COMMISSION ON THE BICENTENNIAL OF THE U.S. CONSTITUTION

90.001 BICENTENNIAL EDUCATIONAL GRANT

PROGRAM

FEDERAL AGENCY: COMMISSION ON THE BICENTENNIAL OF THE U.S. CONSTITUTION AUTHORIZATION: Arts, Humanities, and Museums Amendments of 1985, Title V, Section 501 (a), Public Law 99-194. OBJECTIVES: To help elementary and secondary school teachers develop a better understanding of the history and development of the U.S. Constitution and Bill of Rights so that they will become more able to teach the Constitution to young learners. TYPES OF ASSISTANCE: Project Grants.

USES AND USE RESTRICTIONS: Funds may be used to develop instructional materials and programs on the U.S. Constitution and Bill of Rights. Instructional materials and projects developed must be for use in elementary or secondary schools. Funds may not be used to purchase property, undertake construction, pursue an academic degree, promote partisan political or religious advocacy, involve the Commission in the policy-making processes of any government or agency.

ELIGIBILITY REQUIREMENTS:

Applicant Eligibility: Local educational agencies, private elementary and secondary schools, private organizations, individuals, and State and local agencies. Colleges, universities, and adult education programs are eligible if the project activities proposed to be carried out are for use in an elementary or secondary school environment. Grants will not be made to profit-making organizations. Beneficiary Eligibility: State and local educational agencies, private and public elementary and secondary schools, nonprofit organizations, colleges and universities, individuals, elementary and secondary teachers. Credentials/Documentation: Costs will be determined in accordance with OMB Circular No. A-87 for State and local governments. Costs will be determined in accordance with OMB Circular No. A-122 for nonprofit organizations. Costs will be determined in accordance with OMB Circular No. A-21 for educational institutions.

APPLICATION AND AWARD PROCESS:

Preapplication Coordination: A preapplication is not required. This program is excluded from coverage under Executive Order No. 12372.

Application Procedure: Submission of a Standard Form 424 Short Form Application Package Modified. The application package consists of SF-424 and a budget form. Applicants must also submit a one-page proposal abstract, a budget narrative explaining the project budget and a 5 to 15 page proposal narrative. Forms and detailed application instructions are contained in yearly program announcement. This program is subject to the provisions of OMB Circular Nos. A-102 and A-110.

Award Procedure: Applications are pre-screened for conformity with submission requirements. Acceptable applications are then rated by external review panels and Commission program officers. Awards are approved by the Commission's Education Advisory Committee after recommendation by the grant program staff. Deadlines: October 15, 1988.

Range of Approval/Disapproval Time: Approximately 4-1/2 months. Appeals: None.

Renewals: Not applicable.

ASSISTANCE CONSIDERATIONS:

Formula and Matching Requirements: No formula requirements; applicants are encouraged to provide cash or in-kind match. Length and Time Phasing of Assistance: Awards range from 6 to 18 months. Grant funds must be spent during the grant period. Fund

ing is released gradually through a letter of credit, advance payments, or through reimbursement.

POST ASSISTANCE REQUIREMENTS:

Reports: Progress Reports are required quarterly. Financial Reports are due quarterly. Interim and final reporting requirements are contained in every grant agreement.

Audits: Nonprofit organizations are required to provide audits in accordance with OMB Circular No. A-110. In accordance with the provisions of OMB Circular No. A-128, “Audits of State and Local Governments," State and local governments that receive financial assistance of $100,000 or more within the State's fiscal year shall have an audit made for that year. State and local governments that receive between $25,000 and $100,000 within the State's fiscal year shall have an audit made in accordance with Circular No. A-128, or in accordance with Federal laws and regulations governing the programs in which they participate. Records: Program and financial records must be retained for 3 years following submission of the final expenditure report. Grantees are required to follow the records retention requirements of OMB Circular Nos. A-102 or A-110 and Office of Justice Programs Handbook M 7100.1C.

Obligations: (Grant) FY 87 $996,000; FY 88 est $3,400,000; and FY 89 est $4,508,000.

Range and Average of Financial Assistance: $1,000 to $100,000; $34,390.

PROGRAM ACCOMPLISHMENTS: For fiscal year 1987, 222 applications were received. A total of 27 were administratively rejected, 165 were accepted for review and 30 were funded. During fiscal year 1988, the Commission anticipates receiving up to 700. From 40 to 60 projects are expected to receive funding. Data unavailable for fiscal year 1989.

