(a) The Federal Water Pollution Control Act is amended to add a new title I. (b) Section 1 of the Federal Water Pollution Control Act is re18 designated as Section 101. 19 (c) Section 101, as redesignated, is further amended by striking the 20 second and third sentences of subsection (b) and inserting "The Administrator of the Environmental Protection Agency (hereinafter 22 in this Act called 'Administrator') shall administer this Act." 21 23 SEC. 2. Section 2 of the Federal Water Pollution Control Act is 24 repealed. 25 26 COMPREHENSIVE PROGRAMS FOR WATER POLLUTION CONTROL SEC. 3. (a) Section 3 of the Federal Water Pollution Control Act is 27 redesignated as section 102. 28 (b) Section 102, as redesignated, is further amended (1) by striking 29 "Secretary" wherever it appears and inserting "Administrator"; and 30 (2) by striking "interstate waters and tributaries thereof" in the first sentence of subsection (a) and inserting "interstate and intrastate waters and groundwaters"; and (3) by striking subsection (c). 31 32 33 INTERSTATE COOPERATION AND UNIFORM LAWS 34 SEC 4. Section 4 of the Federal Water Pollution Control Act is 35 redesignated as Section 103. 36 37 RESEARCH, INVESTIGATIONS, TRAINING and informaTION SEC. 5. (a) Section 5 of the Federal Water Pollution Control Act is 38 redesignated as section 104. 39 40 41 (b) Section 104, as redesignated, is further amended (1) by striking "Department of the Interior" wherever it appears and inserting "Environmental Protection Agency"; 1 3 4 5 6 (2) by striking "Secretary" wherever it appears and inserting "Administrator." (3) by striking subsections (a), (b), and (c) and inserting the following: SEC. 104. "(a) The Administrator shall establish national research and development programs for the prevention and control of water 7 pollution and as part of such program shall— 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 "(1) conduct, and promote the coordination and acceleration of, research, investigations, experiments, training, demonstrations, surveys, and studies relating to the causes, effects, extent, prevention, and control of water pollution; "(2) encourage, cooperate with, and render technical services and provide financial assistance to water pollution control agencies and other appropriate public or private agencies, institutions, and organizations, and individuals, including the general public, in the conduct of such activities; "(3) conduct investigations and research and make surveys concerning any specific problem of water pollution in cooperation with any water pollution control agency with a view to recommending a solution of such problem, if he is requested to do so by such agency, or if, in his judgment, such problem may affect any community or communities in a State other than that in which the source of the matter causing or contributing to the pollution is located; "(4) establish advisory committees composed of recognized experts in various aspects of water pollution and representatives of the public to assist in the examination and evaluation of research progress and proposals and to avoid duplication of research. "(5) In cooperation with the States and other Federal agencies establish, equip, and maintain a water quality surveillance system for the purpose of monitoring the quality of the navigable waters of the United States, the contiguous zone, and the oceans, and shall report on such quality in the report required under subsection (a) of section 514. "(b) In carrying out the provisions of (a) of this section the Administrator is authorized to "(1) collect and make available, through publications and other appropriate means, the results of and other information, including appropriate recommendations by him in connection therewith, pertaining to such research and other activities; "(2) cooperate with other Federal departments and agencies, with water pollution control agencies, with other public and private agencies, institutions, and organizations, and with any industries involved, in the preparation and conduct of such research and other activities; "(3) make grants to water pollution control agencies, to other public or nonprofit private agencies, institutions, and organizations, and to individuals, for purposes stated in subsection (a)(1) of this section; 12 2 3 4 5 6 8 9 10 11 12 13 14 15 16 17 18 19 20 21 23 "(4) contract with public or private agencies, institutions, and organizations, and with individuals, without regard to sections 3648 and 3709 of the Revised Statutes (31 U.S.C. 529; 41 U.S.C. 5); "(5) provide training for, and make training grants to, personnel of water pollution control agencies and other persons with suitable qualifications; "(6) establish and maintain research fellowships, in the Environmental Protection agency and at public or nonprofit private educational institutions or research organizations; "(7) collect and disseminate, in cooperation with other Federal departments and agencies, and with other public or private agencies, institutions, and organizations having related responsibilities, basic data on chemical, physical, and biological effects of varying water quality and other information pertaining to water pollution and the prevention and control thereof; and "(8) develop effective and practical processes, methods, and prototype devices for the prevention or control of water pollution. "(c) In carrying out the provisions of subsection (a) of this section 22 the Administrator shall conduct research on, and survey the results of other scientific studies on, the harmful effects on the health or welfare 24 of persons by the various known water pollutants. The Administrator 25 is authorized to construct such facilities and staff and equip them as 26 he determines to be necessary to carry out his functions under this 27 Act." 28 29 30 31 32 33 34 35 (4) by striking "13" in the second sentence of subsection (j) and inserting "312"; (5) by striking "10(c)" in the first sentence of paragraph (1) of subsection (1) and inserting "302 or 303". (6) by adding a new subsection (m) as follows and renumber accordingly: "(m) (1) The Administrator shall, in an effort to prevent degradation of the environment from the disposal of waste oil, conduct a study of 36 (A) the generation of waste oil, including quantities generated, the 37 nature and quality of such oil, present collecting methods and disposal 38 practices, and alternate uses of such oil; and (B) the potential market 39 for such waste oils; including the economic and legal factors relating to 40 the purchase of products made from such waste oils, the level of 41 subsidy, if any, needed to encourage the purchase by public and non42 profit agencies of products from such waste oil, and the practicability 43 of Federal procurement, on a priority basis, of products made from 44 such waste oil. 45 "(2) the Administrator shall report the results of such study to the 46 Congress within six months of enactment of the National Water 47 Quality Standards Act of 1971." 48 (6) to repeal paragraph (4) of renumbered subsection (n); |
