CONSTRUCTION OF AREA VOCATIONAL EDUCATION SCHOOLS

4.1

Procedures for Taking Action on Area Vocational Education School
Facility Projects

4.11 Projects undertaken by State Board

4.11-1 The State Board may authorize the Department of

Finance to purchase sites, plan and construct area

vocational schools meeting the standards and condition. 580 M

4.12-22 The portion of the State's allotment of

Federal funds for any fiscal year allocated

for such projects shall be available for paying, not to exceed one-half of the cost

of construction for each area vocational

education school facility project. (See

1963 Vocational Education Act, Section 6 (c))

4.13 Clearance with other State Agencies

The State Board shall secure the approval of the Department
of Finance for the construction and remodeling of all area
Vocational school facilities. Such construction or remodeling
shall meet the standards and requirements of the Engineering
Division of the Finance Department and the Division of Build-
ing and Grounds in the State Department of Education

4.2 Criteria in determining relative priorities of projects

The State Board, upon recommendation of the State Director, shall

approve projects on the basis of the following criteria:

Justification of the project:

4.21-1 Number of people available for training

4.21-2

Socio-economic conditions in the area to be served

4.21-3 Adequacy of the proposed facility, site and location

4.21-4

to serve the training needs

Attitude, demands and support of the people within

the area to be served by the facility

4.21-5 Job opportunities available

4.21-6 Availability of the facility to all residents of the

State, or an area of the State, designated and approved

4.21-7 Willingness of the school to admit as regular students,

both persons who have completed high school and persons

who have left high school

4.22 Priorities for projects

Insofar as Federal, State and local funds are made available

for such projects, the following order of priorities shall
be given to projects:

4.22-1 Area vocational-technical schools used exclusively

or principally for the provision of vocational education
to persons who have completed or left high school and
who are available for full-time study in preparation for
entering the labor market

A public high school used exclusively or principally
for the provision of vocational education to persons
who are available for full-time study in preparation
for entering the labor market and offers approved
vocational education programs in no less than five
different occupational fields

The department of a public high school used exclusively
or principally for providing vocational education in no
less than five different occupational fields to persons
who are available for full-time study in preparation

for entering the labor market

4.22-4 The department or division of a public junior college, technical institute, or community college or university, which provides vocational education in no less than

five different occupational fields, under the supervision

but not leading to a baccalaureate degree

4.3 Terms and conditions for approval of projects

The State Board will require the following assurances in approving

projects for Federal financial participation:

A written statement from an authorized official indicating
the State and local building codes and requirements will be
met before approval of the project is given and financial
support is made available

4.32 Copies of the project plans, indicating that the facility will be functional, will meet the needs of the persons in the communities to be served, will not be uneconomical, elaborate

or extravagant in design or materials and will be made available for review by the State Board

4.33 Evidence that sufficient funds are available, or have been

voted, to meet the State and local share of the cost of
construction of the facility

4.34 Evidence that sufficient State and local funds will be available, when construction is completed, for effective use of the facility for the purposes for which it is being constructed

4.35 A written statement from appropriate officials indicating that the interest in the land on which the facility is located is sufficient to assure undisturbed use and possession during the expected usable life of the facility. This includes the purpose of construction and operation of the school facility covered in the project.

4.36 A written statement from the appropriate official indicating that representatives of the U. S. office of Education, and such other persons as the Commissioner may designate, will

have access at all reasonable times to the project wherever
it is in preparation or progress, and the contractor will
provide proper facilities for such access and inspection
That all laborers and mechanics employed by contractors and
subcontractors on all construction projects assisted under
the 1963 Vocational Education Act will be paid wages at rates
not less than those prevailing as determined by the Secretary
of Labor in accordance with the Davis-Bacon Act as amended
(Act of March 3, 1931, P.L. 798, ch. 411, 46 Stat. 1494,
40 U.S.C. 276 a - 5), and 29 C.F.R. Part I (See 29, F.R. 95),
and shall receive overtime compensation in accordance with
and subject to the provisions of the Contract Work Hours
Standards Act (P.L. 87-581, 76 Stat. 357, 40 U.S.C. 327 - 330)
as provided for in Section 203 (a) (4) of such Act, and that
such contractors and subcontractors shall comply with the
provisions of 29 C.F.R. Part 3 (See 29 F.R. 97) and abide by
the contract clauses required by 29 C.F.R. 5.5 (a) and (c)
(See 29 F.R. 100,101)

That there will be incorporated, pursuant to 60 C.F.R. 1.3 (b)
(1), into any contract for construction projects assisted
under the 1963 Vocational Education Act, the non-discrimination
clause prescribed by section 301 of Executive Order No. 111
