General Explanation of the Code of

Federal Regulations

The Code of Federal Regulations is an orderly arrangement of the general and permanent rules published in the Federal Register by the Executive departments and agencies pursuant to the Administrative Procedure Act and other statutory requirements within the purview of the Federal Register Act.

The Code is arranged under functional titles representing broad areas subject to Federal regulation. Chapters within each title generally bear the name of the issuing agency. The "Table of CFR Titles and Chapters" is therefore a ready means of locating agency materials. The general arrangement and numbering of the Code is prescribed in Part 17 of Title 1.

As of January 1, 1967, the Code consisted of 111 units. Each book contains an explanation designed to assist the user. All books are either revised or supplemented at least once each year. In general, books that are revised annually, or more frequently, are paper-bound, and each revision is cumulative. Books less. subject to change are permanently bound and provided with pockets for the insertion of supplements. Such pocket supplements are cumulated and reissued at least once each year.

Revised books and supplements generally contain the rules in effect on January 1 of the year designated on the cover, title page, and opposite the table of contents. Exceptions to this rule are distinguished with equal prominence at these same points in each case.

Obsolete provisions are not carried in revised books or cumulative supplements. Code users may trace the text of provisions in force and effect on a given date in the past by using the numerical lists of sections affected (also known as "codification guides"). For the period before January 1, 1964, the user should consult the "List of Sections Affected, 1949-1963" published in a separate volume. For the period beginning January 1, 1964, a "List of Sections Affected" is published at the end of each revised book. Each pocket supplement is also provided with a “List of Sections Affected" for the period covered by the supplement.

The Code is kept up to immediate date by the daily issues of the Federal Register in which all amendments are promulgated under the Code numbering system. To provide a ready and reliable means of following daily Code amendments a numerical guide listing parts affected is published in the Federal Register and cumulated daily within each month. A List of CFR Sections Affected is published monthly on a cumulative basis indicating the nature of changes effected.

The subject index to the Code, which is revised annually, is contained in a separate volume entitled "General Index".

The text of the Code of Federal Regulations is by law prima facie evidence of the text of the original documents and is required to be judicially noticed (44 U.S.C. 307, 311).

Explanation

This book contains the rules, regulations, and finding aids constituting Titles 1, 2, and 3, revised as of January 1, 1967. It replaces the volume entitled "Title 1-General Provisions, Title 2-The Congress, Title 3-The President, Revised as of January 1, 1966," and becomes an integral part of the Code of Federal Regulations. The text in this revision is derived from the latest text of the rules and regulations, general and permanent in nature, duly promulgated on or before December 31, 1966. Source materials from which the text is derived are cited with the text and should be consulted to determine the effective date of any given provision. All dates appearing in the source citations are dates of publication in the Federal Register and should not be construed as effective dates.

Current regulatory material appearing in the daily issues of the Federal Register follows the numbering system used herein, and serves as a daily supplement hereto. In addition to the finding aids comprising Title 2 and Chapters I to III of Title 3, this book contains the following: a list of current CFR volumes; a list of superseded CFR volumes; a table of CFR titles and chapters; an alphabetical list of CFR subtitles and chapters; and a list of sections affected which furnishes Federal Register citations to all changes in Title 1, beginning January 1, 1964, including changes which are no longer in effect.

A compilation of the list of sections affected for the entire Code of Federal Regulations from January 1, 1949, through December 31, 1963, is published in a separate volume entitled "List of Sections Affected, 19491963."

This book is published pursuant to Part 30 of the regulations of the Administrative Committee of the Federal Register, as revised December 7, 1965 (30 F.R. 15131; 1 CFR Part 30), under the authority contained in section 11 of the Federal Register Act (67 Stat. 388, as amended; 44 U.S.C. 311). The contents of the Federal Register and of the Code of Federal Regulations are by law prima facie evidence of the text of the original documents and are required to be judicially noticed (49 Stat. 502, 67 Stat. 388; 44 U.S.C. 307, 311). The approved citation of the Code is "CFR". Thus the citation "1 CFR 1.0" refers to section 1.0 of Title 1.