REGULATIONS, GUIDELINES, AND LITERATURE: 45 CFR 2010 published August 14, 1987, in the Federal Register (52 FR 30582). Copies of the regulation and program announcement are available from the Commission. In addition, the Commission publishes an annual application kit consisting of the program announcement and application forms with instructions. EXAMPLES OF FUNDED PROJECTS: Examples of projects funded in fiscal year 1987 include: (1) History Teaching Alliance Summer Institutes on the Constitution at 14 conference sites; (2) Colorado Department of Education elementary school curriculum guide for responsible citizenship; (3) New York Historical Society 10-part video tape, Constitution on the Air programs; (4) Center For Research and Development in Law-Related Education (CRADLE), 3-week institute and curriculum development project for 25 elementary teachers.

CRITERIA FOR SELECTING PROPOSALS: (1) Potential for project to strengthen ability of teachers to teach the Constitution; (2) Potential for project to achieve wider impact beyond immediate funding; (3) Cost effectiveness of project; (4) Potential for wider audience impact; (5) Potential of project to improve teaching methods; (6) Applicant capacity to manage and carry out project.

OMB Circular No. A-87 establishes principles and standards for deermining costs applicable to grants and contracts with State and local overnments. They are designed to provide the basis for a uniform aproach to the problem of determining costs and to promote efficiency nd better relationships between grantees and the Federal Govern

When State and local governments are recipients, the following prorams listed in the Catalog of Federal Domestic Assistance are subject > the provision of A-87, except where restricted or prohibited by law. Included also in the list are programs falling under the purview of 1-87 because the Federal grantor agencies have elected to use the A7 standards for recipients and programs not otherwise covered by the ircular.

OMB Circular No. A-102, establishes uniform administrative standrds for the administration of grants and contracts to State and local overnments.

Included also in the list are programs falling under the purview of MB Circular No. A-102 because the Federal grantor agencies have lected to use the OMB Circular No. A-102 standards for recipients ad programs not otherwise covered by the circular.

Environmental Impact Statement

Specific programs listed in the Catalog of Federal Domestic Assistace have been determined to have a significant effect on the environent and require an environmental assessment or an Environmental npact Statement (EIS) under Section 102(2)(C) of the National Envi>nmental Policy Act of 1969 (Public Law 90-190; 42 U.S.C. 332(2)(C), and Executive Order 11514 (34 FR 4247) of March 4, 1970, Significant effects include actions that may have both beneficial and etrimental effects.)

In the early stages of project application, and in all cases prior to gency decisions concerning major action, the applicant should be adised by the Federal agency from which assistance is being sought that e will be required to submit environmental impact information (to be ibmitted under agency guidelines) in connection with the proposed roject for an environmental assessment (to be made by the Federal gency), or an Environmental Impact Statement (to be supplied by the ederal agency) concerning the proposed project.

Although the list below is not inclusive, it contains programs normally requiring either an environmental assessment or an Environmental Impact Statement.

OMB Circular No. A-110 sets forth administrative requirements for the administration of grants and other agreements to include money or property in lieu of money; does not include technical assistance programs providing services, loans, loan guarantees, insurance, or direct payments to individuals. Reference to this circular appears in the Application Procedure section of programs that apply.

Applicants are public and private institutions of higher education, hospitals, and other quasi-public and private nonprofit organizations. Executive Order 12372

Executive Order 12372 "Intergovernmental Review of Federal Programs,” structures the Federal government's system of consultation with State and local governments on its decisions involving grants, other forms of financial assistance, and direct development. Under E.O. 12372, States, in consultation with their local governments, design their own review processes and select those Federal financial assistance and direct development activities they wish to review.

Since October 1, 1983 most States have acted to establish a review and comment system in response to E.O. 12372. In such cases, applicants for grants will need to meet the requirements of the intergovernmental consultation process established by a particular State and its local governments before Federal agencies take action on an application.

For more information on the process a particular State requires to be followed, an applicant should contact the office or official designated as the single point of contact in his or her State. Consult the individual program description in the Catalog to determine whether the programs under which he/she plans to apply is subject to E.O. 12372. Consult the Federal agency's application package for instructions on State notification.
