 21 a detailed description by metes and bounds of the exterior 22 boundaries of the recreation area and of the inland sector. 23 The Secretary may by publication of a revised map or de24 scription in the Federal Register correct clerical or typo25 graphical errors in said map or descriptions.

SEC. 5. All lands of the United States within the ex2 terior boundary of the recreation area are hereby made a part 3 of the recreation area for the purposes of this Act: Provided, 4 That lands required for the purposes of the United States 5 Coast Guard or the United States Corps of Engineers shall 6 continue to be used by such agencies to the extent required 7 for such purposes.

SEC. 6. The boundaries of the Siuslaw National Forest 9 are hereby extended to include all of the lands not at 10 present within such boundaries lying within the recreation 11 area as described in accordance with section 4 of this Act. SEC. 7. Within the inland sector established by section 13 3 of this Act the Secretary may acquire the following classes

14 of property only with the consent of the owner:

(a) improved property as hereinafter defined;

(b) property used for commercial or industrial purposes if such commercial or industrial purposes are the

same such purposes for which the property was being

used on December 31, 1970, or such commercial or in

dustrial purposes have been certified by the Secretary

or his designee as compatible with or furthering the purposes of this Act;

(c) timberlands under sustained yield management so long as the Secretary determines that such manage

ment is being conducted in accordance with standards
